Considerations on the fixed-term employment contract as established by Law No.40/2011 completing and amending the Law no.53/2003 – the Labor Code. In the framework of the recent discussions regarding the alteration of the Labor Code – Law No.53/2003, with further alterations and completions, it is intended to alter the legal regime peculiar to the fixed-term employment contract. These modifications are primarily caused by the necessity, brought to light by the practice, to make labor relationships more flexible, especially to the employers’ interest. With the aim of meeting the needs shown within practice, the alterations and completions of the Labor code in this field regard: the extension of the situations in which the conclusion of fixed-term employment contracts is allowed, the increase of the term for which such contracts may be concluded, as well as the elimination of certain duties that the employers have in relation to the employees that have concluded such contracts. The herein study aims at analyzing the new aspects brought to the Labor Code in respect to the the fixed-term employment contract, as well as some considerations of comparative law on this matter.

Each Member State is responsible for the implementation of EU law (adoption of implementing measures before a specified deadline, conformity and correct application) within its own legal system. The infringement procedure is one of the enforcement mechanisms that can be applied by the Commission against a Member State whenever the Commission is of the opinion that the Member State is in breach of its obligations under EU law. Is a procedure with which the European Commission fulfils one of its most fundamental duties, that is supervision of the implementation of the acquis. The infringement procedure can be initiated ex officio, following a proposal from a Member State or from a person reporting the infringement, be it a legal or a natural person.

During the past 5 years, the Romanian film industry, as European film, has gained recognition in Cannes, Berlin, and, as paradoxically as it may sound, even in Romania. Nowadays, the world’s 7th Art has generated a business empire that cannot be conceived in the absence of a well-established legislative framework. The international tendency in law consultancy is to provide adequate guidelines for all stakeholders involved in the film-making business. As a premiere for Romania, this paper, the first in a trilogy that tackles Romanian Copyright and Neighbouring Rights in Cinema, specifically addresses the legal status of the cinematographic creation under Romanian Law no.8/1996, namely the issue of the rights and obligations a film product generates for all individuals involved in the creative process: the director, the screenplay author, the actors etc. This article analyses the understanding of the notion of authorship under Romanian Law by comparison with the provisions of the Berne Convention and those of the European Directive 2001/29/EC on the Harmonisation of Certain Aspects of Copyright and Related Rights in the Information Society.

Smoking is affecting global population, causing different cardiovascular disease, respiratory disease, cancer, asthma and kidney problems. Although it can be prevented, smoking is one of the major causes of death all over the world. Smoking is a social activity that depending on the context may have different meanings for smokers even if they are aware of the risks they are exposed. Smokers may use different methods of intervention to help them get rid of nicotine addiction. One method is referring to the cue exposure therapy performed using virtual reality. Virtual reality is a new technology used in the treatment of nicotine addiction that involves immersing smokers in environments with specific stimuli in order to reduce the level of craving. This article aims to present the main environments that cause smokers from Romania to feel a greater desire to smoke compared to other environments. Identification of specific stimuli in front of which smokers experience a higher level of craving is the first important step in designing interventions that are based on cue exposure therapy through virtual reality.

In view of the UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions autochthonous elements of identity design fall in the category of cultural goods. IA – the Romanian Blouse is such an element.This paper proposes the design and implementation of a protection system dedicated to safeguarding and promoting o the Romanian Blouse through mechanisms that ensure authenticity, encourage creativity and innovation with respect of national identity, and translate economically the cultural value of tradition.The discussion is placed in the field of public international law and calls for the development of cultural intellectual property, as an individual branch of law, within the Romanian legal system.In supporting the development of a dedicated legal protection mechanism for this Romanian element of ancestral fashion, the paper show-cases the recurrent violations of cultural intellectual property law in today’s society and draws attention to possible legal solutions for eliminating such behaviours. Finally, the paper calls for the design and implementation of a sui-generis form of intellectual property protection of the Romanian Blouse as a cultural good, pertaining to the field of cultural intellectual property. In this endeavour of legal design one should follow a similar logic to that of the right to self-determination. This entire system should be built as a mechanism of intellectual property protection, granting its collective holder a cultural intellectual property right susceptible of monetization, as well as all prerogatives specific to intellectual property rights in general.This paper should be regarded as an introduction in the complex issue of the legal protection of the Romanian Blouse.

Marie de France’s Eliduc – A Repentant Sinner. Guildeluec’s Cultural Memory as a Means of Spiritual Progress

In this article I want to discuss the importance of cultural memory within the plot of one of the lais written by Marie de France and to show that the character who is the “custodian” of cultural memory is also the one who can solve the crisis brought about by the other characters’ alienation from traditions. I will argue that this cultural background is the Christian tradition, which is completed by, and not opposed to, some pre-Christian (profoundly natural, rather than super-natural) knowledge, which precedes the cultural one. I will use Jan Assmann’s theory on cultural memory, in order to identify the elements of the cultural background which is defining for Eliduc, the longest lai written by Marie de France. Discussing the issue of cultural memory in this lai is relevant, as the scholar can identify the source of Guildeluec’s superiority, namely her position of guardian of cultural memory. The elements of the cultural memory: Christian principles, Celtic heritage and popular knowledge, work harmoniously to bring about the spiritual progress of all the characters.

