Razmišljanja o odnosu vazdušnog rata i pojma pravednog rata, razmišljanja kojima Karl Šmit (Schmitt) zaključuje svoj Der Nomos der Erde (to važno, ali često potcenjivano delo njegove zrele faze), mogla su da budu napisana kao reakcija na NATO bombardovanje Miloševićeve Jugoslavije. Ali ona su stavljena na papir pre više od pola veka. Sáma ta činjenica kao da potvrđuje uznemirujuću aktuelnost Šmita. Međutim, njegova aktuelnost dotiče sve aspekte jugoslovenske drame. I zaista – budući da on pojam političkog svodi na suprotnost prijatelj/neprijatelj i insistira na homogenosti države – Šmita slobodno možemo smatrati par excellence teoretičarom politike etničkog čiščenja, politike koju su, posle Miloševića, na jugoslovenskom tlu sprovodili svi sukobljeni nacionalizmi.

Kako je pitanje obrazovanja žena bilo posebno važno u ovom periodu, ovoj temi će se posvetiti posebna pažnja, kao i doprinosu žena nauci. Pregled prilika kad su kultura i umjetnost u pitanju, posebno književnost, slikarstvo, pozorište i film daje se kroz predstavljanje rada određenih žena u ovim oblastima. Doprinos Ustavnog suda Republike Hrvatske u definiranju okvira za tumačenje ustavne odredbe o nezastarijevanju ratnog profiterstva i kaznenih djela počinjenih u vrijeme pretvorbe i privatizacije

Odluka USUD je iznimno značajna jer, osim što definira okvir za realizaciju koncepcije zamišljene i provedene Promjenom URH i ZON, sadrži u sebi jasnu poruku upućenu samom ustavotvorcu da parcijalne promjene ustavnog teksta ni pod kojim uvjetima ne smiju biti oruđe konstitucionalne instrumentalizacije već moraju biti iznimne i uvijek i pod svim okolnostima dobro promišljene, protumačene i primijenjene polazeći od cjeline ustavnog teksta. Nadalje, u odluci USUD se između redaka može iščitati i kritika ustavotvorcu da je krajnje prijeporno temeljnim pravnim aktom države retrospektivno regulirati određene pojave glede kojih će učinci određenih ustavnih promjena biti vremenski krajnje ograničeni usljed čega će i sam ustavni tekst po proteku kratkog vremena postati opsoletan. U smislu implikacija odluke USUD na kaznene postupke u tijeku koji su pokrenuti na osnovi ZON, neće doći u pitanje oni postupci kod kojih se utvrdi da u vrijeme stupanja na snagu Promjene URH još nije nastupila zastara kaznenog progona. Međutim, oni postupci u kojima povodom prigovora zastare ili po službenoj dužnosti (na zastaru sudovi moraju paziti po službenoj dužnosti, što se posebno odnosi na žalbeni sud koji u tom smislu nije vezan konkretnim žalbenim osnovama) bude utvrđeno da je u vrijeme stupanja na snagu Promjene URH konkretno kazneno djelo bilo u zastari, morat će po toj osnovi biti obustavljeni. Eventualno neobaziranje sudova na tu okolnost značilo bi ne samo povredu kaznenog po Zakonu o kaznenom postupku već i povredu ustavnog prava zajamčenog člankom 31 URH. Očito je da je tendencija relativizacije zastare kaznenog progona u posljednjih nekoliko godina u Republici Hrvatskoj, a koja nije uvjetovana kriminalnopolitičkim već isključivo dnevnopolitičkim potrebama, zamišljena i realizirana na dvije razine – zakonskoj, pri čemu nezastarijevanje ne zahvaća ona kaznena djela koja su u vrijeme stupanja na snagu zakonskih izmjena već zastarjela i ustavnoj, pri čemu bi, prema shvaćanju koje je prima facie pogrešnim ocijenio i USUD, nezastarijevanje retroaktivno zahvatilo i ona kaznena djela za koje je zastara nastupila i to samo zbog toga što je to tobože dopušteno i opravdano realizirati kroz ustavni tekst (!?). USUD je takav pokušaj manipulacije i instrumentalizacije ustavnog teksta u citiranoj odluci odlučno i argumentirano otklonio uz po(r)uku da se ustav mora tumačiti integralno i s obzirom na svrhu koja se njime nastoji ostvariti. Važna je i po(r)uka USUD da su temeljna načela prava ugrađena u garantivnu funkciju ustava i zakona neprekoračivi limit ne samo pri donošenju zakona već i pri izmjenama ustava. Za nadati se da će tu po(r)uku oni kojima je upućena prije ili kasnije shvatiti u najboljem interesu vladavine prava.

