Building Legal Language Awareness through Legal Collocations

Building Legal Language Awareness through Legal Collocations

Author(s): Marina-Cristiana Rotaru / Language(s): English Issue: 2/2022

Language awareness, an important concept in ELT, can also be used in the teaching and learning of specialized language, such as legal language. Like any other specialized language, Legal English has its own characteristics. Making students aware of various aspects and peculiarities of Legal English helps them understand and learn it better. One way of boosting legal awareness as far as Legal English is concerned is through legal collocations. Collocations, in general, are a good way of increasing language accuracy. Being able to build correct collocations is an indicator of a good command of the language. The peculiarities of Legal English are often thought-provoking to those who want to study it. Legal collocations represent a category of the above-mentioned peculiarities. But once students become acquainted with them, legal collocations turn into useful tools for understanding the specificity of legal language, such as the nature of various relationships established between the parties in a case or in a contract, or among people in a courtroom, be they members of the legal profession or members of the general public.

Challenges in Translating Gender Pronouns in Legal Texts - A Pedagogical Approach for Using Gender-Neutral Language in Translations

Challenges in Translating Gender Pronouns in Legal Texts - A Pedagogical Approach for Using Gender-Neutral Language in Translations

Author(s): Mariana Coancă / Language(s): English Issue: 2/2022

The paper discusses the role of using gender-neutral language in communication and focuses on developing strategies that can be applied in translation activities, to enhance students’awareness of gender-inclusive language and to highlight its importance in translated texts. Relying on students’ knowledge of employment law, discrimination, inclusions, etc., and on their proficient level of English, the strategies can be implemented successfully. Thus they can ensure the consistency of the translated text and can render it more accurately and inclusively. However, the texts translated into Romanian contained several mistakes related to the use of gendered pronouns, because the translation in Romanian requires that both women and men be visible in the text. Using gender-neutral language in translations can influence Law School students “to speak and write in a way that does not discriminate against a particular sex, social gender or gender identity, and does not perpetuate gender stereotypes.” (The United Nations)

Author(s): Loredana Miclea / Language(s): Spanish Issue: 2/2022

The translation of texts from the public service sector has the objective of developing students’ capacity to analyze a text from a pragmatic perspective, considering a syntactic, lexical and sematic analysis. Thus, the text is analyzed from a macro-structural perspective, from the linguistic expression, and the analysis is also focused on identifying the sociocultural context of the texts, meaning the speech analysis. The fields specialized in translating texts from the public service sector, European economic, judicial, medical, scientific, technical and media institutions are being investigated from this perspective when translating the texts. So, the economic sector deals with topics such as: types of companies and the negotiation field, the market and the inflation, from small to medium companies and then big corporations in the world of negotiations; the judicial field has topics such as: the origin and formation of judicial vocabulary, judicial concepts (jurisprudence, legislation), European rights (European courts, European directives). The translation process of texts from the public service sector is presented as a complex profession which involves a scientific strictness and an artistic perception and so demanding a pragmatic approach to reality, supported by a philosophical base.

Author(s): Veronica Dobrișor / Language(s): Romanian,Spanish Issue: 2/2022

In the present paper we are focusing on developing an analysis of the conceptual metaphors based on the notion of “fire”, present in the phraseological units. Among others, phraseological units are characterized by expressiveness, many of them being based on metaphorical conceptualizations of reality. The novelty consists of the comparative approach that we are aiming at: more precisely, the study focuses on analyzing the metaphors in two different languages, but which are in tight connection, on the one hand Romanian language, on the other Spanish language. Along the present study we will observe the way in which the element of nature is conceptualized in the two languages, with focus on existing similarities and differences of the notion, but also on the level of equivalence that it presents. In the first part of the article, we will present the theoretical frame that we are using as the basis of our theory, while in the second part, we will analyze metaphors that will be taken into consideration.

