Decentralization - the mainstay of increasing quality in delivering

The article deals with the issue of how the application of decentralization in public services leads to an increase in their quality. Although quality is more difficult to measure and quantify, it can be said that it is the extent to which the nature of public service performance meets the expectations of citizens in a particular community.Where service delivery is carried out in a decentralized manner, the local public administration authorities must first be concerned about how they respond to the expectations of the beneficiaries, and for this to describe quality standards, materialized by measuring some indicators. Measuring the quality of decentralized public services is the first step towards optimizing them. The article highlights the quality standards to be met by the local public administration authorities in the provision of a decentralized public service. With the provision of a decentralized public service, public authorities need to identify whether there is an improvement or a decline in the quality of services provided by decentralization and verify whether the increase in the quality of public services has led to a maximum degree of satisfaction that can be offered to the consumer.Thus, increasing the quality of public service provision must be a direct consequence of the application of the principle of decentralization by local public administration authorities.

The purpose of this research what are the questions related to the perception of voluntary social responsibility of enterprises they work for office workers identified in thisstudy as a basis for research questions and according to the detection of differences in demographic variables in this context it has been the aim of the research. For this purpose, a field research was conducted on people who work in the public sector inKocaeli. In the scope of the research, a survey was applied to the office workers in the public sector. As a result study, frequency tables were prepared as a result of the answers given by the employees. Percentage and frequency distributions were made with the data obtained and their perceptions about voluntary social responsibility were determined.

The book so ingeniously named “Actul administrativ. The ultimate theory” (The Administrative Act. The Ultimate Theory), validates once more how important and full of substance the theoretical (and more importantly practical) issues related to the administrative act are. Such importance is demonstrated both by the manner chosen by the author to present the notions described in the book as well as by the approach adopted to illustrate them. The theme in itself is extremely vast and it has so far been approached by a countless number of specialists from a doctrinarian and practical point of view, through valuable and ingenious comments issued with regard to various interpretable matters related to the administrative acts, the opportunity and the legality of such acts, matters related to prescription or the capacity of some structures to issue administrative acts. In fact, the theme is contemporary as it has been the main topic of research for numerous studies, articles, doctoral or ability theses. What is more, following pertinent and profound analyses, there emerged the conclusion that this is a field where „everything should be reconsidered” - namely the exorbitant legal regime of the administrative act, its validity conditions or even the theory of nullities .The material that constitutes the scope of my review mainly conforms to the classical approach to presenting the administrative act, focuses on theoretical topics and favourably combines theory and doctrine with contemporary practical aspects, a fact that makes it a quality textbook and an useful instrument that may be used by any student or legal practitioner interested in this field of law.

Individual values are formed through family, education, and various cultural experiences, while the values of public officials are shaped by the rule-of-government tradition of rule-making. The goal is to incorporate both approaches, value-based approaches and rule-based approaches into civil officials. Unethical treatment and lack of integrity are an obstacle to the fulfillment of the tasks of administration, and have an immediate and scope of unimaginable negative consequences on the individual and society. Consequently, the construction of an effective system of ethics and integrity through the complex of rules, procedures and institutions has recently been considered a cornerstone of the concept of good public governance. Managing officers, by their own example, should promote the integrity and ethical behavior of civil officials in everyday work. In principle, ethical consciousness is the common responsibility of all members of the organization, so they should take part in the development of special codes of conduct, such as managing civil officials and all other interested officials, regardless of the hierarchy represented in the organization. PROCJENA UTJECAJA PROPISA KAO INSTRUMENT BOLJE REGULATIVE U INSTITUCIJAMA BOSNE I HERCEGOVINE

(Regulatory) Impact assessment is a key segment of the so-called Better Regulation Agenda in the European Union and serves as a tool for designing and evaluating EU policies and regulations in a way that they achieve their goals in the most efficient and effective manner possible. Better regulation should ensure an open and transparent decision-making process, citizens and key actors participation in the policy-making process, ensure that decisions and actions are based on evidence and understanding of their implications, and finally contribute to reducing or maintaining at the minimum level of legislative burden for companies, citizens and public administration in general. Bosnia and Herzegovina, as a country with a long-term strategic objective that is reflected in EU membership, must also meet certain conditions on its Euro-integration path, one of which is certainly the reform of public administration. One segment of public administration reform includes the area of policy creation and regulation. In this paper, the author will give a brief overview of the fundamental requirements of this reform area, outline the fundamental characteristics of the drafting of regulations in the institutions of Bosnia and Herzegovina, explain what constitutes an assessment of the impact of regulations, and how it intends to introduce this instrument into the process of drafting legislation in the institutions of Bosnia and Herzegovina. In the concluding considerations, the author will express his views on the need to improve the process of drafting regulations in the institutions of Bosnia and Herzegovina in terms of introducing tools and reaching standards advocated by the European Commission and SIGMA.