SOCIAL MEDIA IN OPERATIONS – A COUNTER-TERRORISM PERSPECTIVE

Social media has assumed a fundamental role in today’s society. As a technology with a high level of reach, billions of people are connected daily through global platforms, where they share personal experiences, documents and visual content. Social media has become one of the main channels through which people connect and communicate. NATO, as an organisation of 29 member states with different historical and cultural backgrounds, has made great efforts to develop its social media capabilities. NATO and its key decision makers are present in nearly all major social media networks and have gathered thousands of fans and followers. The current #wearenato campaign conveys the message that every day NATO allies work and train together to keep their citizens safe and that NATO, through partnership and cooperation, has secured peace and freedom for nearly 70 years. Most of NATO’s current social media efforts are focused on this ‘message delivery role’, aiming to raise awareness about NATO as a brand and to resonate with key opinion formers within a younger audience. Since September 2014, when NATO’s Strategic Communications Centre of Excellence (StratCom COE) was established in Riga, Latvia, substantive progress in the study and understanding of social media has been made. The StratCom COE has published a number of research papers exploring current trends in social media and leading discussions on future strategy and related concepts, including the delivery of courses in social media analysis. NATO is involved with two major strands of work, both of which explore more flexible approaches of analysing and engaging with social media. First, the ‘Digital and Social Media Playbook’ currently under development by NATO’s Science and Technology Organisation (STO) will constitute an up-to-date information environment assessment tool. Second, through the Multinational Capability Development Campaign (MCDC), NATO has supported the development of two social media-related concepts to be used specifically in operations. Although there are a number of academic publications that cover the use of social media for military purposes or provide recommendations on how social media can support military actions on the ground, few previous projects have focused on the exploitation of social media in the context of Counter-Terrorism (CT). This is understandable, as according to NATO’s CT policy and concept, terrorism is dealt with at the national level by law enforcement agencies under state control and supervision. In most cases NATO would support Member States at their request, or as part of an operation in an environment in which law enforcement forces of the nation state are overstretched or non-existent. Apart from a collective defence scenario, this is unlikely to happen within the territories of the Member States and has more relevance for non-aligned nations. As part of ongoing efforts to further develop the CT perspective on social media, the NATO Centre of Excellence-Defence against Terrorism (COE-DAT) and the NATO StratCom COE conducted a workshop on ‘The exploitation of social media on operations’ in September 2017. The views were collected of over 20 social media experts and analysts, as well as NATO CT experts. The aim of the workshop was to develop the overall approach of the military’s use of social media to deliver effects in CT scenarios. As such, the workshop can also be seen as part of both centres’ contribution to strengthening of NATO’s fight against terrorism. This report provides a summary of those discussions. A brief outline of the panel’s main presentations is provided as well as a summary of the following questions discussed during the Q&A. „ Can hard-line terrorist groups with extremist narratives be effectively countered with messaging or would it be better to focus on those individuals and groups on the brink of radicalisation and joining a terrorist group? „ Assuming that former terrorists enjoy high credibility within the target audience (with reference to “Breaking the ISIS Brand” by Anne Speckhardt), how could or should they be integrated within military operations? What would such operations look like? „ Can offensive Cyberspace and Information Operations extend the role of the military within Countering Violent Extremism (CVE) programmes? „ How could CT-related social media expertise be integrated into HQ structures? „ Is it possible to develop reach-back capabilities to support deployed forces? „ What tools are there to offensively counter aggressive strategic narratives and which of them are in use in military entities of NATO and the nations? „ Which information from social media is relevant from an intelligence analyst’s viewpoint and which tools are used for social media analysis in military entities? „ Once key influencers and propaganda distribution centres have been identified, should the military take measures to impede the spread of certain messages? In such cases, is the military capable of doing so or would this require external / industry support? „ How are CT aspects reflected in the roles and responsibilities of existing functions and capabilities, such as StratCom, Info Ops, PA, and PSYOPS? Which concepts / doctrine could be improved and updated? „ How does the social media industry counter terrorism and where would cooperation with the military be beneficial? In closing, a number of suggestions regarding the following key issues identified are provided: „ Counter-Narratives „ Identities „ Social Media Analysis in support of Intelligence „ Information Operations, Psychological Operations and Counter-Terrorism These suggestions include future steps which might be beneficial for further CT-related exploitation of social media in military operations. We hope that those who could not attend the workshop can enjoy the content of this publication – as well as spark their interest in future activities dealing with this important topic.

This report presents an overview of the state of the rule of law and the judiciary in Kosovo, divided into two parts. The first section gives an overview of the key challenges to the effective rule of law, with a focus governance of the judiciary. It delves into the structure and role of the monitoring bodies of courts and prosecution services, the state of judicial independence, and the mechanisms for transparency and accountability. It then moves onto practical issues, such as disciplinary procedures, structures to curb corruption and training and capacity building systems. The section finishes with an overview of the judicial integration of the north of Kosovo, the efforts to reduce the backlog and the Functional Review of the Rule of Law. Equally important, the second section addresses court administration and the performance of the administrative staff. It reviews the size and structure of the courts, the budget of the judicial sector, the effects of the wider education system on the judiciary, the status of the Administration, the existing rules for hiring and performance evaluation, and the decentralization process. The section closes with an analysis of the ongoing judicial digitalization.

