Devolutivní účinek odvolání ve věcném záměru civilního řádu soudního
The paper deals with one of the effects of an appeal in civil proceedings, the devolutive effect, within the comparison of valid and effective legislation of Act No. 99/1963 Coll., Code of Civil Procedure (hereinafter “OSŘ”) and the subject intent of Civil Procedure Code (hereinafter “CŘS”). The subject intent of CŘS maintains a system of incomplete appeals in contentious proceedings, nevertheless at the first sight, with minor changes, it emphasizes the character of the appeal proceedings as a check on the correctness of the judgment at first instance. As a result, these changes entail a possible unintended interference with the principle of economy of proceedings and concentration of proceedings, in contrast to the current legislation in OSŘ.
