This paper presents an alternative analysis of implementation of the Agreement reached in Brussels in April 2013 between the Prime Ministers of Serbia and Kosovo. A key part of the Agreement explicitly stated that local Serbian Ministry of Internal Affairs (MUP) units would be disbanded and integrated into the Kosovo Police (KP). The Brussels Agreement also set an obligation to establish a KP Regional Command North, mandated to cover the four northern municipalities with a Serbian majority. // The findings of this analysis show that by the end of March 2014, 285 former MUP employees had started the integration process. This marked a significant step forward in implementing the Agreement. There were uncertainties and challenges regarding the establishment of the KP Regional Command North, in particular whether the Command should include the four Serbian municipalities in the North alone, or South Mitrovica and Vushtrri / Vučitrn as well. In addition, there were disagreements on the appointment of the Head of the Command, a post currently occupied by acting head Nenad Djurić. Apart from these organizational issues, the main area of dispute concerned the vetting process, which faced criticism due to the limited time available for it and difficulties in applying the generic vetting cycle.

Vodič za procesuiranje krivičnih djela počinjenih iz mržnje u Bosni i Hercegovini

Inkriminacija krivičnih djela počinjenih iz mržnje predstavlja aktivnost karakterističnu za drugu polovinu dvadesetog vijeka, iako takva ponašanja imaju veoma dugu historiju. Ova djela, koja se zbog specifičnog utjecaja na žrtvu i zajednicu često smatraju teškim krivičnim djelima, dio su krivičnog zakonodavstva i u Bosni i Hercegovini. Prema rezultatima studije “Procesuiranje kaznenih djela počinjenih iz mržnje u Bosni i Hercegovini: perspektiva tužitelja”, ali i analize incidenata motiviranih predrasudama u Bosni i Hercegovini, procesuiranje ovih krivičnih djela predstavlja svojevrstan izazov praćen nizom poteškoća i problema. Prije svega, ovi izvori ukazuju na probleme koji otežavaju prepoznavanje krivičnih djela počinjenih iz mržnje: problem nedovoljne educiranosti osoblja u policiji i pravosudnim institucijama, izostanak sudske prakse vezane za ova krivična djela, kao i na poteškoće u svim fazama krivičnog postupka. Upravo ta realna situacija bila je i glavna inspiracija za izradu vodiča za procesuiranje krivičnih djela počinjenih iz mržnje u Bosni i Hercegovini. Prilikom izrade Vodiča pošli smo od pretpostavke da praktičari poznaju zakonske norme, te da Vodič stoga ne treba opterećivati temeljnom obradom važećih zakonskih propisa. Osnovna je namjera da se Vodičem ukaže na specifičnosti krivičnih djela počinjenih iz mržnje, te na potrebu za posebnim pristupom osoblja iz policijskih i pravosudnih organa prilikom istraživanja i procesuiranja spomenutih krivičnih djela. U Vodiču se, iz tih razloga, jasno određuje krivično djelo iz mržnje i ukazuje na načine njegove inkriminacije u Bosni i Hercegovini. Nakon toga prikazani su osnovni indikatori za prepoznavanje ovih krivičnih djela, a ukazano je i na potrebu za oprezom u radu sa tim indikatorima. Predočavanjem posljedica krivičnih djela počinjenih iz mržnje, te karakteristika počinitelja ovih djela, Vodičem se namjerava doprinijeti njihovom efikasnijem otkrivanju, istraživanju i procesuiranju, ali i efikasnom i efektivnom sankcioniranju njihovih počinitelja, odnosno ostvarenju svrhe kažnjavanja. U suprotstavljanju ovom obliku kriminaliteta u Bosni i Hercegovini policija i organi krivičnog gonjenja, kao ključni akteri, suočavaju se sa nizom problema koji proizlaze i iz neadekvatnosti važećih propisa vezanih za krivična djela izazivanja nacionalne, rasne i vjerske mržnje, razdora i netrpeljivosti (poput nedefiniranja pojmova “javnost”, “mržnja”, “razdor”, “netrpeljivost” i sl. ili problema vezanih za određivanje nadležnosti kada je riječ o procesuiranju ovih krivičnih djela), što svakako izaziva probleme u primjeni tih propisa. Ipak, u Vodiču se neće posvećivati posebna pažnja pitanjima vezanim za adekvatnost zakonskih rješenja s obzirom na to da se radi o Vodiču za praktičare, a ne za zakonodavca. Uvažavajući činjenicu da je Vodič primarno namijenjen praktičarima, metodologija izrade Vodiča prilagođena je njegovoj svrsi. Za izradu Vodiča korišteni su materijali koji su, sa istom svrhom, korišteni u državama sa dugogodišnjim iskustvom u suprotstavljanju krivičnim djelima počinjenim iz mržnje. Naravno, kako prenošenje iskustava iz jednog sistema u drugi zahtijeva i određene prilagodbe domaćem kontekstu, te radi nastojanja da se u Vodiču daju osnovne upute za rješavanje problema praktičara u Bosni i Hercegovini, za potrebe projekta formirana je radna grupa, koju su sačinjavali tužioci iz različitih tužilaštava u Bosni i Hercegovini. Članovi radne grupe, kontinuiranim konstruktivnim čitanjem i razmjenom mišljenja o korisnosti i primjenjivosti svake pojedine sekcije Vodiča u praksi procesuiranja krivičnih djela počinjenih iz mržnje u Bosni i Hercegovini, značajno su doprinijeli izradi ovog vodiča. Treba napomenuti da ovaj vodič nije mogao biti kreiran samo na osnovu oskudne prakse bosanskohercegovačkih pravosudnih organa u ovoj oblasti. Tako je prilikom kreiranja Vodiča napravljen osvrt i na iskustva policijskih i pravosudnih organa u zemljama regiona, drugim evropskim zemljama, ali i u zemljama van Evrope, koje imaju dugu i uspješnu praksu suprotstavljanja kriminalitetu počinjenom iz mržnje. Imajući u vidu da “uvoz” strategija iz drugih zemalja rijetko donosi prave rezultate, sve dobre prakse iz drugih sistema u ovom vodiču prilagođene su bosanskohercegovačkim okolnostima. Vodič ima i edukativnu i dimenziju podizanja svijesti, ali i ambiciju da ponudi određene praktične savjete profesionalcima koji se suočavaju sa ovim krivičnim djelima. Kao takav, ovaj vodič treba razumjeti prije svega kao prvi korak ka upoznavanju profesionalne zajednice u Bosni i Hercegovini sa ovom kompleksnom problematikom, a ne kao zaokruženi niz precizno utvrđenih koraka koji nužno vode uspješnom procesuiranju ovih krivičnih djela. Povećano otkrivanje i procesuiranje krivičnih djela počinjenih iz mržnje na području Bosne i Hercegovine svakako će donijeti nove uvide i saznanja, koji će uvjetovati potrebu za novim dokumentima ovog tipa.