U prvoj polovici 20. st., balkanski i svjetski ratovi su prekrajali geopolitičku kartu svijeta. Mnoge su države nestajale, a mnoge nastajale. Odnosi Svete Stolice s novonastalim državama tradicionalno su bili uređivani posebnim, sveobuhvatnim ugovorima, konkordatima. Prije Prvog svjetskog rata Sveta je Stolica imala sklopljene konkordate s Crnom Gorom (1886.) i Srbijom (1914.), ali s obzirom da ti ugovori nisu bili primjenjivi na novonastalu državu (Kraljevinu SHS, kasnije Kraljevinu Jugoslaviju), trebala je Sveta Stolica nakon priznanja nove države, Kraljevine SHS, 6. studenog 1919., s njom sklopiti sporazum kojim bi se pravno regulirao položaj Rimokatoličke crkve u državi: pitanja vjeronauka u školama i crkvama, prava vjerskih škola i ustanova, stjecanja crkvenih dobara, slobode komuniciranja sa Svetom Stolicom, slobode djelovanja katoličkih organizacija te niz drugih pitanja iz vjerskog života.3 U Kraljevini SHS živjelo je 1921. godine 48% pravoslavnih, 39% katolika i 13% pripadnika ostalih vjerskih zajednica. Pregovori oko konkordata otpočeli su ranih dvadesetih godina i potrajali više od desetljeća, da bi se 1935. postigla suglasnost oko svih detalja te se formirani ugovor (koji Stojadinovićeva vlada potpisuje 1937.) poslao u Skupštinu i Senat na usvajanje. Međutim, tada zbog ogorčenog protivljenja Srpske pravoslavne crkve konkordatu nastaje duboka politička kriza koja je, uz krizu nakon atentata na Stjepana Radića u Skupštini, bila možda i najopasnija kriza između dva rata. In 1975, news of an exceptional discover in Palmyra rapidly made the rounds within the scholarly community. Digging the ruins of a small sanctuary, archaeologists from the Polish Centre of Mediterranean Archaeology University of Warsaw uncovered a very well preserved statue of the goddess Athena, identified in Palmyra with the tribal goddess Allat. This Arabian deity did not hold a leading position in the Palmyrene pantheon, yet was deeply worshipped by the local Arab tribes. The book by archaeologist Michał Gawlikowski, the excavator who made the discovery and lecturer at the University of Warsaw, eminent scholar and expert on Palmyra and its antiquities, brings an in-depth study of this statue, set in a detailed examination of the architectural evidence for the sanctuary itself, which existed from the 1st through the 4th century AD. The author reconstructs successive stages in the development of this cult place and the respective architectural decor. The volume, in French, is an excellent example of an interdisciplinary approach to the study of archaeological excavation data, compared and critically analyzed in the context of a discussion on epigraphic and numismatic sources, reaching also into the fields of art. history and religious studies.

Some foreign observers think that nothing can ever bridge the abyss that ten centuries of open or hidden struggles have dug be-tween two neighbouring nations. This view seems to be corroborated by voices which rise on both sides of the border, and which assure that the Ger-man-Polish antagonism, carved in the ground and rooted in souls, will always remain, at least for a very long time to come. // We do not share these pes-simistic views. We believe that the German-Polish appeasement, necessary for Europe and beneficial to the higher interests of both countries, is achieva-ble. But whoever is looking for the means and the conditions to bring about reconciliation between Germany and Poland, it is above all important to dis-cern the causes of the oppositions which divide these two great nations.

The old requirements and knowledge of the conservation of numismatic materials, born rather from practice, were increased by the chemical work of K. Komárek121 It was especially after the Second World War that the importance of good catalogs of public museum collections as well as the great role of exhibitions which tend to highlight the economic function of money. Apart from the materials themselves, namely coins, this is done using photographs mounted on thick cardboard, graphic tables, maps, images, comparison tables, etc. // It can be concluded that during the years 1936 to 1960, the publications of Czechoslovak numismatists took off sharply. Because of the subjects of all the fields they offer us, until now, only a mosaic of analytical works. The fact remains that creative minds of the years to come can use it to draw an overall picture of the coinage of our countries.

Jejím cílem je zjistit, zda došlo mezi roky 2008 a 2013 k posílení či naopak k poklesu významu jednotlivých typů zdrojů organizací. Zajímá nás především, zda, resp. jak se mění relativní význam veřejných zdrojů v celkové finanční struktuře neziskových organizací v ČR. Liší se podíl veřejných zdrojů a změny v něm mezi lety 2008 a 2013 z hlediska odvětví působení organizací?
