Judical capacity and the right to file a complaint in proceedings before administrative courts

Zdolność sądowa i legitymacja skargowa w postępowaniu sądowoadministracyjnym

Author(s): Anna Górska / Language(s): Polish

Keywords: Judical capacity; the right to file a complaint; procedural status of local government units and their bodies; abuse of the right to file a complaint

This monograph is devoted to two interrelated constructions describing the subjective structure of administrative court proceedings, the application of which in practice encounters problems related to the shortcomings of the current legal status and divergent interpretation of legal provisions determining the shape of these constructions. Taking into account the position and function of legal provisions regulating the discussed issues, determining the model of access to the administrative court, the discrepancies revealed in the scientific discussion and jurisprudence require analysis within one research work, the purpose of which is to present contentious issues and propose solutions to the most controversial of them. The selection of legal systems as part of the description of the international standard of access to the administrative court was aimed at showing the diverse formulas for protecting categories of interest under the model of standing to bring a complaint, ranging from relatively narrower ones to the broadest, appropriate for the Portuguese legal system. The monograph contains analysis of the constitutional standard of access to the administrative court in the basic and extended dimensions, which made it possible to assess whether the well-established model of access to this court based on the narrowly understood interest in lodging a complaint requires redefinition. The scope of procedural claims of local government units and the instruments of seeking judicial protection at the disposal of local government units and their bodies were analyze while examining the consequences of the constitutional principle of judicial protection of the independence of local government units. The monograph presents situations of abusing the right to file a complaint to the administrative court and proposes actions sanctioning this phenomenon.

Industrial relations in Central and Eastern Europe

Stosunki przemysłowe w Europie Środkowo-Wschodniej

Author(s): Katarzyna Skorupińska-Cieślak / Language(s): Polish

The purpose of this book is to identify changes in industrial relations in the countries of Central and Eastern Europe, with particular emphasis on the area of representative employee participation. The structure of the work was subordinated to the implementation of the above objective. Chapter 1 discusses the most important stages of the process of creating a European dimension of industrial relations and presents the main models of industrial relations existing in Europe. An analysis of selected components of labor relations in the countries of Central and Eastern Europe (CEE) before and several years after accession to the EU was also carried out. Chapter 2 is devoted to the two main forms of representative employee participation in the CEE countries. The first part of this chapter presents the difficult process of "formation" of works councils in Central and Eastern Europe and the principles of operation of these institutions of employee participation. The next part of the chapter, based on the results of research conducted as part of the NCN project, presents the main sources of weakness of works councils in Polish enterprises. The last part of this chapter focuses on discussing employee representation in corporate governance bodies, both at the national and European level. Chapter 3 of the book analyzes the impact of the following three phenomena on industrial relations: globalization, the 2008 economic crisis and the coronavirus pandemic.

Experiencing interculturalism. Based on narratives of young adults of Jewish origin

Doświadczanie międzykulturowości. Na podstawie narracji młodych osób dorosłych pochodzenia żydowskiego

Author(s): Agnieszka Krawczyk / Language(s): Polish

Keywords: culture; interculturalism; narrative; experience; linguistic-narrative method of text analysis; qualitative research

The book presents research conducted in a qualitative orientation. The subject of the research was the experience of interculturalism as reconstructed through the narratives of young adults of Jewish origin. The point of departure for the considerations was culture, seen as the totality of human living conditions created by a community. Being in two (or more) cultures, in turn, involves experiencing the differences with which a person has to cope. The main aim of the study was to reconstruct the cross-cultural experiences of young adults of Jewish origin. Twelve young adults of Jewish origin participated in the study. Data were collected through free-form interviews with narrative elements. A linguistic and narrative method consisting of the rules of Polish grammar, communicative grammar and narratology was developed for their analysis. The individual chapters are built up by three layers: theoretical, theoretical-methodological and analytical. The issues discussed in the first chapter are the source of the assumptions constituting the object of research and the possibilities of knowing it. The second chapter presents the methodological assumptions of the research. The third chapter presents the four key cases, i.e. the fate of those narrators whose experiences were most characteristic of the issues discussed. The fourth chapter presents a reconstruction of the cross-cultural experiences of young adults of Jewish origin. The analyses presented in chapter four led to the distinction of four types of coping with the experience of differences in the context of interculturalism. The analysis presented in the conclusion represents the highest level of generalisation and also relates directly to the adopted research objective.