the place, importance and role of the basic unit or central resource, which is a public servant. Public administration is perceived through the work, activities and characteristics of the employed individual who, on the basis of clearly established and determined legal norms, performs the tasks and serves the needs of the ultimate user, the citizen. Therefore, the problem of the human resources management function in the public service is a central reform issue under SIGMA’s public administration principles for the enlargement countries. The establishment of a professional staff structure of public administration bodies, a clear horizontal and vertical scope, with the introduction of a merit system and a hybrid career system followed by the depolitization of the recruitment and selection process, nominally and factually guarantee minimum management standards in human resources management. Fragmentation of the legal system and the civil service in BiH points to the tendency and trend of differential reform processes at each of the administrative levels that jeopardize the uniformity of the public service in BiH. Global and theoretical models, European and other comparative experiences provide an adequate normative basis for future steps in the public service reform process. The basic issues of the civil service system, such as the notion of a civil servant, the horizontal and vertical scope of the public service, the payment system, the system of promotion, recruitment and selection, training in service, the grounds for termination of public service employment, represent the disputed differential base and the crucial de-harmonization in the civil service reforms at each level of governmentin BiH. The importance of internal organization, systematization of workplaces and working conditions as well as rules of good administrative behavior in the EU, are also a very important normative reform context for the credibility and dignity of the professional public service in BiH.

Public Sector Inter-Institutional Combinations – An Interdisciplinary Perspective

The purpose of this paper is to analyze the recent research literature regarding public sector inter-institutional combinations. Based upon a sample of 51 articles published in 2010-2013 in four databases (Science Direct, Springer Link, Wiley Online Library and Sage), this study summarizes and analyses the approaches found. In the light of an in-depth empirical research the article looks at the issues raised by the public sector inte-institutional combinations by grouping the sample using the following criteria: year of publication, research methodology, field, the mentioning of New Public Management(NPM) concept, theory and geographical area studied.The results reveal the fact that the predominant research methods used are: case study and statistical methods. The vast majority of papers analyze public institutions combinations of local public administration and investigate public sector combinations from Europe. Additionally, the majority of studies from the sample mention the concept of NPM and the institutional theory is mentioned in five articles.

This paper deals with Slovenian special tax on undeclared income and attempts to determine its legal nature by presenting and analysing the regulation. The author believes that this public levy is actually not a tax since it lacks the financial purpose that each tax should have, according to the jurisprudence of the Slovenian Constitutional Court. Since the rate at which the special tax on undeclared income is levied exceeds the tax rates applied on declared income, and therefore the taxpayer’s burden is higher, the author claims that the discussed tax is actually a mixture of compensation for the lost tax revenue and a legal sanction, with both deterrent and retributive (punitive) purpose, which is imposed on the taxpayer for not declaring the income.

The paper analyzes the presence of trade union organizations among civil servants in the state administration in the Republic of Serbia. The employees are organized in different ways in the admin istration, but the role and significance of trade union organization is very important for all democratic societies. There is a brief overview of the development of trade unionism and, in particular, the development of trade unionism on the territory of Serbia. This development was dynamic and in line with global trends, but with many specifics especially in the post-World War II period and after building of real socialism. Starting from the common political and legal past, the paper analyzes the role and significance of trade unions in the countries of the former SFR Yugoslavia. An overview is made of the legal framework that determines trade union organization and operation in the Republic of Serbia, primarily through working legislation in terms of defining basic concepts. A part of the paper examines and analyzes the presence of trade unions in the state administration of the Republic of Serbia i.e. in ministries, special organizations and government services. It also analyzes the place and role of representative trade unions in terms of collective bargaining and their share in making specific collective agreements that apply to civil servants in ministries, special organizations and government services. In addition to analyzing regulations and achieving the presence and role of trade unions, the work is based on research on the presence of trade unions in the state administration. There is one trade union in the Ministry of Foreign Affairs, there are two trade unions in the Ministry of Labor, 12 trade unions in the Ministry of Defense, one trade union in the Republic Institute of Statistics, three trade unions in the Republic Geodetic Authority, one trade union in the Intellectual Property Office. Of the analyzed bodies, 19 do not have trade unions and only 7 state bodies have registered trade unions. After considering and analyzing trade union organization in the state administration in the Republic of Serbia, we can conclude that, regardless of the significance of the trade unions and important role they have in the society, they failed to take place that belongs to them in the state administration, they are only formally present and they are far from an important role in social dialogue.

