People live in “collective relationships of harm and vulnerability”. This social-theoretical concept focuses on the fact that people interact as vulnerable subjects and subjects capable of violence whose vulnerability, solidified in dispositions, may be considered the result of violence sustained and inflicted in historical constellations. Following an outline of psycho-analytical research results, the author presents the concept of transgenerational transmission of serious (traumatic) injuries and emphasizes the importance of enactments as a special form of unconscious actional retrospection in social situations. It is argued and illustrated that these and other traces of collective violence – even those dating back to the early centuries – are eminently manifest in modern immigration societies (e. g. in interactions with political refugees). From a normative perspective, the author advocates a heightened sensibility towards harm that presupposes a differentiated concept of violence that also includes symbolical and psychological forms. After giving a short explanation of two modes of symbolical and psychological injury that are important in migration societies – “dyspresentation” and certain forms of omission, namely silence –, the author finally discusses the ‘danger’ of promoting a dubious “tribunalization” of psycho-social realities through an increasing (scientific) sensitization for relationships of harm and vulnerability.

If the International Criminal Court (ICC) can not prosecute leaders who committed war crimes, it will be the end of justice and system for the international community. This study, examines both the efforts of international community to prosecute Assad, who committed war crimes in Syria, in the ICC, and the Russian factor in UN Security Council (UNSC), which has the authority for the statute of the international court of justice. The responsibility of Assad has been watched for a long time due to his crimes against humanity and war crimes in Syria. It is also vital that the General Secretary of UN declared that Assad committed crimes against humanity and war crimes and he must be prosecuted. In this regard, it is crucial how to prosecute Assad, because Syria has not ratified the Rome Statute of the ICC, so, just the attempt of the ICC Prosecutor for the jurisdiction over Assad in the ICC is inadequate.

The murders are divided into deliberate murder, murder because of types of error or carelessness in the Western division of the practical law. There are 4 types of murder are observed in a law of Western countries: premeditated murder, murder on the basis of heart insistence to implement, murder in an ambush and murder of error. The murderer‟s will and intention determined all these murders being deliberate or non-deliberate (carelessness, etc.).The factors of being deliberate or his preparing for crime does not affect the principle of being premeditated or non-premeditated. Non- deliberate or murder because of the types of error is in the range of crimes in foreign law which degrees of fault are took into consideration. Different classifications are made on murder crime in Iran jurisprudence (Fiqh) and law source. The murderer‟s aim and tools which are used in crime are presented in this classification. A well- known and documentary criteria is murderer‟s aim and legal side of this task is also more reliable.

The distinction between types of violence is intended to facilitate understanding of the problem. Physical, sexual and emotional abuse are most often present in the public language. Other, more specific types are domestic violence and workplace violence. In reality, no form is autonomous - for example, sexual abuse is almost always accompanied by physical coercion, and domestic violence also implies emotional harassment.

Criminal offenses against sexual freedom are crimes that are constantly increasing, because with the development of technology, the very essence of the criminal act has changed significantly, and these works do not necessarily imply direct physical contact. The appearance of this criminal offense establishes a specific victim-based relationship between the victim, the perpetrator, and the authorities responsible for dismissing the offense. In the stages of the resolution of this criminal offense, there is a justified risk of secondary victimization of the victim caused by discrimination by the social environment, but also by the nature of the proceedings itself. The paper analyzes criminal offenses against gender freedoms, points to the risk of discrimination against victims and provides recommendations for the treatment and response of internal affairs bodies in cases of these crimes.

The aim of the essay is not merely to identify reasons, backgrounds,and interests in the revisionist discourse. Rather, it suggests possible solutions to this polarized situation which could be relevant beyond the regional framework.
