Copyright and Related Rights over the Cinematographic Work: the Transmission of Copyright over the Cinematographic Work

Dreptul de autor și drepturile conexe asupra operei cinemato¬grafice: transmiterea drepturilor de autor asupra operei cinematografice

Author(s): Monica Florina Bota Moisin / Language(s): Romanian / Issue: 3/2014

Keywords: patrimonial cinema rights’ assignment presumption; cinema production agreement; work for hire; non-assignable moral cinema rights; EU Directive on orphan works; permitted use of orphan works

Last in a trilogy that tackles Romanian Copyright and Neighbouring Rights in Cinema, this paper specifically addresses the transmission of rights generated by cinematographic creations. The Romanian Copyright Law provides for a presumption of assignment of all patrimonial rights related to a cinematographic product in favour of the film producer. As for the moral cinema rights, typically for this category of rights recognised by the continental legal system, they are inalienable, non-assignable and perpetual. Under such circumstances, how can the co-existence of moral and patrimonial rights over the same cinematographic creation be balanced as to ensure an equitable status for all stakeholders? And what happens with a film whose producer cannot be identified and for which no entity claims any authorship rights thereof?

Observations concerning research made in 2008-2009, 2011-2012 in bronze age necropolis from Cârlomănesti

Observatii preliminare privind cercetările efectuate în anii 2008-2009, 2011-2012 la cimitirul din epoca bronzului de la Cârlomănesti

Author(s): Ion Motzoi - Chicideanu,Monica Sandor - Chicideanu,Mihai I Constantinescu / Language(s): Romanian / Issue: 17/2012

Keywords: cemetery; funeral inventory; Bronze Age; Monteoru culture

The excavations on the bronze age cemetery from Cârlomăneşti, county Buzău, are not yet finished. Here are presented the principal observations from the 2008-2009 and 2011-2012. Till now were discovered 68 graves with 91 skeletons, some tombs had been collective. The funerary zone is now on the most part superposed by villagers' houses. In any case the cemetery is a large one and could be related to a corresponding settlement which it's not yet identified in the field. It's easy to observe a remarkably variety concerning the funeral structures which include stone small barrows in and over the tombs and, in the same, time catacomb graves. This catacomb tombs could be put in relations with the Katakombnaja and Mnogovalikovaja eastern cultures. The most part of the skeletons are disposed in scorched positions on the left side. The predominant skeletons orientations are in sector W-SW. The anthropological analyse is not yet finished so we cannot yet make a relations between the sex groups and the positions of the bodies. The ceramic inventory is uniform in majority belonging to the so called „Ic3 stile”, the most frequent pottery types been the askos, kantharos and cups. Some metal adornments show relations with Central Europe, with Periam-Pecica or Aunjetitz cultures. Till now we have only one 14C datation for the Grave no. 24 in the time interval 2030- 1870 BC.

Community and Communion in the Quest of the Holy Grail

Community and Communion in the Quest of the Holy Grail

Author(s): Monica Ruset Oancă / Language(s): English / Issue: 2/2015

Keywords: medieval;13th-century literature;Arthurian literature;Holy Liturgy;Christian community

In this article the author intends to analyze to what extent the Holy Grail, which may be regarded as a symbol for the Holy Communion, can be considered the basis for creating and preserving a community in the Quest of the Holy Grail (La Queste del Saint Graal), as rendered in the Vulgate Cycle. One starting point is to identify the elements which determine and define a community, and the author tries to apply these characteristics to the gatherings presented in the Queste. There are several moments when the Holy Grail appears in front of a group of people, and it affects those assemblies in different ways. Starting from the well-known fact that a Christian community is created around the Holy Communion, or the Holy Eucharist, celebrated with the Holy Chalice, it is to be expected that the Holy Grail, used in a similar situation, also gathers a community of knights around it and elevates them spiritually. However, the author will show that these expectations are not achieved, as neither the Quest, nor the mystical Grail, can establish a community. The text of the Queste does not introduce any sort of community either terrestrial or celestial, which could include most of the knights involved in the Quest.

The elements of the didactic communication process – a theoretical presentation

The elements of the didactic communication process – a theoretical presentation

Author(s): Monica PATRUT / Language(s): English / Issue: 25/2020

Keywords: didactic communication; communicative competence; pedagogical message; feedback; educational communication;

This article represents a theoretical approach to the elements of the didactic communication process. Our theoretical plea will open with the distinction between educational communication and didactic communication. Then, following the line of analysis drawn by the classical theories of communication, we will present some interdisciplinary approaches to the elements of the didactic communication process: the teacher and the student in their double capacity of transmitters and receivers, the pedagogical message transmitted in the traditional or virtual classroom, the feedback and the specific features of the context of this type of communication. Our theoretical analysis restates the need for analysis and understanding of didactic communication by all actors involved, considering that the quality of didactic communication directly influences the quality of teaching – learning – evaluation in the educational system.

St. Augustine’s Personal Experience of Marriage and Family and his Influence on the Theology of Marriage

St. Augustine’s Personal Experience of Marriage and Family and his Influence on the Theology of Marriage

St. Augustine’s Personal Experience of Marriage and Family and his Influence on the Theology of Marriage

Author(s): Mieczysław Ozorowski / Language(s): English / Issue: 1/2020

Keywords: St. Augustine; marriage; family; concubinage; sexuality

This study presents St. Augustine’s personal experiences related to marriage and family that eventually influenced his views on these topics. Augustine of Hippo is considered one of the greatest theologians of the ancient Christian world. Although he was unmarried, he was born into a Christian family and experienced what it was like to live with a woman in a quasi-married state before he converted to Catholicism. Augustine left behind a large body of writings dedicated to the topics of marriage and family. Even though these works do not constitute a coherent treaty on marriage and family, they do shed light on these issues. They also reflect the current and pressing problems that affected not only St. Augustine but also the people of his time. St. Augustine’s views on marriage and family have had an immense influence on the entire Latin Church’s position on these issues. In this regard, the primary source that contains a lot of biographical information is Augustine’s Confessions. This study is made up of two parts. Part I describes Augustine’s childhood experiences and family life. Part II describes youth and his experience living with a female concubine. This original study presents the sources of St. Augustine’s views on human sexuality and his relationship with his family.
