In 2013, Directive 2009/81/EC of the European Parliament and the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, supply contracts and service contracts by contracting authorities or entities in the fields of defense and security, amending Directives 2004/17/EC and 2004/18/EC (Directive 2009/81), was implemented into the Polish national law on public procurement. The transposition of Directive 2009/81/EC into the Polish national law should have been carried out with the preservation (as far as possible) of strengthening the Polish defense industry potential, especially its developmental potential, through public contracts awarded by Poland The article assesses the implementation of Directive 2009/81 into the Polish law, as well as the mechanisms for Polish industry development which were used during this process.

The safety of the patient during the providing the health services is the main defiance for health policy and for the proper functioning of the units of the health care. The conditions of the health care system determinate the quality of the health services, and consequently cause the safety of the patient incidents. As a result, the right of patient to the safety is violated, frequently in very serious way. In this acrticle there are described two main questions. First of all, some statistical data has been cited, which illustrate the scale of the medical incidents, related to the health services in Poland and the other countries. Then there are briefly described european and polish legal acts, which regulate the procedures, areas and methods of the activities for improving the safety of the patients.

Deviation of the aviation into two functional areas: civilian aviation and state aviation follows current international regulations. The basic legal document for civilian aviation operations is Chicago Convention from the December the 7th 1944. Despite the fact that civilian aviation can apply all regulations currently implemented, the state aviation has some significant problems in some areas of its implementation. Legal issues are not the only ones. The training and control systems are different and not based on the same regulations. Only military aviation has coherent model of fl ight and maintenance personnel preparation, precise aviation regulations in addition. The author and his proposals included in the article are related to the problems of the functionality of the state aviation in the following areas: aviation law, state aviation authority and training model for flight and maintenance personnel.

Jednolita ochrona patentowa – wybrane zagadnienia i uwagi o działaniach podczas polskiej prezydencji w Radzie UE

One of the main targets of Polish Presidency of the Council of the European Union was to reach an agreement regarding unitary patent protection. However, although numerous attempts were made the issue remained unsolved. EU Member States reached a provisional agreement on the two draft regulations implementing enhanced cooperation in the area of unitary patent protection, but compromise on agreement for the creation of a Unified Patent Court was not achieved. The works on Unitary Patent Protection lasted within enhanced cooperation of 25 EU Member States. The unitary protection was to be created by so-called patent package built of two regulations, adopted by union institutions introducing enhanced cooperation on unitary patent protection system and with respect of translations and international agreement on creating Unified Patent Court. The agreements stipulate establishment of European patent with unitary effect applicable on territory of all EU Member States participating in enhanced cooperation. The achievements of Polish Presidency in Europe in works on unitary patent protection should not be criticized although on domestic ground not only should the Polish stand and accepted offers but also the commitment of Polish society in establishing rules be refused.

The article demonstrates an attempt to define the legal boundaries of using advertising that employs sexual themes on the basis of resolutions issued by the Advertising Ethics Committee. Issues with the use of sexual themes in advertising have been present for a long time. Existing laws do not always allow for the barring of such advertising, making self-regulation, in which the United Advertising Associations Council’s Advertising Ethics Committee plays a vital role, crucial. Benefits of such self-regulation, compared with legislated regulations, include flexibility in implementing solutions and the ability to promptly alter decisions in accordance with evolving social standards.

The author aims to explicate the term ‘apolitical Police’ and to expand on the postulate that the Police as a state agency should remain apolitical. He analyses the matter in various perspectives, including the informal support given to a political party, personal politics in appointments to positions of power, re-organisations leading to a shift in the balance of power between political parties, pretend activities aimed at achieving publicity goals, discretionary interpretation of targets achieved, etc. The process of making the Police political is however not affected through unlawful acts, but rather by means of generating connections and interrelationships which result from faulty legal provisions. The situation may be improved by perfecting the mechanisms of democracy and by applying high moral standards in politics.

In modern times, disability has become not only a medical and psychological problem, but also a social one. More and more people in the world are becoming people with disabilities. This state of affairs requires care for the rights of persons with disabilities in the same way as for the rights of every human being. Unfortunately, simply establishing the law is not enough to normalize the lives of people with disabilities. Changes in social attitudes are necessary because they are conditioned by prejudices and, above all, by the lack of reliable knowledge. The normalization of life of people with disabilities is based on the assumption of full participation in all life trends. However, the law does not guarantee changes in the human mentality. Therefore, a joint effort of specialists of different disciplines and the good will of all people is needed to normalize the situation of people with disabilities.

Nationalists do not identify themselves with one particular political system, but they aim to create and sustain sovereign nation states. There is no doubt that European Union poses a threat to the sovereignty in a traditional sense due to the transfer of executive authority from the national parliaments to the amorphous supranational structure. It should be noted that United States have never acceded any organization with independent legislative power. Moreover, advocating the nation states does not have to go together with nationalism, while the latter not always occurs combined with the variously defined populism. Populism can put on different forms. In Poland and Hungary populists have majorities in respective parliaments and are strongly affiliated with traditional institutions. Donald Trump gained support thanks to the creation of an image of an angry ‘ordinary fellow’, which citizens disdained by the elites could relate to. He was also attracting interest, because he ignored the rules of political correctness. But Trump’s rhetoric devaluates the most crucial institutions of the American political system. Furthermore, both Trump and his supporters gravitate towards conspiracy theories and the primacy of common-sense attitude, denying the value of expert’s opinions. Similar phenomena are taking place in Europe. Although there is no one consistent definition of ‘populism’, one could say that populism is a symptom of frustration melting into anger that is a threat to the wholesome nationalism and enduring sovereignty. It does not constitute a reform programme, and the ideological void is filled by demagogues, however posing as guardians protecting the “disinherited majority” from the amorphous “establishment”.

The service of police officers and soldiers at the Polish-Belarusian border during the 2021–2022 crisis

In recent years, the question of population migration has become more present in the Polish social and political life. One of the examples of this phenomenon was the set of events at the turn of 2021 and 2022, when thousands of people tried to illegally cross the Polish-Belarusian border and enter the Republic of Poland. The state reacted by reinforcing border services, deploying soldiers and police officers to serve on the border. The circumstances of the deployment, conditions of service and related impressions of participants became the subject of research, the results of which are presented in this article. Most of our respondents were deployed to the border by order and were scarcely or completely unprepared to the service. The social and living conditions during service are evaluated as rather good, although leisure activities were poorly organised. Among the feelings and impressions from service, the most highly appreciated were the team atmosphere and cooperation and the attitude of superiors. Nevertheless, what prevails is a moderate dissatisfaction with the job, with a vast majority of participants unwilling to repeat such service.
