Reframing Migrancy Through Intersectional Analysis: Conceptualizing The Embodiment of Migration Experience From The Mexican-United States Migration Field Framework

Reframing Migrancy Through Intersectional Analysis: Conceptualizing The Embodiment of Migration Experience From The Mexican-United States Migration Field Framework

Author(s): Renato de Almeida Arão Galhardi / Language(s): English Publication Year: 0

Mexico-United States migration research rarely use the concept migrancy and migration analysis has often used migrancy “out of context”. By reviewing the usages of migrancy, I argue that migrancy is better understood as the embodiment of the experience of migration. I reason that the experience of migration is best captured through intersectional analysis. By addressing gender, ethnicity and class, migrancy can recapture migrant agency and bridge the gap between micro and macro analysis. Within the Mexico-United States migratory field, I argue that migrancy is a powerful concept that addresses the structuring forces that shape migrant experiences without sacrificing migrant agency.

A Family Resemblance: Migration, Work and Loyalty

Author(s): Frédéric Décosse / Language(s): English Publication Year: 0

Ayoub and Malika Amrani are husband and wife, former farm workerswho, for many years, came to France on OMI contracts to do seasonal work for a farmer in the Bouches-du-Rhône area. In the early 1970s, the young woman’s father and uncle, fellahs2from the Moroccan Prerif who had emigrated to the city, found a contract in the city of Grans, on the Crau plain, and gradually “sponsored” the next generation of migrants. In 1990, when Malika was recruited to join them, there were about ten family members already working on the farm. Though she was formally employed as a farm worker, she actually worked as a “servant” for the farmer and his family. Against the advice of her employer, who wanted nothing to distract her from her work, she got married and held a big wedding in Fez, to which her employer was invited. Ayoub, her husband, was recruited to work in the orchards. As a newlywed, Malika had more and more trouble accepting the abuse and bullying her parents had endured until then. She became increasingly opposed to her employer. 2000 marked a breaking point, when Ayoub fell from an apple tree and was seriously injured. His pelvis was fractured. Their employer was reluctant to report it as a work-related accident. The couple stood up to him, and the following year, none of the family’s contracts were renewed. It was a form of retaliation. It was a collective punishment, as if to remind the migrants that they were bound to their employer by the same duty of loyalty. This incident would have lasting consequences on Malika’s relationship with her family, who accused her of being selfish. In the meantime, Malika became a prominent figure in the movement to defend seasonal migrants’ rights, almost in spite of herself. Her story was the subject of several articles in the media and was taken up by the Collectif de défense des travailleurs agricoles saisonniers (Collective for the Defense of Seasonal Agricultural Workers) (CODETRAS).

COMUNICAREA ÎN MEDIUL EDUCAȚIONAL

COMUNICAREA ÎN MEDIUL EDUCAȚIONAL

Author(s): Maria Georgescu / Language(s): Romanian Publication Year: 0

Communication is a psychosocial interaction through which subjects transmit information and expect feedback, fulfill their goals, direct and control their own activity, that of a person or a group. To communicate effectively and expressively with oneself and others (Gh. Dumitriu 1998), means to convince, to be able to develop the thinking, affectivity and personality of others, to inform intelligibly and to understand correctly the meaning of the message, to notice and be aware of reactions, attitudes and behavioral changes in the receptors or audience. Communication, in general, and educational communication, in particular, are related to the phenomenon of social influence and persuasion. The teacher is the one who exerts influence through democratic behaviors that allow him to build a relationship based on mutual respect, self-disclosure and valorization, a context that facilitates the harmonious growth and development of the autonomous and creative personality. Among the sources of power that the teacher exercises in the educational context, we emphasize the importance of manifesting the power of reference that involves creating relationships based on affectivity and emotional support, the power of expertise based on shared competence of the teacher, legitimate power, specific to the teaching role, sources generating greater satisfaction than the one-way use of coercive power. The main component of education, communication, has always been an indispensable support for education. Receptive to the progress of human communication, the school has never ceased to approach and integrate intelligently

DEZVOLTAREA INTERESULUI PENTRU ÎNVĂȚARE AL ELEVILOR DIN CICLUL PRIMAR PRIN TRANSDISCIPLINARITATE

Motivation is one of the most important prerequisites for school learning. The channeling efforts towards the construction and endowment of a school, towards the training of teachers are in vain without a solid motivation for students' learning. Self-regulation of learning also includes that of motivation (self-motivation). This requires students to have motivational learning strategies and tools used to maintain or increase their motivation while completing a learning activity. Parents consider a child motivated when he wants to have good results at school, does not expect to be "pushed" from behind and is appreciated by teachers. Among the motivational strategies and tools used at home and at school, the following stand out: increase hope; communication; engaging the imagination; encouraging self-motivation and involving the child in decision making; cultivating effort. At school, the teacher's enthusiasm and motivation are directly restricted to the student's motivation. Cooperative learning implies the hypothesis, according to which, the way in which the activities are involved determines the quality of the interaction between the students, the results of the activities being consequences of the interaction between them. Thus, one of the main elements to be created in the classroom is positive interdependence or cooperation

