- Summary/Abstract:This article examines the intersection of family law in Albania and the jurisprudence of the European Court of Human Rights. It analyzes how Albania’s legal framework has evolved in response to European Court of Human Rights rulings, particularly regarding issues such as parental rights, child custody, etc. The study highlights key regulatory legislation, such as the Constitution of the Republic of Albania, 1998 and the Albanian Family Code, that have aligned national standards with European human rights standards. By investigating case studies and legislative regulations, the article underscores the importance of integrating international human rights norms into domestic legal practices, ultimately advocating for a more robust protection of family rights in Albania. The findings contribute to a broader understanding of how European human rights standards influence national legal systems in the context of family law. By analyzing the jurisprudence of the European Court of Human Rights, this research aims to provide a comprehensive overview of the challenges Albanian family law had undergone and the potential pathways for future development. Ultimately, it emphasizes the need for continuous legal adaptation to ensure that family law effectively meets the diverse needs of Albanian society in an ever-changing European landscape.

- Summary/Abstract:Gender equality and non-discrimination have been used in recent years in a way that raises many questions. Like the decades-long struggle for women to be treated equally with men, today the battle is being fought over the right of same-sex couples to marry. The system of rules has had to react very quickly to the changes, taking into account the new fundamental rights. We are witnessing a change in the view of the family, which has long since ceased to be about procreation. The redefinition of the concept of family, globalization and inclusion are high on the "agenda" of European officials. Is there something behind this agenda? Why has it become a "must have" to recognize same-sex marriages, why should gender self-determination be a mere administrative process? Is marginalization and discrimination so profound, or are we missing something else? The idea of acceptance is causing religion to cede the important position it has held until now. Will all the discourses articulated around the concepts of faith, tradition and cultural identity still have an echo? Do these categories of people, vulnerable groups, need to be taken into account in the creation of effective public policies? Is a national strategy such as the European one needed? There is a legislative and geographical scope, a dialog, which at times seems forced, between the countries lagging behind (in the adoption of effective protection rules) and the European Union. What is the appropriate national solution? Attempts to justify the rejection of the idea of legal regulation of same-sex marriages by appealing to notions such as the traditional family, unions that represent a social, cultural and legal heritage, no longer resonate with the Court, which holds, on the basis of Article 14, that the traditions, stereotypes and social attitudes prevailing in a given country cannot justify a difference in treatment based on sexual orientation.

- Summary/Abstract:In this study, we propose to carry out an introspection on the family in Romania, inthe historical time we are living in, characterized, in our opinion, by two trends. Onthe one hand, the mutations that are attracted both by the informational age in whichwe live, and by the changes produced on the human species, on the individual'sperception of himself and of his neighbor, when the problem of acclaiming andguaranteeing fundamental rights have mitigated, so as not to we say that they haveliterally "broken" the rigid boundaries between the sexes, with all the consequencesthat occur and which we will try to at least touch in our study. We say this becausethe issues are complicated and they need to be deepened, including interdisciplinary,in works of other dimensions, including doctoral or postdoctoral ones. On the otherhand, it is about the need to preserve some ancestral, traditional values, withoutwhich the family would not be able to evolve in accordance with its role and place insociety and, without big words, the world could not move forward. The article will be structured in several sections, in which the views of the two authorswill be presented, respectively, of a person at an age where life experience configures acertain perception, which naturally differs from that of a person at still in full existentialand professional evolution. We will strive to harmonize the two visions and develop astudy in which harmony prevails, as should happen in the life of any family. The approach will be equally legal, but also philosophical, sociological and literary

- Summary/Abstract:This survey is circumstantial to the jurisdiction of the courts. In the first part of thepaper, some general issues are reviewed on the innovations promoted by the NewCivil Proceedings Code (NCPC), which introduced the judicial category of theguardianship court. It was noted that at the time of the adoption of the NCPC, such avision could be considered a questionable one, since the duties of protecting minorsand other persons were carried out under the terms of greater celerity by theguardianship authority. It is also noted that the guardianship court is currently only astructure of a judicial body (judiciary), and not a specialized court.A broader analysis is dedicated to the material and territorial jurisdiction of theguardianship court. Material jurisdiction refers to cases strictly determined by the CivilCode and aimed at protecting minors or other categories of persons. All these situationsare of strict interpretation. As far as this territorial competence is concerned, it isderogatory to the common law, a circumstance fully justified in relation to thesituations that require the protection of a natural person. The norms of territorialjurisdiction in the Civil Code in matters of guardianship are also mentioned. In the current circumstances, where we are witnessing an unprecedented recrudescenceof the agreements of some minors (physical violence, physical aggression, etc.) theauthor of the court case by law of a guardianship institution can contribute to a betterprotection a minor.

- Summary/Abstract:In today's context, parent-child relationships have undergone significant transformationsunder the influence of social, economic and technological change. One of the keyissues is the emphasis on open and empathic intergenerational communication, dueto a better understanding of child psychology and the need to support emotionaldevelopment. Modern parents tend to adopt a more democratic style of parenting, based on dialog and collaboration rather than traditional strict authority. Digitaleducation also plays a central role, as children have vast access to information andtechnology, which can create a generation gap but also new opportunities to connect. However, parents face challenges such as the pressure to protect children in aglobalized environment that is also exposed to online risks. Parental authority, in thiscontext, is no longer just a form of control, but becomes a guide in the process ofresponsible child autonomy, with a focus on trust and mutual respect.

- Summary/Abstract:The need for an interdisciplinary network in the process of finding biological families among internationally adopted youth is essential to ensure complex and coordinated support. Such a network brings together specialists from various fields, such as psychologists, social workers, lawyers and counselors, who can offer adoptees the necessary support from multiple perspectives. The collaboration between these professions contributes to the effective management of emotions, legal aspects and social challenges that may arise during the search for biological families. According to, Monica Lanyado, from British Association of Psychotherapists, London, the emotional burdens of the transition from adoption to adoption: transitions, attachment, separation and loss, make us look towards Attachment Theory, which highlights that the child is expected to form a new attachment to by the adoptive family, while often in the grip of grieving the loss of the adoptive family. In this context, to make a brief presentation of the international adoption procedure and to highlight the psychodynamics of the professional network around the child is discussed.

- Summary/Abstract:The family is one of the most intimate social realities for us. It is perhaps the mostfamiliar social phenomenon. In all societies people start families, although often thesefamilies are different from the type of family we are used to today. Defining moreaffectively than rationally, any individual could say what a family is, this being possibledue to the fact that every person has had to deal with families in the course of his life,be it the family he was born into, by his own family, or by those in the communitywhere he lives. The family is one of the most widespread types of social groups anddespite this, the attempt to define it is not at all easy, but, on the contrary, the greatdiversity of family types that have succeeded each other over time or that coexist insocieties contemporaries, requires finding some common characteristics. In theseconditions, the role of the family in the process of raising and educating children is adecisive one. Unfortunately, modern and postmodern society brings with it majorproblems in this chapter as well. Disorganized families, families „built” on unhealthyprinciples were the basis for the development of deviant and delinquent behaviorsamong children and young people. Under these conditions, can the family and theconcept of family stop the growth of this scourge? What (more) is the role of thefamily in the process of raising and educating children.....these are some questionsthat we will try to find an answer to in this study.