Dans ce travail l'auteur traite le rapport de l'homme au devant du pouvoir, è savoir son rapport vers la politique de personnel, surtout quand il est porteur de l'autorité du pouvoir. Ces rapports de l'homme et du pouvoir sont très différents, importants et intéressants en particulier lorsque beaucoup de critères de valeur sont troublés et surtout les critères moraux. C'est dans ces et telles situations des critères de valeur troublés qu'entrent sur la scène des groupes non formels ou les puissants individus qui abusent les institutions du pouvoir pour la réali¬sations de leur propres bues de personnels ou bien des buls au groupe nonror- mel. Outre cela, dans son travail, l'auteur traite la conduite des hommes dans les conditions d'une telle politique de personnel à savoir dans le temps de l'exe- cution de l'autorité du pouvoir, de la conduite des hommes de politique après leur descente de la scène politique. Dans telles situations les differénees dans leurs conduites sont diamétralement différentes. Qui doit avoir le rôle dominant dans la réalisation des affaires et des buts de la politique de personnel? L'auteur soulig¬ne, avec raison, que chez nous dans la direction et la réalisation des buts de la politique de personnel la Ligue des communistes avait le monopole sans égard à l'existante influence de la Ligue socialiste. Les pouvoirs dans la direction ae la politique de personnel, souligne l'auteur, doivent être tout petits ou nuls car la politique de personnel avant tout dans les conditions de notre système démo¬cratique, est une cathégorie socialisée. Outre cela, l'auteur traite la suite des autres problêmes et particulièrement si les cadres qui ne sont pas membres de la Partié communiste peuvent-être ou non à la position dominante politique ou d'affaires?L'auteur a activé de nombreuses questions du rapport de l'homme du pou-voir et de la politique personnel. A la plupart de ces questions il a donné les réponses et beaucoup û'entre eux sans doute feront réfléchir le lecteur.En vérité, ce sont les problèmes constants de chaque démocratie et de la nôtre aussi car le primat dans la direction de la politique de personnel signifie aussi le primat dans la réalisation de la fonction du pouvoir. D'où provient au¬ssi la tendance éternelle que des groupes nonformels, aussi de certains hommes d'autorité, de posséder l'influence dominante dans la direction de la politique de personnel. C'est pourquoi la démocratisation ae la politique de personnel est un problème de premier ordre de chaque société démocratique. Ce procès ne sera pas ni facile ni simple. Au contraire ce procès sera très difficile et contradictoire. Mais, sans égard à tout ça, chaque société démocratique peut compter sur son progrès seulement autant qu'elle réaliserait conséquemment l'idée sur la démocratisation de la politique de personnel.

La responsabilité de l'état dans le domain pour lequel ils sont fondés pré¬sente une fonction nouvelle des organes gestionnaires d,Etat établie par la Con¬stitution de 1974. Elle est très complexe et comprend presque toutes les affaires du cadre de la compétence des organes de gestion établi par la Constitution. Les organes de gestion sont responsables que pour l'exécution des affaires du cadre „des fonctions des gestion classiques" aussi pour l'exécution des affaires stud-analtiques et des autres affaires professionnelles.Dans son travail l'auteur fait l'analyse pour savoir de quelle manière et dans quelle mesure le organes communaux réalisent leurs fonctions de la res¬ponsabilité devant l'Assemblée de la Commune et devant son organe executif, et il fait l'analyse de la réalisation des droits et des dévoirs des organes de gestion par rapport aux autres organisations de travail associé et aux autres organes et communautés autogestionnaiires.L'auteur constate que la partie prépondérante de l'activité des organes communaux de gestion dans la réalisation de l'activité est dirigée vers l'Assembleé et son organ exécutif. Dans l'exécution des affaires analytiquo-professionne- lles pour l'Assemblée et son organe exécutif on engage la plus grande partie du temps de travail des cadres professionnelles et créatifs, ce que rend qu'on ne peut pas être content par l'état de la réalisation des ordonnances et de la poli¬tique fixée et on pose la question de la reexamination des affaires mises à la compétence des organes communaux de gestion c'est-à-dire de leur qualification de cadre et matérielle.On n'est pas content aussi de l'état dans la réalisation des droits et des devoirs des organes de gestion contre les autres sujets autogestionnaires, car certains d'eux ne sont que partiellement ou même point réalisés. C'est encore toujours que la gestion se présente comme l'organe du pouvoir au-dessus de ses sujets autogestionnaires, au lieu de, comme un service professionnel, coïabore avec eux à la réalisation commune des buts établis par la société.129À la fin de son travail l'auteur (traite sur l'activité des organes communaux de gestion à l'élaboration des projets des ordonnances et des autres actes géné¬raux arrêtés par l'Assemblée et sur les plus importantes questions et problèmes liés à l'execution de ces affaires.

