The Social Policy and Labor Law – Selected Issues

Polityka społeczna a prawo pracy. Wybrane problemy

Author(s): / Language(s): Polish

Keywords: social policy; health policy; employment protection; people with disabilities; corporate social responsibility; occupational burnout; discrimination; family policy; temporary work agency; ageing; job placement; people with disabilities; unemployment

Scientific conferences entitled “ Szubert Seminars”, organised at the Faculty of Law and Administration of the University of Lodz, have a long tradition. These meetings have two main goals. The first, is to show the multifaceted achievements of an outstanding and recognized researcher of social policy and labour law – Wacław Szubert. The second, is to pay attention to the universality and timelessness of the observations made by this author. His opinions can be an important hint for all researchers currently dealing with employment issues, counteracting unemployment, social insurance, health care and social economy. The variety of topics covered in this book shows the complexity of the relationship between labour law and social policy. Both areas of science benefit from the fact that their representatives conduct research in close cooperation. Thanks to this, social policy becomes the basis for building the axiological assumptions of labour law institutions. Labour law, in turn, provides tools for verifying the objectives and tasks defined by social policy, as well as the ways of their implementation.

Hostages of History. The Polish Minority in Post-Soviet Lithuania

Zakładnicy historii. Mniejszość polska w postradzieckiej Litwie

Author(s): Barbara Jundo-Kaliszewska / Language(s): Polish

Keywords: Vilnius region; nationality policy; Polish-Lithuanian conflict; Polish minority in Lithuania; association of Poles in Lithuania

The author presents a historical approach to the issue of the Polish national revival in the contemporary Vilnius region in the late 1980s and early 1990s, paying particular attention to the efforts aimed at establishing an autonomous Polish-speaking administrative unit within Lithuania. The theme of nationality policy in the countries of the former Union of Soviet Socialist Republics is continually returning in the international public sphere. For political reasons, the events described in the book have historically been controversial and continue to affect bilateral relations between Poland and Lithuania; their origin is therefore well worth learning about.

Elements of Set Theory

Elementy teorii mnogości

Author(s): Marek Nowak / Language(s): Polish

Keywords: cardinal numbers;transfinite sequence;sets of ordinal numbers;natural numbers;binary relations;well-founded and non-well-founded sets;axiomatic;set theory

The monograph contains the most important elements of the Zermelo-Fraenkel axiomatic set theory with the axiom of choice: axiomatics, definitions of basic concepts, theories of binary relations, partial ordering, equivalence, functions, ordinal numbers and cardinal numbers. It was created on the basis of lectures conducted over many years by the author for philosophy students at the University of Łódź. Therefore, it does not require a thorough mathematical background; it is enough to have some logical "skills" in theorem proving, or, indeed, a knowledge of such logical constants as Boolean functions and quantifiers. It can be used not only by mathematicians and mathematics students, but also by humanists wishing to consolidate their knowledge of sets, often used in various formalization procedures. The more so because some topics have a philosophical character, including discussions about the axiom of regularity and the concept of founding a set, equivalence relation, ordinal number or axiom of choice.

The Reform of Contract Law in France: Deliberations by European Lawyers

La réforme du droit des contrats en France – réflexions de juristes européens

Author(s): / Language(s): French

Keywords: Abusive clauses; civil law; contract law; contract theory; French Civil Code; contractual obligations; collective labour agreements

The monograph, inspired by the reform of contract law in France, is a collection of texts written by outstanding academics from France, Germany, Poland and Switzerland. The first part of the book sets the stage by presenting the most important changes introduced into the French Civil Code. Those modifications become the starting point for subsequent deliberations regarding their influence on the development of both German and Polish contract law. The second part of the publication contains an analysis of the French concept of ‘imprévision’, followed by a presentation of the aforementioned doctrine in the German and Swiss law as well as of the corresponding concept of clausula rebus sic stantibus in Polish law. The third part of the book contains considerations on the application of contract theory in other areas of law, which is of vital importance in legal practice.