The fight against poverty in Bałuty and other writings about charity

Włodzimierz Kirchner, Walka z nędzą na Bałutach i inne pisma o dobroczynności

Author(s): / Language(s): Polish

Keywords: philanthropy; charitable organizations 20-th century

The edition consists of scattered works published in daily newspapers and magazines (e.g. "Rozwój", "Kurier Warszawski", "Bluszcz", "Słowo", "Tygodnik Ilustrowany") and brochures written by Father Włodzimierz Kirchner, an activist charity organizations in Lodz and Warsaw at the turn of the 19th and 20th centuries. Their subject matter deals with the issue of almsgiving, which Kirchner finds demoralizing. As a theoretician of philanthropy, he proposes a prudent consideration of individual cases in its place, especially replacing it with specific proposals for gainfulemployment, which is supposed to improve not only the economic but also the moral situation. Kirchner's philanthropic thought revolves around other, but close to mainstream, issues: vagrancy, juvenile crime (knife-throwing), prostitution, domestic violence, the tasks of vocational schools for women, etc. Thanks to the author's erudition, experience and concepts, his philanthropic sketches may constitute a kind of paradigm of the theory of charity in organizations of this type 19th/20th centuries. The edition also includes two introductions: a scientific one by D. Samborska-Kukuć and a memoir by Kirchner's daughter, prof. Hanna Kirchner.

The State and Groups of Influence in the Economy. The institutional-political perspective

Państwo wobec grup dominujących w gospodarce – perspektywa instytucjonalnej ekonomii politycznej

Author(s): Anna Ząbkowicz / Language(s): English

Keywords: economic theories; capitalism; polity; corporations; financialization; democratic welfare state

The book dwells on views and cognitive apparatus worked out in this strand of social thought where collective action and particular groups interests carry weight. It claims that such theorizing leads to the substance of economic activities in our surroundings more certainly than methodological individualism does. In most compact way, the contents of this book can be characterized by referring to a couple of research perspectives, and the scope of its theoretical background can be marked by several great researchers‘ names. Firstly, deeper understanding of economic performance, as Douglas C. North and his followers argue, requires consideration of economic activities as well as polity, where property rights and incentives structure are determined. Secondly, public and economic policies can not be regarded to be exclusively government’s domain, being to some extent the outcome of activities of organized interests and group interest representations. As Wolfgang Streeck put it, “capitalism is under renegotiation”. The contemporary democratic polity sees representations of labour interests, non-governmental organizations, etc. However, as John K. Galbraith points out in some of his works, the axis of renegotiation in capitalism has been constituted by relations between contemporary state and organized groups of mighty enterprises, “corporations”. These business groups (“business” in broad sense), apart of winning profits, can influence economic outcomes. The latter means economic power. Profit-oriented groupings or “corporations”, according to Susan Strange, exert impact simply because of weight and position they have in economic structure either intentionally, via their organizations and lobbyists in the polity. That’s why they penetrate society as a whole, not economic economic activities alone. In result, contract relations and respect for financial surplus overcome social relations. Argumentation thus oriented is backed by description of real processes. The corresponding parts of the book contain short studies on financialization, narrow interest representations and contemporary transformation of democratic welfare state which is a debt state in fact. Old theories inspire understanding of new configurations.

Capital Controls in the Contemporary Economy. Institutional View of the International Monetary Fund

Kontrola przepływu kapitału we współczesnej gospodarce światowej. Podejście instytucjonalne Międzynarodowego Funduszu Walutowego

Author(s): Iwona Maciejczyk-Bujnowicz / Language(s): Polish

Keywords: capital control; capital flows; capital flow management measures; International Monetary Fund

The management of international capital flows is a new phenomenon in international financial relations. The IMF's institutional approach to capital controls is a new concept in international relations. For the first time in Polish literature, they were collected in a uniform study. The aim of the monograph is to review selected approaches and research on the determinants of the application of capital controls in the global economy from the perspective of the International Monetary Fund. The financial revolution, the beginning of which dates back to the 20th century, globalization and the development of technology create, on the one hand, opportunities for the development of individual countries, and on the other hand, they carry threats unprecedented in the economic history of the world. Sudden stops, financial crises in the 1990s and in the two decades of the 21st century caused by capital flows gave rise to their institutional location. For the first time in 2012, the International Monetary Fund, following the outbreak of the global financial crisis, adopted the Institutional View, which states that it is possible for the authorities of given countries to apply measures to control the international movement of capital. The COVID-19 pandemic and the war in Ukraine led to a renewed revision of the views of the International Monetary Fund on the management of international capital flows. The revision of the Institutional View made in 2022 at the IMF states that the problem of capital control is current, important and urgent to be solved in the context of maintaining the financial stability of the global economy.