Les lacunes de droit dans l'ordonnancement autogestionnel des rapports dans le travail associé existent lorsqu'un rapport déterminé qui doit être ordon¬nancé d'une manière autogestionnelle n'est pas ordonnancé par aucun acte autogestionnel général de cette organisation ou communauté autogestionnelle. Envisagée d'un point de vue formelijuridique, cette lacune consiste dans le fait qu'un rapport social-économique donné et un autre rapport autogestionnel n'est pas ordonnancé par l'acte autogestionnel général adéquat bden qu'il y existait une telle obligation. Les conséquences de ce non-ordonnancement sont le défaut de .la base autogestionnelle juridique générale, en raison de quoi la réalisation de ce rapport et la décision des cas particuliers de son cadre est rendue juridiquement impossible. Chaque lacune de droit dans l'ordonnancement autogestionnel des rappo¬rts dans le travail associé demande à être écartée d'une façon adéquate de sorte que le rapport autogestionnel donné ou bien une question de ce rapport soit ordonnancé par acte autogestionnel général adéquat de cette organisation du travail associé. Ce but peut être atteint moyennant l'adoption de Pacte autogestionnel général qui fait défaut ou bien moyennant le complètement de Vacte autogestionnel général existant eu égard à la question qui n'a . pas été ordonnancée jusqu'alors. Si la lacune de droit n'est pas comblée de la sorte, alors. les cas particuliers appartenant au rapport qui se trouve dans la lacune de droit sont résolus par l'application des moyens juridiques adéquats, de droit sont résolus par l'application des moyens juridiques adéquats.

THE OBJECTIVE OF STUDY WAS TO EXAMINE THE ACCESSIBILITY OF THESE RURAL PUBLIC INFRASTRUCTURES IN RURAL AREAS AND THEIR POSITIVE INFLUENCE ON RURAL PEOPLE’S FOOD SECURITY. THIS STUDY BORROWED THE PRAGMATIST RESEARCH PHILOSOPHY THAT ADVOCATES ONTOLOGICAL AND EPISTEMOLOGICAL MIXES IN AN EFFORT TO MINIMIZE THE GAPS NOTED ON THE EMPIRICAL KNOWLEDGE. ACCORDINGLY; QUANTITATIVE AND QUALITATIVE APPROACHES WERE EMPLOYED. DATA ANALYSIS HAS FOLLOWED A CONVERGENT DESIGN THAT COMBINED DESCRIPTIVE AND INFERENTIAL TECHNIQUES WITH THE THEMES EMERGING THROUGH QUALITATIVE DATA. CONSEQUENTLY; THE FINDINGS OF THE RESEARCH REVEALED THAT PUBLIC INFRASTRUCTURES HAVE A SIGNIFICANT ASSOCIATION RURAL PEOPLE FOOD SECURITY. CHALLENGES IN RECRUITMENT AND SELECTION OF THE POLICE OFFICERS IN MONTENEGRO

The objective of the paper is to analyse the legal framework and challenges in the recruitment and selection of the police officers in Montenegro. In the first section of the paper the author examines the international standards regarding recruitment and selection of the public sector employees, including the police officers, which serve as a benchmark for assessing the respective Montenegrin legal framework and its implementation. In the second part of the paper, the author analyses the relevant provisions of the Law on Internal Affairs and the Civil Service Law which refer to the recruitment and selection of the police officers. The author concludes that the current legal framework is not fully aligned with the international standards, especially since it prescribes the exceptions to carrying out of the public competition. Current challenges in the recruitment and selection process result in the low level of confidence of the public in its fairness. For these reasons, it is necessary to undertake measures to increase the merit in the recruitment and selection of the police officers and reduce secrecy and patronage.