Author(s): Adrian Damșescu / Language(s): Romanian Issue: 1/2022

The presentation/ article tries to present, as it can be observed from the title, different common incidents, both at lexical and phonetic level, between the dialect spoken in the Romanian Banat region, on one hand, and Galician, as well as Brazilian Portuguese language on the other hand. As far as the phonetic coincidences are concerned, they exist especially between the Banat region dialect and Brazilian Portuguese language, because consonants “t” and “d”, followed by the vowels “e” and “i” are pronounced in a very similar way. We can even talk about a common evolution of the primitive vowel “e” towards an “i” (which indeed exists in other languages and dialects too, especially in English). Syntactic coincidences on the other hand are more frequent between Galician and Banat dialect, certain terms being common only in the two regions, being used to designate objects exclusively typical for the two areas (such as “brenta”, a large basket, woven around four sticks, which is then strapped to the shoulder, and whose origins are probably pre-Roman, probably Celtic or Celtiber)

Author(s): Răzvan Bran / Language(s): Spanish Issue: 2/2021

The main purpose of this lexical and semantic study is to investigate the names the new Coronavirus (COVID-19) received in the Spanish and Romanian media. First, we want to gather together all the names and the bilingual media corpus to analyse its formation and meaning. We are interested in the linguistic mechanisms which led to the formation of Coronavirus’s denominations and the sematic differences between them. The analysis revealed that, on one side, the lexical mechanisms are abbreviation and composition, and, on the other side, there is a tendency to use different names (hypernyms and hyponyms) to indicate the same meaning. Also, besides the semantic uncertainty, we saw a high use of different orthographic options. Over time, from the first signs of the pandemic until now, more or less precise meanings were created, which have gradually qualified their us, while also being discovered new scientific information.

Perceptual and conceptual reference point constructions in cinematographic shots

Perceptual and conceptual reference point constructions in cinematographic shots

Author(s): Mircea Valeriu Deaca / Language(s): English Issue: 1/2021

In Cognitive Grammar, the concept of reference point (R) designates the conception of one entity invoked in order to establish “mental contact” with another. The reference point access is a manner of mental scanning of a series of discrete elements in order to find a final element embedded in this chain. In film, we can dissociate between perceptual reference point (pRP) and conceptual reference point (cRP). The pRP can be perceptually present in long takes that, after the editing cut, focus on a metonymic element of a scene in order to track to another section of the scene. The paper analyses several pRP and cRP constructions in film sequences and conceptual phenomena involving metonymy. Diegetic metonymy is compared to symbolic metonymy, which ultimately leads to metaphoric construals. We can also establish metonymic categories used as pivots between semantic domains and metonymies that profile unbounded qualities similar to mass nouns.

Author(s): Loredana Miclea / Language(s): Spanish Issue: 1/2021

My main responsibility as certified translator-interpreter is expressing different meanings (referential, pragmatic and intra-linguistic) which might stay in the translation, aiming at having as little semantic loses as possible. The mandatory condition during all this complex process of creation is the fair delimitation of different types of meanings, specifically which of those are to be treated as a priority and which do not, given the context. That is why, the highest translation level is the referential one (as the objective reality is more or less the same). The pragmatic meaning is being subjected to transposition as, even if there are same realities described the attitude of different communities towards them is different. And, eventually, the intra-linguistic meaning, which has the minimum degree of transposition. In this way, for legal economic, technique and scientific texts the information is codified mainly referentially, while in the artistic texts the pragmatic level is more important. That being said, I, as certified Translator-Interpreter, will focus on a global investigation of relations and procedures system between globalization, internationalization, localization to clearly see the referential meaning of the object text.

Romanian Derivatives and Compounds in Trend

Romanian Derivatives and Compounds in Trend

Author(s): Elena Museanu / Language(s): English Issue: 2/2020

Generally speaking, identity is revealed not only in the actions and attitudes of characters, The affixed derivation is characterized by keeping the suffixation first, in terms of quantitative and qualitative importance, and by a marked increase in derivatives with prefixes. In both situations, the most productive affixes are the neological ones with multiple etymologies. The neological derivation in our language can be achieved in three variants: the neological lexical base + the neological suffix, the lexical base from the old fund (inherited or borrowed) + the neological suffix, the neological lexical base + old suffix (inherited or borrowed). The increase in the number of derivatives depends on the circulation power of the base morpheme. The derivative creativity of the neologisms brings productivity in the sphere of inherited suffixes, selected due to the stable and popular character, as well as for the contrast with modern elements. A current trend in the development of the Romanian language is the ease of obtaining compound lexical elements. The predilection for such internal formations, existing in the current Romanian press, is not a general feature of the writing of this period, but is observable especially in the areas addressed to the young public, generally cultivated, open to novelty, concessional and captivated by the new combinations. The phenomenon of thematic composition highlights the creativity and ability of the current language to assimilate both erudite and internationally successful affixoids.