COMUNICAREA INTERPERSONALĂ ÎN ORGANIZAȚII

Author(s): Ana Maria Dumitru / Language(s): Romanian Publication Year: 0

Communication represents a process of interaction between people, groups, as a relation mediated through word, image, gesture, symbol or sign. Through it, individuals share their knowledge, experiences, interests, attitudes, feelings, opinions, ideas. Viewed as a process, communication consists in transmission and exchange of information (messages) between individuals. Communication means to tell those around you who you are, what you want, why you want a certain thing, and what are the means you will use to achieve your goals. Communication is defined as “a process through which a transmitter sends information to the receiver through a channel, in order to produce certain effects on the receiver.” In the present paper we analyze the most important types of communication: intrapersonal communication, interpersonal communication, small group communication, public communication / in organizations and mass communication. The success of communication in organizations depends on its manager, who must be a true manager of his organization's communication system, and this requires a continuous effort on his part in accumulating knowledge and training skills in organizational and interpersonal communication

Criminalitatea legată de situația politică din România în perioada pandemiei

Criminalitatea legată de situația politică din România în perioada pandemiei

Author(s): Tiberiu Viorel POPESCU / Language(s): Romanian Publication Year: 0

The multidimensional health crisis that broke out in late 2019 and early 2020, amid the transition from the epidemic of Sars-CoV -2 virus that initially appeared in China, to the pandemic generated by the same virus, had multiple implications in almost all areas of activity. The restriction of citizens' rights and freedoms has had profound economic implications, upsetting the social and legal order. The effects of coronavirus disease (COVID 19) caused by the virus, materialized in the overcrowding of health facilities, overwork of medical staff, the suffering of those who contracted the disease or loss of life, did not prevent some citizens from denying the danger, often generating riots against protection measures. initiated at the level of all states of the world. In Romania, as in most countries of the world, restrictive measures have been imposed to prevent the spread of the virus, measures to support the affected sectors of activity, but also measures to adapt activities to the new epidemiological context, such as teleworking, where this was possible, or online school. The procedures by which state bodies have implemented measures to limit the spread of the virus and the way in which the social reaction against the measures ordered by the State, viewed from a criminological perspective, can be briefly analyzed in terms of political crime, this being a type of crime widely debated in the literature.

Legislative election during pandemics. Challenges to democracies

Legislative election during pandemics. Challenges to democracies

Author(s): Claudia Gilia / Language(s): English Publication Year: 0

The Covid-19 pandemic has challenged the democracies. A representative democracy is the favourite instrument in terms of expressing a people’s sovereign will. Any democratic system is based on free, periodical elections. The election procedure is the natural way in which peoples participate indirectly in political decision-making. The conduct of the election under special conditions, like the conditions the heath crisis imposed, had consequences, particularly in terms of legitimacy. The pandemic-affected countries have taken a number of measures to ensure safe voting to electors, though a number of shortcomings marked the organization and carrying on of the election processes, such as lack of funding, technical errors, quarantined people’s inability to vote, low attendance, and legitimacy issues. In our study, we are analyzing the legislative elections that took place in Romania, Slovakia, Croatia, and Lithuania. After the electoral processes, which took place under these special conditions, it is a must to rethink the electoral processes in order to allow all voters to participate in the election of political decision makers.

Online sales of medicinal products in the CJEU case-law – between the free movement of goods and public health protection

Online sales of medicinal products in the CJEU case-law – between the free movement of goods and public health protection

Author(s): Gabriela Belova / Language(s): English Publication Year: 0

The trans-border online purchase of medicines has been growing in the last decades. This paper provides an in-depth analysis of the relevant case-law of the Court of Justice of the European Union. The Luxembourg Court has addressed the issue of online sale of medicinal products on several occasions primarily from an internal market perspective. From its first judgments in cases Doc Morris, Ker-Optika and Pierre Fabre the Court tried to find the delicate balance between the freedom of goods within the European Union and the principle of protection of the public health. On the one hand, the Court tries to keep in line with the development of the internal market, including medicinal products sold online and on the other hand the public interest has been always observed, in particular the protection of public health. The article pays attention to one of the legislative initiatives of the European Commission in this field as well as to the newest judgments of the Court of Justice of the European Union.

Social Factors Influencing the Acquisition of the Romanian Language by Students Belonging to a Local Community Hungarian Minority

Author(s): Anikó Erzsébet Fügedy,Gavril Flora / Language(s): English Publication Year: 0

Research on language acquisition is a central theme in sociolinguistic research. Contemporary social, economic and political processes affect the life of communities and the languages what they speak. Globalization, migration and the enlargement of the European Union can significantly change the role and the future of majority and minority languages. In this research, we aim to reveal the family level language choice strategies of the Hungarian community in the small town of Margitha (Bihor County, Romania), discussing the role of family related social framework that positively or negatively influences the motivation of minority students to acquire knowledge of the Romanian language. For this purpose, we used both quantitative and qualitative methodological approaches. The results of research confirm that in multi-ethnic communities perhaps the most important, however at the same time the most vulnerable component of ethnic identity is the linguistic identity, which plays a key role in shaping the cultural landmarks and contents that determine the social integration of the individual. The positive family effects of socialization with the Hungarian language can be observed mostly in the ethnically homogeneous family. However, if one of the spouses is ethnic Romanian, the dominant language of communication within the family is more likely to be the Romanian language.