The reforms that have been implemented in entire public administration and public sector in Great Britain represent continuous action of several British governments in last four decades, regardless of their ideological differences. This leads us to conclude that all these governments have had certain motifs which governed them to exercise reforms of public sector in a systematic and continuous way regardless of their ideological differences and distinct conceptual approaches towards certain social issues. These motifs, which can be discerned at first sight, are the consequence of the globalization process which is connected to continuous, more – less explicit global recession and desire to maintain competitiveness of national economy in unstable global macroeconomic environment , even at the expense of decreasing the public sector. From that point of view, any government, left or right, did not have much room for manoeuvre, but had to attempt to get as much as possible from rather unfavourable and turbulent circumstances. The models of new public management in USA and Canada lack comprehensive reform programs, such as those existing in Great Britain and New Zealand. All major factors supporting radical reforms did not form a constellation in USA and Canada: economic pressure, commit ment of top management and clear ideology. Key factor in Canadian reform was the economic pressure, while in USA it was the dedication of political leaders, such as Al Gore. Despite different causal factors and different political systems, the reform programs in Canada and USA have certain similarities – the importance to carry them according to bottom up approach and the efforts invested by local governments. Also, the efforts of middle level line managers should be commended since their ideas and suggestions have largely contributed to inventive pograms. The influence of ideas coming from private sector such as quality of services, total quality management and reconstruction of business processes has had a significant impact, as well as the significance of intiatives aimed at improving the quality of services and introducing of performance indicators and objectives. Finally, assigning the leading role to information technologies was a key to success – these two countries are the leaders in revolutionizing information technology and using of alternative mechanisms of service offering (instead of offering larger structural reforms of public administration). These alternative mechanisms surpass the boundaries between ministries and administration levels and assume partnerships between partners from private and non-profit sector.

The concept of an EU citizen has developed over the years with not just economic, right to reside in other Member States but also rights in the democratic processes. The processes of decision making, passing legislation and legal proceedings are proceeded between the institutions of the European Union, that function according to the powers assigned to them. The opportunity to influence decisions for an EU citizen arises from three ways of participation that have developed in the provisions of the treaties. The EU citizens can affect the democratic process through their national elections, in the elections of the European Parliament and by proceeding a merited legal claim to the Court of Justice of the European Union. The author analyzes official information along with journal writings to introduce the aspects of the topic. The author analyzes the relevant developments in the treaties that create the current legal rights of the EU citizen. The author covers the EU organizations relevant for the paper, their composition and their functioning in the Union. Also, the author analyzes features and mechanisms that take place in the democratic process along with the democratic deficit.

The notion of the social services is with us of a recent date. Before this notion there was a notion of'public service, which originated in the French law. As to the positive legislation, the social services acquired a narrower meaning than that of the former public service. The social services are constituted by some general social service activities which satisfy not only the meeds of an individual beneficiary, but also the general needs of the society. Therefore, in such activities the interest of the social community is more intensive, so that, in consideration, too, of the process of decaying of the state and law, these activities must be exercised through a system of social self government. The organizational forms through which the social services are exercised may be different, but, in the actual degree of social development, institutions are the most characteristic and the most frequent forms. But, regardless of the organizational form, the essential is, owing to the withering of the state and the law, in the relation between the state organs and those organizational forms, how much the affairs are transferred from the state agencies to those forms, and how much they have become autonomous and separated from the state apparatus. In the process of the transfer of powers from the state organs the most essential are the following: a) the powers' necessary for the practising of a professional activity; b) the powers concerning the management; c) the powers concerning the organization of the activity; d) the powers of a property law character; e) the powers of a financial nature; f) the powers concerning the exercice of the internal control; g) the powers concerning the regulation of the internal and labour relations, and, h) the powers concerning the promulgation of acts. Nevertheless, in the process of the transfer of affairs, decaying of the state and the law, the state is witholding some functions: the regulation and the control of some determined relations. As a matter of course, owing to the fact that the process of decaying of the state is a general process and that the social self- government has become with us a basis of the entire socio-political system, so that the state organs themselves and the law are losing their classical character. The state organs are becoming also the' organs of the social self-government and along with the law are appearing also the socio-political norms. Along with the legal and state control we have a social, political control. The great number of socio-political norms, promulgated by organs and by organizations in the province of social services, on one side, and the necessity of securing the unity of the community in the actual degre of development, on the other side, require the creation of a determined social legality and constitutionality of these norms. But, all the principles and the premises in the process of withering of the state and the law in general, as well as in the province of social services, require not only organizational forms, mechanisms and means, but also a daily practice of the men, their thought and their social consciousness.