Author(s): Gian Maria Forni / Language(s): Italian Issue: 1/2020

According to the most recent “National Guidelines for Customized Curriculum in Middle School, Grade I,” the former middle schools tend to take a back seat to curriculum, planning it as mere mnemonic and dogmatic knowledge of data, facts and names, in favor of other, much higher goals: "moving from a primary education to a first grade secondary school means dealing with the problem of a model. [...] Yet to know in a “secondary” manner is to use the constructs of the explanatory mind which are based on an appropriate use of analogy. [...] [In] the mathematical-scientific field [...] special importance is given to the methods, through which the scientific description of the world is elaborated, focusing especially on the process of mathematization of physical objects and on the constitution in consequence of a model that literally replaces real objects"1. These objectives are broad and absolutely necessary to make students become more than simple containers of uncritical notions, but also and above all Italian and world citizens, with broad thinking and their own critical thinking. But these are objectives, which each teachers tend to achieve in their own way, making use of their interdisciplinary and multidisciplinary knowledge. The method and the knowledge are often difficult to put into practice with the textbooks provided by the publishers, despite the good intentions of the authors and of the same publishers. It is not unusual for teachers, especially those of humanities, when choosing textbooks, to be confused when they see the available offer. For example, regarding the Italian language, there are books that provide a good anthology of texts, but these textbooks are weak in terms of exercises or explanations. In terms of history, some textbooks tend to skim topics that a teacher might want to explore; or, they offer other outdated exercise books that require notional completion. These are just a few examples. Personally, as a teacher, I tend to integrate the topics covered in different textbooks (Italian, History and Geography) with numerous handouts, as a result of the often present flaws, which I mentioned above. So do many of my colleagues. To overcome these limitations and to deal with different teaching methodologies among different teachers, tools could be created to create modular textbooks, “assembled” by teachers at the beginning of the three-year period, at the beginning of the school year, or during the school year, as the case may be. What I will explain is an idea not only to make teaching work more organic but also to create a more pleasant environment for students.

The study aims at elaborating a conceptual vision of correlation of the factors related to an understanding of the text, from the perspective of the literal and contextual comprehension, in tandem with aspects of interferential and integrative understanding. The didactical techniques proposed are presented only as elements of an incipient level of approach for the comprehension of the text, while the fundamental element is represented by the full exploitation of the connotations of the lexeme of the further didactical approach, which is indispensable in any verbal communication. The conceptualization of the connections between the learning paradigms and the methodological framework for the application of the models has as a main objective the development of the frames for the interpretation of the data and elaboration of the methodological structures certified from the perspective of efficiency in application on a personal learning style of the user, while placing the adequate topical techniques as part of the learning strategy.

Réflexion sur la lexicographie et la terminologie

Réflexion sur la lexicographie et la terminologie

Author(s): Ana Maria Drăgoi / Language(s): French Issue: 1/2019

Lexicography and terminology are two disciplines that use the same techniques: using the corpus to obtain information on words and terms, applying corpus data analysis techniques, extracting terms, searching for contexts, studying linguistic units. The two disciplines are distinguished by the central object they deal with: the word and the term. Both disciplines are turning to new descriptive models, such as lexicology and lexical semantics. These changes can be distinguished in terms of term analysis methods and lexical units. Through the corpus, both disciplines can observe the behavior of units: lexicography looks for important and representative organisms for a language, while terminology looks for representative organisms in specialized fields and describes terms. In general, the corpora of both disciplines consist of written texts, not oral transcriptions. Lexicography and terminology require an electronic medium to analyze words and terms. In both disciplines, the corpus plays an important role, with the emphasis on frequency, observation of authentic usage and correction of dictionary errors.

