Summary/Abstract: Climate change is one of the biggest global challenges. The world is already facing many problems caused by climate change, and predictions are that there will certainly be more of them in the coming decades. The problem of climate change can be approached from different perspectives. It is necessary to consider measures that can contribute to reducing the occurrence of climate change, but it is also necessary to consider the possibility of adaptation to changed climatic conditions. The challenges of climate change can be considered from the point of view of different scientific disciplines. In this thematic collection, the problem and challenges of climate change are approached from the perspective of law, economics and sociology.

- Summary/Abstract:The first part of the paper points out the key elements of the „principle of common but differentiated responsibility and appropriate opportunities“ (CBDR). It discusses the evolution of the understanding of the content of the principle and the need to respect the general circumstances, goals, and obligations prescribed by the Paris Agreement (PA) and other relevant international agreements. The significance of the PA is seen through the fact that it introduces a new (‘bottom up’) approach to tackling climate change. The second part of the paper discusses the issue of criteria for defining the content and application of the CBDR. The norms of the PA and other international agreements that explicitly refer to the differentiated position of developing countries are particularly considered. The possibility (and need) of differentiating the contracting parties on the basis of more precise criteria such as the capacity of contracting parties, vulnerability, contribution to climate change (historical, and present), and commitments to reduce GHG emissions is pointed out, etc. Relevant data for Serbia and neighboring countries are overviewed. The aim of the paper is to examine the meaning and scope of the principle of common but differentiated responsibility. The thesis is considered that the PA, regardless of the new approach to the GHG emission reduction, has not made progress in the operationalization of CBDR. Basically, the general and (and incomplete) differentiation of the contracting parties has been maintained through the definition of specific obligations and rights of developing countries. In conclusion, it is stated that the CBDR has its solid foundation in the nature of the problem of climate change, but that the issue of differentiated responsibilities of the contracting parties is still open.

- Summary/Abstract:The Republic of Serbia has ratified climate change related international agreements adopted hitherto within the United Nations. Aside of that, climate change issues are of the considerable importance in the EU accession process, whereas the Paris Agreement is to be considered as the utmost multilateral framework for dealing with the climate change. The EU is dedicated to providing support to its neighbourhood, as the transformation of the EU may be fully effective only if the closest neighbourhood undertakes effective actions regarding mitigation of climate risks and environmental protection. This being said, it should be mentioned that the leaders of the Western Balkans countries have confirmed on several occasions their commitment towards implementation of actions within the Green Agenda. The Chapter 27 in negotiation of the accession of Serbia to the EU is entitled Environment and Climate Change and it was officially opened for negotiations on the Thirteenth meeting of the Accession Conference with Serbia at Ministerial level held in Brussels on 14th of December 2021. Nevertheless, until finalization of this paper there has been no information if the negotiating has practically begun. Although Serbia has not accepted the targeted decarbonisation through the coal phase down as envisaged at COP26 held in Glasgow, through international agreements and agreements reached within the EU accession process Serbia has accepted many obligations. Therefore, it is reasonable to say that Serbia needs to direct activities towards implementation of the already accepted obligations whereas it is necessary to define steps and priorities in professional and responsible manner. As a result of the analysis, this paper states key obligations to be implemented.

- Summary/Abstract:The best way to stimulate beneficial human behaviour is through an economic approach. It encourages innovation and implies that the “Polluter Pays” principle is applied in internal systems as well as at the global level. The biggest challenge of the official project of global climate policy is the goal of keeping the increase in the average temperature of the Earth at values lower than 1.5 degrees Celsius, compared to the pre-industrial era. The estimated concentration of carbon dioxide in the atmosphere should not be above 400 ppm (although this level was exceeded in 2015). It is considered important to lower this concentration to 350 ppm. Climate changes at the present moment in Serbia are more visible in relation to their average global effect. Facing our climate future may be leading us to new structural crises. The current energy crisis marks a large part of the global economy. Together with the still current covid-crisis and wrong monetary and fiscal measures, the climate policy could contribute to an even greater imbalance of supply and demand. The world today is not safe, both in terms of energy, and also in the economic, military-political and social terms. All risks have increased during the last three years. But the covid recession and the energy crisis have highlighted the contradictions between the exploitation of natural resources and sustainability. The world will not easily get out of the existing structural difficulties and their developmental consequences. The good news is that climate unknowns and risks today have an increasing influence on the formation of culture, especially the young and teenage generation (Greta Thunberg) as well as believers and religious authorities around the world (Pope Francis).

- Summary/Abstract:In recent years the Republic of Serbia has made a certain progress in developing the legal and strategic framework in response to climate change. However, its effects on society has not been assessed so far. This article fills the gap. The first part of the article presents the ex-ante assessment of the planned public policies related to the energy sector and climate change. The second section presents the global and European context in which the international agreements related to climate changes have been shaped. The article concludes that the planned energy transition in Serbia will have more negative than positive effects on society due to the chosen model. Positive impacts are expected on adapting to local adverse weather conditions and removing the consequences from them, while the impact on the climate cannot be assessed. The policy options have the potential to negatively affect the living standards of citizens because the costs of the energy transition are planned to be transferred to consumers. The state’s energy dependence and indebtedness are also expected to increase as a result of huge investments in solar and wind power plants. Switching to these expensive energy sources will cause energy, food and other household costs to rise. The aim of the article is to emphasise the need for ex-ante assessment of the effects of regulatory and public policy options on society and to respect its findings when formulating final solutions. In addition, the paper stresses the need to understand the broader context in which Serbia’s energy transition is taking place. The key influence on the formation of international agreements in this area is held by the most powerful states and corporations, and therefore these agreements represent the interests of corporate globalism rather than the states of semi-periphery and periphery.