This essay combines close reading and contemporary cultural theories, in order to explore several figurative patterns in which individual and collective identity are shaped in contemporary Caribbean British poetry. In the context of the post-war multicultural Great Britain and of the transatlantic cultural traffic connected with the Caribbean, the poetic discourse has become a site of cultural negotiation and visionary expression. It will be shown that none of the values associated with multiculturalism, transculturalism or cosmopolitanism are taken as fixed, but they are rather options and positions on the continuum global-local, as well as facets of an emerging complex cultural reality. The authors included in the present analysis – three Guyanese poets, David Dabydeen, Grace Nichols and John Agard, and the Barbadian Dorothea Smartt – display a great awareness of contemporary cultural change, best rendered using a culturally hybrid poetic language.

The broadening of the geographical frontiers of the European Union brings new opportunities, the number of the foreign investors in Romania is higher every day, the country’s relationship with other European countries, and not only with them, are more and more developed. Thus, we can assume that the professionals (irrespective of the domain) with a higher education degree wish to have access to highly qualified jobs, which means they have to meet not only the technical professional requirements but also the collateral ones, like the access to specialized information in a foreign language. To have access to this type of information, the technical student needs to get familiarized with the specialized vocabulary and its particularities which can be acquired only within an academic environment with specialized teachers. It is the goal of this article to present a few criteria of choosing/developing teaching materials for ESP based on the author’s experience.

This research was aimed to test the effectiveness of AR-based digital learning materials in improving the learning of the students. The development method used in this research is the ADDIE (Analysis, Design, Development or Production, Implementation or Delivery, and Evaluation) model. The subjects in this developmental research are the lecturers of the educational technology department as media experts, the lecturers of the nonformal education department as the subject expert, and the students of the nonformal education department of the academic year 2018 as the users. The specification of the innovative product to be developed is augmented reality as a digital media in learning the family education subject. The result of the research that AR-based digital learning materials have gained excellent results as it has proven to help students in learning effectively. The average score in the experimental group after participating in learning with Augmented Reality media, the average score was improved to 92,55. Whilst in the control group, the average learning with the old/conventional paradigm, the average score recorded at 86,75

The idea of writing an article on how to send a message from one language to another in interpreting dialogues primarily based on technical content came to us in the national context of accreditations of doctoral schools at the level of universities in ourcountry. Our personal interest in exploring the realm of simultaneous interpretations which, in all honesty, we considered a real challenge for our everyday profession as teachers, has led us into this attempt of defining the mission of the translator – obviously different from that of a language teacher – and the difficulties that may arise in simultaneous interpretations as compared to the written ones. The present paper is far from being an exhaustive research of the difficult mission that an interpreter has, moreover that the degree of difficulty should be judged according to the discourse genre, but it aims to shed light on those aspects or strategies that could help the translator prepare for this mission, especially when it is about a rare attempt of this kind, as our case was.

Spider-Man, as one of the most famous and popular comic superheroes, has been adapted into digital games since the early 1980s. Recent movies about (or including) Spider-Man paid even more attention to this superhero, making him an eventual centre in the further development of pop-cultural artefacts. The study analyses digital-game adaptations of Spider-Man in order to reflect current and upcoming trends within media set by popular culture, including the impact of license rights ownership and the forthcoming plan of the Marvel Cinematic Universe. The study focuses particularly on aspects concerning the cross- and transmedia storytelling and in-game advertising, or rather its absence, in Marvel’s Spider-Man digital games as possible indicators of these trends, while applying the gaming platform to analysis as an additional factor.

Mind-changing Perspectives on Education: A Content Analysis of Young People’s Storytelling-based Interviews

This article is based on the results obtained in our research activity carried out in the framework of the project Mind changers: Regions and Youth for Planet and People, funded through the European Commission's Development Education and Awareness Raising Programme (DEAR). The overall aim of the article is linked to the project’s main objective: to increase young people’s engagement in actions for change with regard to the Sustainable Development Goals (SDGs) at regional level. Taking into consideration that youth active participation and youth empowerment have become much-debated topics nowadays, it is important to identify the elements that could stimulate or hinder it in community activities at regional level. To this aim, we conducted an interview-based kind of research with young people from Dolj County, based on their high level of active engagement. The participants were identified with the help of the representatives of regional civil society organisations (CSOs) they work or collaborate with. The text corpus of the interviews resulted after transcription and translation into English was analysed using open coding (Straussand Corbin, 1990: 69; Creswell, 2015: 429; Cohen et al. 2018: 671) and content analysis to delimit elements that could later be used in educating young mind changers. We grouped the codes under different categories and only discussed the category related to ‘education’ in this article, with the aim to find out how education could encourage and contribute to youth engagement.