Zarządzanie publiczne w lokalnym sektorze kultury

Author(s): Wawrzyniec Rudolf / Language(s): Polish

Keywords: public management in sector of culture; cultural institutions; new public management; public governance; stewardship theory; agency theory

Public management has been an area of dynamic development for years, both in terms of scientific research and practical action. This study deals with public management in cultural sector, which in Poland is dominated by public and social actors. The territory's cultural potential can constitute its development foundation and more and more cities and regions are taking efforts to take advantage of these values. When considering the specificities of public management in the field of cultural sector, the author argues that systemic and organizational solutions based on a market approach are not fully applicable in this sector and show defects that could result in dissatisfaction and resistance of the part the directors of city cultural institutions and their staff. The specificity of culture and employees of the cultural sector communities professionally connected with culture is not conducive to the introduction of solutions for which rigid regulations, quantitative tasks or competition for clients are the daily context of the activities carried out. The study highlights the social nature of the cultural sector, which makes it difficult to apply market-based performance improvement actions and instruments, based on financial motivation or individualistic approach. The study provides an in-depth analysis of the relationship between the city administration acting on behalf of local authorities, on the one hand, and the directors of museums, theatres, cultural centres or galleries (cultural institutions) that belong to the city and are financed from local budget. The monograph aims to analyze this relation in the light of two theories: agency and stewardship. Using both theories, which are part of the institutional economy, the author intends to answer the question of how much these relationships can be described by the agency's theory of market-based NPM model, and to what extent by stewardship's theory, which is part of a relational NPG model, based on interaction and trust. The monograph, due to the empirical material obtained from the selected city of Lodz, also has application value. The conclusions drawn may prove useful for those cities which intend to use the sphere of culture in promoting their socio-economic development. The presented proposals for solutions, in terms of optimizing the management of the relationship: authorities/administration – the directors of the cultural organizations were inspired by the statements of respondents representing both sides of the analyzed relations.

The book deals with the important and current subject of the effectiveness of the creation and functioning of Supply Chains in a changing, uncertain reality. It presents the results of analyzes on increasing the adaptability of supply chains. The authors focus on finding answers to the main research question of building resilience while maintaining operational efficiency and cost-effectiveness on the one hand, and on the other hand, being prepared for turmoil in the long term. Importantly, it is not about another possible wave of a pandemic, but about natural disasters, climate change, cyberattacks or limited access to certain resources that affect the efficiency of supply chains supporting all socio-economic processes. The research results are presented in four chapters and they concern:• Epistemological considerations aimed at examining the evolution of supply chains in conditions of disruptions and shaping the main pillars of chain adaptability in a turbulent environment,• Economic aspects of adaptability of supply chains along with its vulnerability determined shaped externally (e.g. due to the political factor),• Improvement of supply chains in the pharmaceutical industry, in the context of an increase in adaptive relations in the face of increasing instability of the environment,• Legal conditions governing the functioning of adaptive supply chains of medicinal products, including vaccines against COVID-19 and the issue of the risk of interference with active substances. The research should be of interest not only to universities and science institutions, but also managers responsible for the functioning of supply chains, healthcare entities and medical units servicing deliveries, as well as people interested in Logistics, Transport and Innovation.

"Micro-scale revitalizations of backyards”. Socio-educational action research

"Małe rewitalizacje podwórek". Społeczno-pedagogiczne badania-działania

Author(s): Anita Gulczyńska,Mariusz Granosik / Language(s): Polish

Keywords: Action-research; neighborhood; urban regeneration / revitalization; participation; social work (praca społeczna) work; strenghts