Information and communication technologies in provincial pedagogical libraries in Poland

Technologie informacyjno-komunikacyjne w wojewódzkich bibliotekach pedagogicznych w Polsce

Author(s): Monika Wachowicz / Language(s): Polish

Keywords: provincial/regional pedagogical library; information and communication technologies; librarians – teachers; library law

The subject of the research are information and communication technologies used by teachers librarians to carry out the tasks of provincial pedagogical libraries. A catalog of tasks of voivodeship pedagogical libraries has been separated, in the implementation of which new technologies can be used. The source of the study was widely understood literature on the subject. The following were taken into account: Polish scientific literature, legal acts, practical publications, guides, specialist press, opinions of Internet users, as well as selected English and Russian-language literature. The author's greatest research contribution was the creation of her own understanding of information and communication technologies and the indication of the most popular ways of using new technologies by librarians in the implementation of the tasks of a pedagogical library. Developing the material from the theoretical side and supplementing it with a discussion of the results of own research seems to be interesting both for librarians, library directors, scientists dealing with this issue, as well as material for workshops for future librarians at the academic level.

Gamers in Culture

Gracze w kulturze

Author(s): Kamil Jędrasiak / Language(s): Polish

Keywords: video games; gamers; players; video game culture; gamification; ludicity

This book is a proposal to identify and take a closer look at selected aspects of the functioning of modern culture, in which the growing importance of games (especially video games) and the broadly understood ludicity, or "game-like" qualities, are clearly manifested. The key point of reference for the considerations undertaken are gamers, understood as a specific type of cultural participants. As the foundation for the argument, the examples of an academic reflection on the subject-matter are recognized and the field of this reflection is outlined, highlithting mainly the links between games and culture. This is followed by a discussion of issues related to the specifics of experiencing video games (mainly in a technological context), but also to the competencies of gamers, and to the fact of their diverification as a group, including some taxonomies. Further on, the perspective broadens, turning to the culture of games/gamers (among other things: venues designed for gamers, specialized media, events and other phenomena shaping the "gaming culture"). The argument concludes with an attempt to look at culture (as a whole) through the prism of its "gamification". Thus, the manifestations of "game-likeness" beyond the core "gaming culture" itself are discussed – the influence of games on other branches of culture (including entertainment industries or the arts), cultural protocols, everyday life, etc., and therefore on the competencies desired for modern cultural participation.

The best interest of the child – beteween the common good and the individual interest

Dobro dziecka w ujęciu indywidualistycznym i wspólnotowym

Author(s): Karolina Mendecka / Language(s): Polish

Keywords: best interest of the child; common good; general principles of law; general clauses; liberalism; communitarianism

The principle of the best interest of the child has gained widespread recognition. It is universally applied in adjudication by courts, tribunals, administrative authorities and legislative bodies in cases concerning children. This book aims to investigate what is behind the meaning of this term from the perspective of the philosophy of law and the political philosophy as well as in light of international and Polish law. Nietzsche famously argued that there are two opposing elements: Apollonian and Dionysian. Apollonian aspect represents the individual, order, rational thinking, logic, and law. The Dionysian element represents nature, unconsciousness, instinct, chaos, urges – there are no rules. According to the philosopher, everything and everyone consist of both Apollonian and Dionysian elements. This classification offers an insightful perspective on the subject of this book and is a thought-provoking starting point for the topic of child’s best interest, but also the notions of good and common good. Each matter is approached from the philosophical and legal angle.Although there is no clear and undisputed definition of the best interest standard, there are some factors that need to be considered. In all actions concerning children their particular interests have to be taken into consideration, along with moral and ethical aspects. At the same time, the child is a part of a community – the family, the society, and the state. Therefore, the communal angle of what is good for a child must always be considered as well. The main finding of the book is that there needs to be a balance between the individualistic and communal aspects while interpreting what is good for a child. Therefore, the balancing act is also necessary for interpreting what is best for a child – otherwise, the standard is set up to fail.