Ukraine is a multinational and multicultural country. Though Ukrainian scientists have studied the issue of multicultural education from different aspects, nevertheless, there is no special or ideal model of multicultural education. That is why we decided to monitor the students’ multicultural education state at secondary schools of Ukraine. In order to identify the state of multicultural education in Ukrainian schools we conducted an empirical study in schools of Cherkasy region among primary, secondary and senior level students. The main method was determined as questionnaire, which is provided for clarification of issues of national-patriotic and multicultural orientation. Accordingly, questionnaires that combined quantitative and qualitative data collection were offered to the 4th, 6th and 11th grade students in some schools in Uman and Uman district, covering 296 respondents. Thus, the monitoring of the state of multicultural education in Ukrainian school education has shown that the problem of multicultural upbringing of children and young people is addressed at the government level, relevant research is conducted, some aspects of multiculturalism are observed in educational programs of some subjects, but the level of multicultural education of students should be higher.

The Philosophical Vision of Legal Punishment

The Philosophical Vision of Legal Punishment

Author(s): Virginia Zaharia,Veronica Pozneacova / Language(s): English Publication Year: 0

The concept of punishment represents one of the most difficult legal issues that are related to the concept of human freedom and responsibility. Since Antiquity, the brilliant minds of humanity contemplated about the sense of punishment and the function of this institution. Each epoch analyses this concept from different aspects and some of them are reflected in the actual legislation. The most important principles of contemporary criminal law were expounded by the Ancient, Modern and Contemporary philosophers. The field of research of this article is the philosophy of punishment of criminal law. In this study, we have applied the method of historical research of the proposed topic, which gives us the opportunity to analyze the development of criminal punishment and its goals from a historical perspective. In this paper, we aimed to determine the philosophical base of the legal punishment that legitimizes the application of sanctions to the person who committed the crime. We established the importance of the theories developed by brilliant thinkers for the contemporary concept of penal retribution and legal regulation of this institution. This theme generates several discussions that are formed in the process of comparison and debating of the ideas of influential philosophers regarding the purpose of criminal punishment. Therefore, we consider that the analysis of the theories of great thinkers gives us the possibility to understand the complexity of the phenomenon of criminal punishment, and leads to the more effective application of state constraint towards the offender.

Exhausting the Natural Capital is a Dangerous Trend for the Sustainability of the Socio-Economic System

Exhausting the Natural Capital is a Dangerous Trend for the Sustainability of the Socio-Economic System

Author(s): Maria-Luiza Hrestic,Constanta Popescu / Language(s): English Publication Year: 0

Natural capital is the collective term both for the products of the natural assets of our planet and for the ecosystemic services that result from the interaction of these assets, services that support life on our planet. In fact, the ecosystemic services resulting from the activity of the Natural Capital constitute the fundament of the entire activity of the socio-economic system and include food, water, energy, climate security and other services essential for all. Unfortunately, often, the value of the natural capital was forgotten in the traditional methods used for measuring economic performance. This non-recognition of the importance of the natural capital has, in the end, a damaging effect on the ecosystems, biodiversity and natural environments in general and can trigger a loss of the essential services of the ecosystems. The value of the natural capital becomes acknowledged increasingly more as critical for economic success and economic sustainability. Many decision-makers and organizations have begun to focus on the way value can be attributed with precision to the natural capital and in connection to economic policies. The result hoped for is a better decision-making to manage, preserve and improve our natural environments. Moreover, the identification and quantification of the natural capital and of the ecosystemic goods and services offers a supplementary economic justification for the efficient management of the natural resources. As the scientific research has noticed and supports increasingly more, the attribution of value to the natural capital and to the ecosystemic services can be a positive step in the prevention of their exhaustion by promoting a better understanding of the true economic value of the ecosystemic services and by providing economic tools able to consider this value adequately.

Motivation and Management of Human Resources in Public Administration

Author(s): Silvia-Elena Iacob,Ayten Güler Dermengi / Language(s): English Publication Year: 0

Motivation has the potential to make a difference in terms of results both individually and organizationally. Motivation based on classical processes, such as the theory of hope, the theory of goal setting and the theory of equity. In the social context of governmental organizations, public values have the potential to infuse the value structures of organizations and individuals, leading to forms of prosocial motivation that focus on supporting the public interest and helping citizens. The management of human resources has evolved considerably since this function was named the Personnel Administration. Currently, organizations do not only manage resources, but focus in particular on the proper management of human capital. There are many aspects of human resources management, all of which are just as important for the development of an organization.