The book is a result of the theorization of a tripartite process (academia / students + young residents of disadvantaged urban neighborhoods (DUN)+ employees of institutions involved in the local system of social and educational support for residents of such places) of co-creation the space of life environments of DUN young residents in the course of participatory research-action (PAR) conducted in 2018-2021. The idea of the research stems from the tradition of linking theoretical work, clinical practice and academic education in the development of the Łódź theoretical model of social work (praca społeczna). The book presents the complex justifications and the results of this study, rich in empirical illustrations. The first three chapters cover the theoretical rationale of a socio-pedagogically oriented PAR with children and young people from DUN. The fourth one describes the methodological assumptions of the research. It argues the selection of research method, research focus, and data collection techniques in qualitative research governed by the regularities of the participatory research strategy. It introduces the reader into the research territory and reports on the research process. In the next chapters the results of the study are presented and discussed: - reconstruction of typological categorization of the neighborhoods; - human, social, historical and economic strengths uncovered in these places; - reconstruction of the process of co-production of the socio-educational revitalization of the living environment of downtown neighborhoods (called by the authors "small revitalization of backyards") In the final part of the book the reader finds elements of reflection on participatory revitalization-driven and rooted in the identity of social pedagogy transformations that were observed in all parties of the research as well as critical reflection on the overall process.

Selected sources of financing for micro, small and medium-sized enterprises in Poland

Wybrane źródła finansowania mikro, małych i średnich przedsiębiorstw w Polsce

Author(s): Joanna Fila,Elżbieta Grzegorczyk,Marta Paduszyńska / Language(s): Polish

Keywords: MSMEs; funding; microfinance; crowdfunding; mortgage loan

The enterprises operate in a competitive and unstable environment, which is considered a normal phenomenon in a free-competitive economy. They constantly look for better and better solutions for the effective functioning of their business. Micro, small and medium-sized enterprises (MSMEs) are a key element of any market economy. These entities are perceived as a group facing numerous barriers, both at the time of their creation and further operation. One of the key limitations, often conditioning the establishment or continuation of operations, is the difficult access to financing sources. Therefore, this publication focused on selected methods of raising capital that are currently convenient for the MSME sector. The following instruments were analyzed and assessed: crowdfunding aimed at enterprises, loans and credits, considered from the perspective of microfinance, as well as a mortgage loan as a way to finance investment projects. All these forms share a common idea - financial support for the MSME sector in accessing capital. The main aim of the study was to broaden the knowledge of the indicated financial instruments, to present their functioning in Poland in a compact manner and to verify their current structure and availability for enterprises. It should also be emphasized that all the discussed instruments can be used successfully in the booming economy, but they are of particular importance in a downturn. The period covered by the analysis is the perspective of the last dozen or so years, and the geographical scope covers Poland, with reference to examples occurring in other countries.

Visual metaphors in children's discourse

Smaki życia razem. Metafory wizualne w dyskursie dziecięcym

Author(s): Aleksander Gemel,Monika Wiśniewska-Kin / Language(s): Polish

Keywords: theory of metaphor; cognitive linguistics; education; conceptualization

The aim of the work is to create theoretical space for activities in the field of critical revision of the currently dominant education system. The first part is theoretical and is devoted to discussing the main assumptions and paths of the development of cognitive linguistics from which the cognitive theory of metaphor grows. The first chapter introduces the problem of metaphors. The second chapter introduces the assumptions of cognitive linguistics and the process of its development on the background of two great schools of language philosophy: Bloomfield's behaviorism and Chomsky's generativist theory. The third chapter discusses the main assumptions and basic problems of the cognitive theory of metaphor, which is later used as a theoretical paradigm of conducted research. The second part is empirical. Its main goal is to analyze children's metaphorical predispositions, especially the processes of understanding, recognizing, and creating metaphors of community. The reconstruction of children's idealized cognitive models undertaken in the research is aimed to recognize the culturally conditioned patterns of conceptualization of community experience, that are implicitly contained in metaphorical linguistic structures. These models determine - usually in addition to the speaker's consciousness - ways of thinking and acting. The reconstruction of these socio-cultural symbolic forms aimed to their further juxtaposition with the natural and spontaneous methods of metaphorical creativity of children. The goal of the fourth chapter of the work is to define the methodological assumptions of obtaining research material, including the definition of methods, techniques, and research tools, as well as the development of the organization and course of the research. The fifth chapter is devoted to the research itself.

