In the context of the Polish constitution, the monograph analyses the framework of the freedom of engaging and conducting research (Art. 73). By formulating this freedom, the constitutional legislator at the same time sanctioned the principle of equal legal protection of the scholarly output of the researcher, and that regardless of the dissimilarity of the subject and the nature of research work in various departments of knowledge/scholarship (Art. 32 in reference to Art. 64 Para. 1 and 2). However, the realisation of the indicated constitutional maxim at the level of the act of law and implementing acts necessitates the diversification – due to the nature of scholarly research in various disciplines of scholarship – of the principles of legal protection of intellectual copyright. Meanwhile, the legislator does not address this problem directly. In order to elucidate the scholarly problem which was formulated in this manner, the first part of the work was devoted to an analysis of the freedom of scholarly research as a category which is constitutionally protected. The second part is devoted to the problems of the legal bases of the protection of scholarly work, and to be more precise – of the right of the researcher to indicate authorship of a scholarly publication from the perspective of the regulation(s) of the constitution and other regulations, which develop and particularise its ordinances, including the provisions of the codices of ethics to which scholars are bound. Thus, one indicated the principles of reliable attribution of the authorship of research works, with special reference to research conducted in research teams of multiple people, including teams of interdisciplinary nature. In order to illustrate the theses which were put forward, one described the object of scholarly research realised in the domain of experimental exact sciences, and subsequently the principles of the publication of the results of the said research, along with the regulations of the attribution of the authorship of scholarly works which are published. The diagnoses which are formulated in this manner may contribute, in the opinion of the authors, to the raising of the awareness of the legislator and as a result they may influence favourably the direction(s) of the scholarship-related policy of the state in the course of the reform of scholarship which is being realised in Poland.

No member state of the EU has ever gone as far in subjugating its courts to executive control as the current Polish government has done. The Polish case is a test whether it is possible to create a Soviet-style justice system, where the control of courts, prosecutors and judges lies with the executive and a single party, in an EU member state. || The Polish government’s assault on its judiciary represents a threat to the EU’s legal order and long-term political stability. The EU and national legal orders are now so intertwined as to make up a single patchwork quilt, from which so great a hole cannot be cut, without the whole unravelling. 328 years ago, the great English philosopher John Locke noted that “wherever the law ends, tyranny begins.” Poland is at this threshold now. The stakes could not be higher. The outcome of this conflict will determine whether the EU has a future as a community based on the rule of law.

Centre for Civic Education (CCE), within a subprogramme Equal Opportunities, has filed an Initiative to review the constitutionality of certain provisions of the Law on Misdemeanors to the Constitutional Court of Montenegro almost two years ago, assessing that they violate constitutionally guaranteed rights of citizens of Montenegro. Constitutional Court has not made a decision up to this date, allowing thousands of our citizens to be put in a position of inequality before the law, while the governing structures were left with uncontrolled mechanism of abuse.

Legal interpreters assume, inter alia, that the legislator consistently applies the concepts throughout the entire legal act, and that they do not introduce any unnecessary fragments into the text (prohibition of per non est interpretation). Do such interpreters' assumptions accurately reflect the way the legislator works? And do the persons handling the legislative process employ in their work tools with which the law will then be read? In order to find the answer to this question, the author has analyzed the applicable legislation and has undertaken socio-legal research, using the methods of text analysis, participant observation and in-depth interviews with legislators working in the Legislative Office of the Chancellery of the Sejm of the Republic of Poland. The results of his research and the conclusions derived from it are presented in the monograph titled Korespondencja dyrektyw redagowania i interpretowania tekstu prawnego. The Universal Declaration of Human Rights for the first time enshrined and guaranteed as fundamental the principle that everyone has the right to a trial before an independent and impartial tribunal to determine his rights and obligations. Subsequently, the International Covenant on Civil and Political Rights guaranteed that all persons shall be equal before the courts and that, in the course of judicial proceedings of a criminal charge or of civil rights and obligations, any person shall have the right, within a reasonable time, to a fair and public trial before a competent, independent and impartial court established by law. As a result of a long and fascinating legal and jurisprudential evolution, the imperative of resolving disputes by an independent and impartial court is today recognized in regional human rights instruments, in national constitutional and legislative provisions, in common law, as well as in conventions and traditions legal, and the importance of an independent and impartial judiciary is accentuated by the fact that the implementation of all other rights depends on the good administration of justice. The independence of the judiciary is the premise of the rule of law and a fundamental guarantee of a fair trial, while impartiality is essential for the proper performance of the judicial function. Although they seem commonplace in the mentality of contemporary jurists, the analyzed concepts would not have had the configuration we know today if they had not been enshrined and guaranteed by the Universal Declaration of Human Rights.

The Kosovo question has attracted the widespread attention of researchers, politicians, diplomats and analysts of international relations for more than three decades. as the Kosovo crisis developed in the direction of escalation or de-escalation, thus the issue of Kosovo and Metohija occupied a higher or a lower place on the “ranking list” of the priorities of the international community. nevertheless, it remained on that list permanently. during the observed period, the crisis reached its zenith twice. the first time, in the period 1998-1999, after the escalation of the war in Kosovo and the subsequent NATO aggression on the Federal republic of Yugoslavia. and the second time, in February 2008, when Kosovo Albanians unilaterally declared independence and their decision was soon recognized by dozens of states. on both occasions, numerous questions have been raised in the academic community. However, even today we are still searching for answers.