Author(s): / Language(s): Polish

Keywords: polszczyzna dawna; Biblia; Nowy Testament; polszczyzna współczesna

Stanisław Bareja (1929-1987) was a Polish film director born in Warsaw. After the war, the family moved to Jelenia Góra. Staszek had great intellectual passions from the beginning and after graduating from high school he decided to continue his education at the film school in Łódź. In 1960 he made his debut with the comedy “The Man of His Wife. ” The 1960s were successful with the comedies “Wife for an Australian” and “Marriage with Reason. ” His films, in which popular actors appeared, moved to cinemas and attracted increasing criticism from the press and parts of the film world. In the late 1960s, Kasimir Kutz, an old friend of Barei’s, used the term “ba reizm” for artistic mediocrity. This helped to block further projects of the director for four years. Bareja returned in 1972 with the movie “Wanted Wanted. ” A new, more mature period of his work began. His comedies will now consistently brand the absurdities and humiliations of life under real socialism. That’s why there’s always trouble with censorship and crowded public halls. In the 1970s, criticism of Bareia remained ambivalent. On the one hand, he was still under condemnation, but on the other hand, there were positive voices on “What are you gonna do with me when you catch me” and “Bär” that put his films in a circle of moral discomfort. Since the late 1970s, Bareja had been a member of the Democratic Opposition, and his house had an illegal print shop. In the 1980s he produced two series “Alternative 4” and “Changer. ” The fight against censorship affected the health of the director, who died in the Federal Republic of Germany in 1987. Bareja’s wife didn’t have time to reach the dying man. The power of that time prevented them from doing so. Bareja left two children: the daughter Kasia and the son Janek. Today, the director’s work belongs to the permanent work of Polish film art.

The Shields of the Empire: Eastern Roman Military Elites during the Reigns of the Emperors Theodosius II, Marcian and Leo I

Author(s): Łukasz Pigoński / Language(s): English

Keywords: Aspar; Theodosius II; Marcian; Leo I; Eastern Roman Empire; military elites

When the emperor Valentinian III murdered the general Flavius Aetius, it has been observed that he had ‘cut his right hand with his left’, and the story of the fall of the ‘last Roman’ has been put in the greater context of the subsequent dissolution of the Roman Empire in the West. However, a similar deed committed by the emperor Leo in the East in 471, when he ordered the killing of the general Aspar, certainly did not gain such a legendary status. The underappreciated story of the survival of the Eastern Roman Empire in the turmoil of the fifth century is however no less dramatic, and the role that powerful military leaders played in those events was certainly paramount. This publication aims to reconstruct the involvement of the Eastern Roman military elite in various matters of the state on the wider background of political history marked by the reigns of the emperors Theodosius II (408-450), Marcian (450-457), and Leo I (457-474). On its pages, the author presents the history of the numerous wars in which the Empire found itself entangled in during that uneasy time, as well as the periods of conflict and cooperation between the generals and the emperors. The focus is not only on the military elite as a group, but also on outstanding individuals, such as generals Plintha, Flavius Zeno, Aspar or Zeno-Tarasikodissa, the aforementioned emperors and their civilian advisors. The result is a comprehensive study and a novel interpretation of the nearly seven decades of turmoil that, contrary to what happened in the West, curiously did not result in the collapse of the Eastern Roman state; perhaps, as the author argues, in no small part due to those military leaders, who were serving and protecting it.

In the Face of Death. A Study of the Intimacy of a Limit Situation

W-obec śmierci. Studium intymności sytuacji granicznej

Author(s): Anna Walczak / Language(s): Polish

Keywords: death; limit situation; corporeality; experiencing; relation

In the Face of Death. A Study of the Intimacy of a Limit Situation is an academic monograph representing the revived trend of existential discourse (with an emphasis on issues related to the death drive) in the humanities, as broadly understood, as well as social sciences. The monograph presents the author's outlook on two key individuals who found themselves in an existential limit situation when faced with death. These individuals in the book are the First One Facing Death (mainly someone terminally ill) and the Second One Facing the Passing of the First One – as his companion of choice. The connotation of the limit situation has been extended if compared to the concept described by Karl Jaspers, allowing its intimate aspect in its peculiar, ever-fragile discreetness to be highlighted, implying the need for the attentive physical presence of the Second One there. With reference to contemporary thought on the body and corporeality, these categories have also been given different meanings from those commonly used in order to bring out the First One Facing Death’s multidimensional essence of being and to unveil the architectonics of the Second One's attentive physical presence beside him, with him and, perhaps, for him. The monograph employs a phenomenological reduction to the actual experience of the limit situation by the First and the Second One. Its aim is to reveal its essential meanings from beneath layers of obviousness.

PolEnglish Revisited. Leksyka angielska w polszczyźnie XXI wieku

Author(s): Łukasz Jan Berezowski,Mikołaj Deckert / Language(s): Polish

Keywords: Anglicisms; contact linguistics; English borrowings; English loanwords; language contact

This volume deals with the influence of English lexical elements upon Polish, especially upon the units used in Internet discourse and in new media. Of particular interest here are the latest English borrowings – dating back to the turn of the 20th and the 21st century – both lexical and semantic. The aim of the present book is, therefore, to explore the scale of this impact upon Polish on the basis of a corpus compiled and organised in the form of a lexicon comprising 1,600 entries with definitions and examples from Internet websites, social media, forums and modern literature. An important contribution of the publication is to offer an experimental user-focused perspective on Anglicisms, sourcing input from a young generation of Polish speakers.
