Summary/Abstract: The paper deals with one of the effects of an appeal in civil proceedings, the devolutive effect, within the comparison of valid and effective legislation of Act No. 99/1963 Coll., Code of Civil Procedure (hereinafter “OSŘ”) and the subject intent of Civil Procedure Code (hereinafter “CŘS”). The subject intent of CŘS maintains a system of incomplete appeals in contentious proceedings, nevertheless at the first sight, with minor changes, it emphasizes the character of the appeal proceedings as a check on the correctness of the judgment at first instance. As a result, these changes entail a possible unintended interference with the principle of economy of proceedings and concentration of proceedings, in contrast to the current legislation in OSŘ.