Lexicon of integrated development planning

Leksykon zintegrowanego planowania rozwoju

Author(s): Tadeusz Markowski,Maciej J. Nowak,Małgorzata Blaszke,Małgorzata Żak-Skwierczyńska / Language(s): Polish

Keywords: development policy; integrated development planning; integrated management of development; sustainable development; spatial planning and development; governance

The issue of stimulating socio-economic development in an open market economy requires an increasingly complex and, at the same time, holistic approach to the increasingly complex planning and decision-making process. The sphere of public activities related to the development of modern democratic states is undergoing dynamic changes under the influence of complex global political, social, economic, and environmental changes. This results in hindered communication not only between scientists but also between practitioners and stakeholders of contemporary politics. This fact significantly delays the building of a consensus around the necessary institutional reforms, the development of modern planning concepts, and the creation of an appropriate regulatory system. A particularly important conceptual sphere for polish regional and spatial policy - requiring ordering and clarification of several concepts - is the sphere of integrated development planning. The lexicon is the first study available on the market aimed at partially organizing the terminology related to integrated development planning. It distinguishes over a hundred terms that raise certain interpretation doubts and proposes ways of understanding them referring to the latest research in the field of the theory of regional and local development. The formula of the lexicon assumes a synthetic presentation of individual terms, with the majority of issues being subject to further supplementation. The lexicon is aimed to help not only in the basic understanding of specific terms but also with the basic principles and challenges of contemporary development policy and planning pragmatics. The lexicon was developed by a multi-author and multidisciplinary team. It contains a broad description of terms and indicates the basic supplementary literature for the described term. It is a kind of compendium of knowledge necessary for planning practice and communication drawing on the experience of many disciplines, urban planning, architecture, regional studies, city economics, sociology, political science, and law.

Intermarium – a vision, an illusion, or ... a reason of state? From the history of Polish political thought and practice

Międzymorze – wizja, iluzja, czy… racja stanu? Z dziejów polskiej myśli i praktyki politycznej

Author(s): Przemysław Waingertner / Language(s): Polish

Keywords: History of Poland in the 20th century ; History of Central and Eastern Europe in the 20th century ; Polish political thought in the 20th century ; Polish foreign policy in the 20th century

Attempts to build political and military security and favorable conditions for the economic development of Poland by constructing a broader political order in Central and Eastern Europe date back to the late Middle Ages. The Piasts built the security of their domain through victorious wars, expansion of borders and treaties with neighbours. The decline of this dynasty's reign was marked by an attempt to build a Polish-Hungarian personal union. In 1385, the idea of a Polish-Lithuanian personal union was realized. In 1569 it was replaced by the real union and the construction of the Polish-Lithuanian Commonwealth. After the partitions, interwar Poland tried to implement the idea of a federation of Poland with Ukraine, Belarus and Lithuania; the union of states between the Baltic Sea, the Black Sea and the Adriatic Sea; finally, the so-called Third Europe. During the years of World War II and the post-war division of the Old Continent, Polish political emigration did not abandon the integration concepts for Central and Eastern Europe. The bankruptcy of communism and the collapse of the USSR and the Eastern Bloc favored the restitution of the subjectivity of Poland and Eastern European countries and the region adopting a common, successful course for joining NATO and the EU. In 1991, the Visegrad Group was established. Since 2015, Poland has been implementing the Three Seas Initiative (ABC) project. It was based on a real community of economic, political and defense interests in the region. Intermarium is a permanent, ambitious, geopolitical vision. It was also an illusion, negatively verified by history. Above all, however, it is a concept resulting from Poland leading to the strengthening of its security, subjectivity and economic potential in the international area.