The Canada-Poland Partnership Evolving Transatlantic Ties at a Strategic Crossroads for The Euro-Atlantic Community

Eight decades of relations have led to Canada and Poland forging a unique partnership that strengthens the transatlantic alliance and Euro-Atlantic community they both share. Since Poland’s peaceful transition away from the Soviet sphere of influence, bilateral relations continue to tighten as Canada broadens its political, economic, and military ties in Central and Eastern Europe - one of the European Union’s most dynamic and developing regions. Canada and Poland further bolstered their strategic partnership following Russia’s unprovoked war of aggression in Ukraine in February 2022, which poses risks to European stability, transatlantic security, and the rules-based international order that the two allies commonly value. Poland is now Canada’s go-to partner in Central and Eastern Europe, providing conditions for deeper collaboration in such key areas as defence, energy, economic development, and regional security. Canada and Poland work together politically to address pressing global challenges and crises by promoting shared like-minded positions with respect to the rules-based international order, democratic values, and free trade. They regularly support each other in various multilateral platforms like the North Atlantic Treaty Organization (NATO), the United Nations (UN), the Arctic Council, and others. Polish-Canadian relations have the potential for even more growth in the medium to long term. To exploit that potential, Canada and Poland must diversify the partnership’s “toolbox” with instruments recommended in this report to push each other towards closer bilateral and transatlantic cooperation. These recommendations include: Launching and developing a Canada-Poland Strategic Partnership Framework; Poland ratifying the Canada-European Union Comprehensive Economic and Trade Agreement (CETA); Canada publicly supporting the Three Seas Initiative (3SI); actively cooperating with 3SI members, especially Poland, in the energy sector (including natural gas, nuclear, and hydrogen) and deepening pan-domain security and military cooperation.

