The state of human resources in public sector in Republic of Macedonia

In the Former Yugoslav Republic of Macedonia, in the last seventeen years, efforts have been made to build a professional, expert and primarily depoliticised public administration in accordance with European standards. Unfortunately, we have failed to reduce political influence on the 'meritocracy' system, especially in terms of new employments, as well as on the progress and assessment of civil servants. Also, the professional development of civil servants was hampered by formal and systemic training problems, and they are implemented ad hoc generally without any order. Because of this paradox, the position of the Human Resources Departments in the official system is very similar to traditional 'personnel departments'. The dilemma is whether the new legal solutions of 2015 (the Law on Public Sector Employees and the Law on Administrative Officers) will be an appropriate solution to the human resource management shortcomings of the past years and the citizens will finally receive a professional, expert and depolitical public service working for the interest of the citizens.

The supporters of the idea of introducing a term limit for Vogts and mayors argue that long-lasting incumbency leads, among other things, to atrophy of political involve-ment at the local level. The aim of the article is to validate the above-mentioned belief through checking how the duration of tenure of Vogts and mayors affects the voter turn-out and the number of candidates in the local elections.The study draws on the data from National Electoral Commission regarding the re-sults of and candidates in the local elections (2002, 2006, 2010 and 2014) in 317 Polish electoral districts.The statistical analysis reveals that time of incumbency can correlate negatively with po-litical engagement in some aspects, although these relationships are not very strong.

The aim of the article is to present and describe how to counteract threats to social security through sport. The theoretical method of analysis and criticism of the literature was used in the research work. The conducted research allowed to determine that mainly trainers and pedagogues play an important role in the prevention of risky behavior. The review of the literature allowed to conclude that the research work is based primarily on surveys and currently only a few researchers conduct research on combating social security threats through physical activity. In connection with the above, it is necessary to continue research in this direction, using such research methods as the individual case method.

Problem setting. A thorough scientific understanding of political activity in state bodies, and, accordingly, political service, is an actual scientific topic. It acquired particular significance in the context of the reform of public administration identified by the Strategy for 2016-2020.Recent research and publications analysis. Considerable attention of scientists from all over the world is paid to the study of the civil, political, public service, this topic is at the center of attention by V. Averyanov, L. Beloy-Tionova, K.-H. Cho, R. A. Cropf S. Kim,S. Kivalov, N. Kolisnichenko, O. Krupchan, J. G. McGann, T. Motrenko, K. Namkoong, Ch. B. Newswander, N. Runowa, J. L. Wagner, T. Zeliuk et al. But one needs to study in more detail the political service in Ukraine.Paper objective. The purpose of the article is to describe the political service as one of the types of public service.Paper main body. The political component of the public service is a relatively new domestic institution, although the debate on the delineation of policy and administration in the field of public administration has been under way since W. Wilson, who in 1887 clearly divided his policy and administration into his essay «The Study of Administration». Ukraine has gone through a difficult path to implement a mechanism for distinguishing between politics and administration in the public sphere.For the first time, the idea of demarcation of political and administrative positions with the need to introduce a political figure (politician) in the official sphere appeared in the Concept of Administrative Reform in Ukraine since 1998. However, only in 2001, political positions were officially recognized in accordance with the Decree of the President of Ukraine «On next steps for further implementation of administrative reform in Ukraine». Political positions are one of the types of public service posts, which, by their peculiarities and politico-legal principles, differ significantly from other public service positions, in particular civil service. The political nature of these positions is determined by: a special procedure for appointment to a post regulated by the constitution and laws; a special procedure for dismissal and termination of authority; special types of responsibility, which has signs of public, mainly political, for the consequences of being a political figure. In their activities, political figures are guided by specific principles: the presence of a clear political position; activity and initiative; political morality (observance of its political position). Conclusions of the research. The political service in Ukraine generally received a legislative settlement. The article also emphasizes the lack of legislative regulation of a number of executive positions in state bodies, which are not subject to the new Law of Ukraine «On Civil Service».

The relevance of the study is determined by a need to implement new forms of cooperation between the state and the private sector, viz. public-private partnership mechanisms (hereinafter referred to as PPP) due to the limited the state financial capacity to carry out long-term projects in modern conditions. The purpose of this research is to study special aspects of mutually beneficial and effective government and business partnership development in Kazakhstan. As part of this study, an analysis of the current PPP development status in the Republic of Kazakhstan has been carried out; institutional and legislative framework of PPP has been defined. This study reveals that it is necessary to provide a set of measures that will contribute to forming a ready PPP market in Kazakhstan, attractive for both domestic and foreign investors.

In the article the importance of strengthening competitiveness of small and medium enterprises for municipalities to support economic development is considered. The major problems of small and medium enterprises development in Ukraine were identified. The actual problems of small and medium enterprises competitiveness improvement in single municipality were defined. Methodological approach to conduct the research on strengthening competitiveness of small and medium enterprises for individual municipalities was developed. The model of formation the program of strengthening the competitiveness of small and medium enterprises is offered for a particular industry in a particular city. This model was implemented on the example of two industries in Vinnytsia that confirms the effectiveness and validity of the developed model. The competitive advantages of small and medium enterprises of the tourism and clothing industry in Vinnytsia were identified which enabled to develop the programs for strengthening the competitiveness of small and medium enterprises in these industries.