- Summary/Abstract:The right of public participation in the law-making process is guaranteed by international and domestic law. Involving the public in the law-making process contributes to strengthening both citizens’ trust in the legislature and enhancing its legitimacy, as well as to the quality of laws and their consistent application improvement. The Law on Climate Change in Serbia entered into force on March 31, 2021, consequently it is significant to perceive how the public participated in each phase of this legislative procedure, i.e. to conduct an analysis of obligations arising from international and domestic law and their application, in this particular case. The conducted analysis of public participation in the adoption of the Law on Climate Change indicates that both, the authorities and the public have made significant efforts in order to involve proposals and comments of citizens and their associations in the draft law, but also due to shortcomings of the available mechanisms, public participation in this legislative process was not effective.

- Summary/Abstract:The paper presents the necessity of legal and political changes as humane responses to migration caused by climate change. There is a globally developed awareness that not only political persecution and armed conflicts are the cause of migratory movements, but also the drastically threatened existence of the population of entire regions caused by climate change. There are more migrants in the world than ever before. Many of them have fled from a severely threatened existence due to climate change and the resulting increase in droughts, typhoons, floods, heat waves, desertification, sea level rise, and other extreme weather conditions. Climate changes are intensifying and are not a problem of the future, they are already here, and they affect all parts of the world, pointing to humanity’s responsibility for their occurrence. The COVID-19 pandemic and the armed conflict in Ukraine threaten a new possible departure from the agreement on climate change issues and the abandonment of what was agreed upon with great difficulty at the Paris, Glasgow, and Petersburg summits. The aim of the paper is to warn that climate change is not only behind frequent natural disasters, and the ruined and disabled economic activities of entire regions, but also behind the armed conflicts that break out in them. The circle of generating continuous waves of refugees is thus completed along the lines of climate change, natural disasters, wars, devastated (agricultural) economic activities, and threatened basic existence of the entire affected population. That is why migration management is one of the priorities and necessary humanitarian responses to climate change. The conclusion of the paper is the necessity of adopting new rights and new practices of inclusion, freedom, and equality, which will either reform existing social and political institutions or create new ones. It is necessary to develop knowledge of new practices, and above all, more global solidarity among people.

- Summary/Abstract:Climate change represents one of the biggest challenges that the world has been facing for several decades, and which will become more intense in the coming period. Agricultural production is a sector that is directly exposed to the impact of climate change, but also has a significant contribution to its occurrence. Research data indicate the worrying negative effects of climate change, which are reflected in the reduction of agricultural yields, the greater intensity of which is expected in the coming decades. The starting point of the research is the analysis of international documents in the field of climate change in search of answers to the questions of whether agricultural production is recognized as a significant contributing factor to climate change, a sector that is significantly exposed to the impact of climate change and that must be adapted to changes in climate conditions. Part of the paper is devoted to the analysis of the regulation of climate change issues within the Common Agricultural Policy of the European Union. Finally, the situation in the Republic of Serbia was analyzed. One of the questions that is in special focus is whether climate change is recognized in the regulations governing agricultural production in the Republic of Serbia.

- Summary/Abstract:The economic and social progress recorded during the last century has been achieved at the expense of the environment. Increasing consumption of natural resources is necessary to support economic activity. Inclusive green growth should reconcile the urgent need for intensive economic growth and poverty reduction in developing countries with the need to preserve the environment and prevent the occurrence of irreversible harmful environmental consequences and losses. The paper analyzes the movement of the global material footprint, as well as how economic development is reflected in the consumption of natural resources and what kind of pressure it creates on climate change. Climate finance will be defined and it will be pointed out that adapting and neutralizing the negative effects of climate change requires the mobilization of significant financial resources. The paper will present recommendations for strengthening the growth of green financing and define green financial instruments.

- Summary/Abstract:After a wave of indications on anthropogenic sources of climate change, a complicated encounter with a shifting landscape of the Earth sparked a cascade of political, legal and ethical issues. Inception of novel ecological sensibility, as a direct response to the predicament signalled by the robust concept of Anthropocene, have also hinted at necessity to rethink the normative frameworks in heterodox manner, in order to encounter with unpredictable climate scenarios, porous materiality and non-human entities. This paper explores exactly the possibility of non-human entities attaining legal subjectivity. Starting from a “diagnosis” of international law by Carl Schmitt and profound mythological roots of the nomos which enabled the precedence over land, this paper first depicts a crisis of normative framework to articulate climate-induced problems. As being emphasized in the second section, security responses to climate variability, such as erosive territoriality, territorial disputes, climate migration and (in)justice, largely remain anthropocentric. Thus, in the third section, the paper engages with recent debates which offer an innovative design for relations between species and consequently induce new principles of obligations, responsibilities and relationships, exceeding the narrow format of rights, sovereignty and political autonomy. Lastly, the paper explores the possibility of building a new “constitution”. “Parliament of things”, a concept proposed by Bruno Latour, in this regard presents an interesting speculation on the possibility to provide a legal status to non-human entities and present their political significance in an exterritorial manner.