The UN Security Council adopted Resolution 1325 ‘Women, Peace and Security’ on October 31st, 2000. It is the first time that the UN Security Council advocates at such a high level the inclusion of women in peace processes and implementation of peace agreements. As for Serbia, ten years after the adoption of SC Resolution 1325 not only that state institutions did nothing in terms of implementation R1325, but they remained deaf on permanent and long-term efforts of civil society organisations to implement the Resolution. Women in Black, starting from 2005, have been demanding the implementation of SC Resolution 1325 and the adoption of Women in Black’s Resolution ‘Women, Peace and Security’, with the requirements specific for political context in Serbia. In fact, we had the support of dozens of civil society organisations, and also of several MP’s in the Parliament of Serbia. Unfortunately, our requests were not included in the agenda of the parliamentary sessions, which testifies to the extremely scarce democratic capacity and lack of political will of the current institutions in Serbia to acknowledge initiatives and efforts of autonomous civil society organisations in Serbia and of their failure to comply with international obligations. Out of very pragmatic reasons of adoption of international documents, in early 2010, the institutions of the Serbian state began the drafting process of NAP for the implementation of Resolution 1325. Activists around the world have been giving us early warnings of the danger of bureaucratization of R1325 by States, even by some NGOs; that happened in Serbia - Resolution 1325 has been misused by the ruling elite and some NGOs, in order to achieve certain political goals. NAP drafting process testifies to the absence of autonomous civil society organisations from the process; it also testifies to the fact that the state representatives do not acknowledge lasting efforts and initiatives of civil society organisations to educate, promote, and lobby for the implementation of SC Resolution 1325 in Serbia. The whole drafting process of NAP in Serbia was non-transparent, undemocratic and non-inclusive, which is proven by the results of a research survey, prepared by Women in Black, along with other numerous activities, in order to commemorate the tenth anniversary of the SC R1325. Complete report about cited research survey shall be given later in this publication. The state of Serbia will adopt the NAP for the Implementation of the SC Resolution 1325 in order to meet yet another formal request by the international community and Women in Black will, with the support of related autonomous civil society organisations, monitor the implementation of the Resolution 1325 and will notify all relevant local and international institutions about the process.

In September 2022, EU DisinfoLab, with the support of Qurium, exposed a Russia-based influence operation network operating in Europe since at least May 2022. The campaign, dubbed “Doppelganger”, replicated and impersonated authentic media by spoofing domain names and creating content falsely attributed to reputable news websites. Despite Meta’s acknowledgement of the operation and legal prosecutions by affected media in France and Germany, recent findings from June 2023 confirm that the campaign is ongoing on multiple platforms, and even expanding. Public institutions such as ministries in France and Germany were recently impacted. In August 2023, Graphika’s latest investigation on the campaign and Meta’s Adversarial Threat Report Q2 2023 confirm that NATO has been a direct target of Doppelganger, in the context of last July’s Vilnius summit.

By ratifying the Convention for the Protection of Human Rights on July 12th 2002 BosniaHerzegovina has assumed responsibility that it will ensure the exercise of all human rights and fundamental freedoms regulated by the Convention and its protocols, for all individuals under its jurisdiction. This responsibility clearly implicates the protection of human rights for all individuals under its jurisdiction, regardless of the walks of life or organizational forms they belong to. It means that apart from human rights related to all individuals in BiH society, there are some areas which inherently do not allow for general realization and protection of human rights. Human rights pertaining to the members of armed forces fall within this category. On one hand, members of armed forces enjoy all rights and fundamental freedoms as granted by the European Convention, while, on the other hand, by the nature and requirements of their profession they inevitably experience numerous restrictions in terms of exercise of such human rights. It is only logical to assume that within the Armed Forces of Bosnia and Herzegovina, it will not be possible to exercise fully all human rights which are typically granted to those involved with the civilian sector, because of high level of subordination and centralization of such function. The delicacy of our task stems from the need to reconcile and harmonize human rights granted to all individuals with the obligatory restrictions immanent to the armed service. In accordance with the existing practice in modern European countries, the need arose to ensure the exercise of human rights for the individuals within that walk of life, at least inasmuch as it is feasible in such conditions, and, at the same time, without impeding normal functioning of the armed forces in terms of its defensive role. With this premise in mind, the objective of our research in Bosnia and Herzegovina is to examine the relationship between freedom of an individual member of the Armed Forces of Bosnia and Herzegovina and the need to successfully perform primary duties of the Armed Forces of Bosnia and Herzegovina. This task is especially delicate since, this is the first time that in Bosnia and Herzegovina, the concept of professional armed forces was introduced instead of former compulsory military service. This will give us the opportunity to use experience of developed democratic European countries which achieved certain results in this field and conducted research into relationship between armed forces and human rights of individual members of armed forces. It means that the project will mostly tackle the human rights fields which were subject to research in European countries, in order to pinpoint specific and characteristic aspects of our situation. Its most striking feature in this field is the fact that the armed forces are not mentioned specifically in the Constitution of Bosnia and Herzegovina (Annex 4 to the General Framework Agreement for Peace in Bosnia and Herzegovina), but in Annex 2 of the said Agreement. It is clear that future amendments to the Constitution will also regulate the constitutional status of the armed forces. Nevertheless, this research will be focused on the current state of affairs, regardless of the fact that the Dayton Agreement stipulated separate implementations for military and so-called civilian aspects of the Agreement, and that High Representative of the International Community is in charge of this field in accordance with Annex 10 of the Dayton Peace Agreement.