Lodz remake of Alexander Pushkin's poem "Eugene Onegin"

Łódzki remake poematu Aleksandra Puszkina "Eugeniusz Oniegin"

Author(s): Anna Warda / Language(s): Polish

Keywords: A. Pushkin; “Eugene Onegin”; "Lodzinskij Listok"; “My uncle”; N.G. Kuzmich

The topic of research in the monograph is the work of N.G. Kuzmicha “My uncle”, which was published in the newspaper "Lodzinskij Listok" in 1896. It is a remake of Alexander Pushkin's poem Eugene Onegin. The work was discussed in terms of its genre form - remake and confrontation with Pushkin's prototype. The author develops the works in Lodz, and the characters are known from Pushkin's poem, but differ from these prototypes in character, appearance and others. The work of Kuzmich is one of the regional adaptations of “Eugene Onegin”, which in this case is considered in conjunction with the multicultural, industrial Lodz of the late 19th century. The monograph presents the most widely read and helpful Russian-language newspaper published in Łódź - "Lodzinskij Listok" (1894-1914), in which Kuzmich study was published. The remake as a form of reference to the classics as well as remakes and continuations of Alexander Pushkin's works “Eugene Onegin” were also discussed. The literary frame of the work “My uncle” and the adequate introductory fragments present in Pushkin's original were also analysed. The image of Lodz presented in Kuzmich’s work and in the columns of the newspaper "Lodzinskij Listok" was also considered. In the analytical and descriptive part of the monograph, attention was focused on the three main characters of Kuzmich work: uncle, Tatiana and Eugene, and their prototypes created by Pushkin. A separate chapter is devoted to the narrator who plays a role in the work, taking into account the traditional, omniscient narrator, but also, like the characters, in their world and does not always reveal other information about them. The work is finalized with an appendix to my original text by uncle N. G. Kuzmich and its translation into Polish.

Darren Aronofsky's Transnational Cinema. Film, the sacred and myth

Transcendentne kino Darrena Aronofsky’ego. Film, sacrum i mit

Author(s): Marcin Kępiński / Language(s): Polish

Keywords: cinema; transcendence; myth; symbol; sacrum

The book about the transcendent cinema of Darren Aronofsky takes the reader on a journey through the selected filmography of this outstanding American director. A monograph devoted entirely to his extraordinary work, which among film experts and film audiences has both a group of devoted admirers and critics. A strong, even anarchist accent falls here on the type of film hero presented, living on the margins of society and consciously rejecting its normative structures. The films, as well as the literature to which the book refers, are an expression of a critical attitude towards symbolic violence and the imposition of creatively limiting cultural norms on the individual, requiring such ordering such and no other understanding and experiencing the surrounding world. An astute observer of Darren Aronofsky's work will notice the existence of metaphysical problems in it, sometimes directly directed towards religious issues. We can call this kind of cinema transcendent. This cinema is only seemingly pessimistic in its meaning. It is worth looking for mythical stories to try to hear and understand what they have to offer us. It is worth turning to transcendence and trying to express the inexpressible, also in the art of film, as does Darren Aronofsky, who wants to be a trustee of great mythical narratives. These features, so characteristic of the director, can be seen, to a greater or lesser extent, in all his films, especially those referred to in this monograph. It will be interesting for the reader who expects from contemporary cinema something more than unsophisticated entertainment and wants to go beyond its ludic dimension.

To Tell the History. Polish Contemporary Dramaturgy after 2006

Opowiedzieć historię. Polska dramaturgia współczesna po 2006 roku

Author(s): / Language(s): Polish

Keywords: Polish theatre; Polish drama; history; memory; memory studies; narrative strategies

Publication ”To Tell a Story. Polish Contemporary Dramaturgy after 2006” is an attempt to analyse the historical narratives in the newest Polish theatre and drama. Starting from the classical canon of memory studies, shaped by researchers such as Pierre Nora, Marianne Hirsch, Jan and Aleida Assmann or Maurice Halbwachs, young theatre researchers look at methods, reasons, aims and effects of including historical and memory narratives into performances and dramas. Due to the variety of research approaches and topics undertaken by both the authors of articles and theatre artists, the issue of telling the history in Polish theatre and drama was treated in a cross-sectional area. The book deals with the themes of peasant stories, stories related to the place (memory spaces), memory transfers between generations, or feminist revision of history, among others. Using examples of selected dramatic texts and plays (not only representing dramatic theatre, but also musical, puppet or physical theatre), the dramaturgical conventions and narrative strategies employed by theatre makers that influence the construction of stories about the past are analysed.