Acțiunile interpretativ-comunicative ale competenței lingvistice

Author(s): Ludmila Nedu / Language(s): Romanian Issue: 1/2019

In order to offer an overall image of the notion of linguistic competence, as a specific concept of learning Romanian language by the Gagauz students, it is necessary to present a set of criteria with regard to this concept. Linguistic competence is represented by the phonetic, lexical and grammatical knowledge and acquisition of Romanian language. The pre-learning strategies of Romanian for Gagauz students focuses on the specific interpretative-communicative actions. Social diversity of the contexts in which the communication of the Gagauz student can be valorized, can help him/ her understand the capacity to correctly interpret the “textualization” of the information.

Terminological Entry in Animal Science Language

Terminological Entry in Animal Science Language

Author(s): Izabela Oprea / Language(s): English Issue: 1/2019

Recently, the number of works centred upon terminological entries has multiplied, a great number of linguists showing interest in this field. Nevertheless, concerning animal science language, terminological entries aren’t studied enough. Thus, we aim at presenting in our work a trial of delimitating certain phrases and terms which are very important for animal science specialists and students, making comparisons between words and terms. Consequently, we will present significant information on general lexicon in order to conclude with animal science lexicon. Our work will comprise the following stages: 1. definition of terminological entries and conveying a short history; 2. extraction of phraseological units candidates to the terminological unit status; 3. application of Cabré (1998)’s principles.

Revisiting the Principles of the Adult Learning Theory

Revisiting the Principles of the Adult Learning Theory

Author(s): Roxana Bîrsanu ,Ilda Kanani / Language(s): English Issue: 1/2019

In the last decade, adult learning has been a constant topic of education research, particularly in the context of the impetus of instruction targeted at adults brought about by rapid technical advancements, increasing intercultural interactions and a constant changing work environment, all of which compel professionals to embrace lifelong learning as a constant coordinate of their active life. In this light, this paper revisits the andragogical model proposed by American researcher Malcolm Knowles from the perspective of its applications in adult learning classrooms. Moreover, it touches upon a number of obstacles encountered in the instruction process addressing adults, analysing their impact upon adults’ decision to enrol in and commit to instruction programs.

Author(s): Ana Mihaela Istrate / Language(s): Romanian Issue: 1/2019

The concept of cultural intelligence (CQ) represents the ability of the individuals to relate and act efficiently in cultural contexts different from the ones in which students usually act. Although traditionally the concept of cultural intelligence 9CQ) measures the intellectual performance, in contexts related especially to the economic field, allowing the successful accomplishment of contacts between culturally different business people, it can represent a starting point and support for the correlation of indicators such as empathy, ttrust, emotional intelligence, in the case of international students who choose to study Romanian as a foreign language, as a starting point of their future career. The present study starts from the definition of culture shock for international students that choose to study in a totally different cultural environment from the national one, explaining different stages that they experience, offering information about the techniques for the successful management of this experience and an analysis if the way in which culture shock can be correlated with cultural intelligence (CQ). The research is based on the specific case studies of international students enrolled in the foundation year of Romanian as a foreign language at the Romanian-American University in Bucharest, talking about the initial culture shock, management and then mastering of adaptation in the Romanian environment, highlighting the progress that can be observed in the case of these international students along the two semesters of immersion into the Romanian culture.

Towards Flexible Foreign Language Learning through Digitalisation and Cooperation across University Borders in Finland

Author(s): Antti Petteri Kurhinen,Anu Mustonen,Marja Oksanen,Tapani Mottonen / Language(s): English Issue: 1/2019

Finland has faced increasing immigration during the past years. Simultaneously, the aging of population has made Finland increasingly dependent on linguistically competent foreign workforce. To overcome this challenge, the Ministry of Education has started several national projects to promote the digitalization in education, including DIGIJOUJOU (2017–2019), whose main aim is to develop digital materials for teaching Finnish and Swedish. We will outline the work done in one sub-project of DIGIJOUJOU. In this sub-project, eight university level teachers have developed flexible working life oriented digital study modules for free use. We discuss the project in terms of both practical material production and the development of teachers’ digi-pedagogical competence.

Author(s): Emilia Ababei Cioloca / Language(s): Romanian Issue: 1/2023