Over the past 14 years of police reform an opportunity has been missed to build a strong institutional framework for the work of the Ministry of the Interior. The consequence thereof is the unbalanced development of areas pivotal to police integrity. Thus, policing transparency has improved, and an Integrity Plan and Development Strategy have been adopted. However, police integrity is mostly influenced by politicisation and inappropriate management of human resources. The police force in Serbia is losing its operational independence and accountability due to the interests of political parties. The organisational unit responsible for the management of human resources is merely a technical body. In addition, effective planning of budget spending is not possible because in excess of 80% of the MoI budget is earmarked for wages. Finally, neither does the harmonised system of internal police control work that should simultaneously ensure that police act in accordance with the rules and to increase the police integrity. External policing oversight remains lax.

Zestawienie w tomie sfery technologii wojskowych i prowadzenia działań zbrojnych (wojna rosyjsko-ukraińska) ze sferą niewojskowych zasobów siły i obszarów rywalizacji - od info sfery, przez energię i klimat, po etykę, prawo międzynarodowe umożliwia porównanie, na ile w XXI wieku instrumenty pozamilitarne stają się równie efektywnymi jak środki militarne narzędziami w wyłanianiu nowych potęg. W warunkach systemu rozwoju nauki i badań w Polsce, zdeterminowanego przez klasyfikację dziedzin i dyscyplin, studia strategiczne rozwijają się niejako „w poprzek" zadekretowanego rozwiązania, poszukując nowatorskich koncepcji i formuł naukowych w interdyscyplinarnym podejściu do badań naukowych. Autorzy zbioru podeszli do kwestii tożsamości studiów stra­tegicznych z ostrożnością, czy też przezornością, mając świadomość wyzwań, które stoją przed przedstawicielami tej „interdyscypliny" w Polsce i na świecie. Nakreślone przez nich hory­zonty łączą fundamentalne i pierwotne w sensie ewolucji studiów strategicznych zagadnienia, jak technologia i wojna, prawo i etyka, energia i przemysł, z (względnie) nowymi obszarami, jak hybrydowość użycia siły (oraz groźby jej użycia), informacja (w ujęciu kognitywistycznym i cybernetycznym), klimat i środowisko naturalne. Z recenzji prof. dr. hab. Artura Gruszczaka Uniwersytet Jagielloński Zastosowana w tytule fraza (horyzonty) choć jest umowna, a nawet wręcz symboliczna, dobrze odzwierciedla złożoność i ewolucję studiów strategicznych oraz towarzyszącą temu dynamikę stosunków międzynarodowych, co zaobserwować można obecnie choćby w kontekście wojny w Ukrainie, eskalacji napięcia wokół Tajwanu, konfliktu w Sudanie i wielu innych kwestii. Praca w sposób znaczący poszerza oraz systematyzuje naszą wiedzę dotyczącą wybranych aspektów studiów strategicznych, w tym przede wszystkim zaprezentowanych „miękkich" oraz „twar­dych" determinantów. The analytical report is devoted to the issues of forming an effective public-private partnership on cyber security issues. Theoretical approaches to public-private partnership and their peculiarities in cyber security issues are analyzed. The world experience (USA, EU, Germany, Great Britain, Poland) in building trust between the public and private sectors in cyberspace security issues has been studied. The regulatory, legal and organizational foundations of public-private partnership in Ukraine are considered, and effective examples of such partnership are given. Prospective directions for the development of cyber security public-private partnership in Ukraine and possible ways of their implementation are outlined.