SPECIFICITY OF THE MATERNAL ASSISTANT'S EMPLOYMENT RELATIONSHIP

This paper analyzes the special character of the maternal assistant labor contract regarding the actual legislation and the jurisprudence in this matter. By trying to find a balance between the regulations of the Labor Code regarding the individual employment contract and the special regulations regarding labor contract of the maternal assistant, we notice that the institution of the maternal assistant is governed, first of all, by the principle of the best interest of the child. So, because we have to consider this an axiom, the maternal assistant is, in fact, a genuine replacement of a parent for the child who is in placement or in custody. That’s why the content of this labor contract is all about the growth, care and the education of the child, without a strict connotation to the specific elements of the common labor contract, as the work program, the time to work and time to rest and even the subordination relationship with the employer. In this context, the common stipulations of la labor Code regarding the individual labor contract are only the general frame in which the work of the maternal assistant is taking place, because the content of his work is much more, legally and morally, that the norm.

Administrative acts’ characteristics present those features which, by resulting out of the cumulative reunion of the essential elements and of the validity conditions, they differentiate these acts from other categories of legal acts. When we say characteristics of the administrative acts we understand those features which individualize these acts from other legal acts.

Central administration and local administration units are main administrative systems that operate for serving citizens in a country. Both administrative systems must perform the duties in their field in an efficient and productive way, and so, meet citizens’ needs. Due to historical problems between the central administration and local administrations, it is impossible to achieve efficiency in satisfying people’s needs in Turkey. At the root of issues between the central administration and local administration, there are problems faced in the areas of duty sharing, allocation of funds and supervision. Although many steps were taken to resolve these problems in the historical process, such problems still exist. This situation entails justice to overcome the problems, because justice represents suitability to needs on the basis of equity, and must be taken into consideration in relations between the central administration and local administrations. That the central administration and local administrations execute their duties efficiently requires duty sharing, allocation of funds and supervision on a just basis. This study first explores the concepts of justice, centralization and decentralization. Then, it discusses the role of justice in resolving the question of centralization and decentralization, which is a very important problem in Turkey.

The article gives an account of the 1st Convention of Łódź Voivodship Regional Associations, which was held in Uniejów in 2016. Regional associations started to be formed in Poland in the 1st half of XIX century. The article highlights the background of the organization of the Convention and provides information about the activity of regional societies in Łódź voivodship, including the time of their establishment, number of members, etc., on the basis of a survey conducted in 2016 on a sample of 33 respondents. It also stresses the importance of cooperation with local governments and exchange of experiences among regional activists.

The educational capital of the Cahul, the largest district as area (1545,28 km2) and population (116,7 thousand) from the Republic of Moldova, represents an important resource of the regional economic development. It is made an analysis of the educational capital of Cahul district from the perspective of its valorization in order to support the regional socio-economic development and to deepen the cross-border cooperation within the Siret-Prut-Nistru and Lower Danube Euroregions, to which the district is a party. In this sense, the educational capital can be a catalyst for development and due to the fact, that in Cahul district are several educational institutions that can contribute to the training of qualified staff for various fields of activity relevant to the economic development and cross-border cooperation. In the precarious economic development conditions of the Southern Development Region, the educational capital can contribute to the enhancement of economic activities by training the labor force in line with market requirements. It was carried out the SWOT analysis of the district educational system and proposed some actions that would contribute to the improvement of the qualified workforce training system in line with the requirements of the regional labor market.

Purpose of the article. The archival sources on the organization of record keeping and the organization of the activities of local self-government bodies on the example of the Kiev City Duma and Kiev City Council were researched. The composition of the National Archival Fund of Kyiv (NAF), which holds documentation on the issues of general organization of record keeping and staff composition, were analyzed. The purpose of the article is to determine the significance of archival documents for defining the nomenclature of documents inherent to local self-government bodies of the late ХІХ – early ХХ, namely, Kiev City Duma and Kiev City Council. The methodology consists in applying the historical method, the method of textual analysis and deconstruction of document information. The indicated methods allow to reveal and analyze the official document as an object of record keeping in state government bodies and bodies of local self-government. The scientific novelty is the expansion of scientific knowledge about types of materials of Kiev City Duma and Kiev City Council, which are transferred to archival storage at NAF.

The article summarises the advanced world experience in government regulation of the automotive industry using the example of the leading automotive manufacturing countries – China, Japan, India, South Korea, the USA, and the European Union. Leading approach to the study of this problem is the comparative method that has afforded revealing peculiarities of the primary measures applied by governments of the world to regulate the automotive industry have been identified. A unified model for government regulation of the automotive industry has been elaborated. The presented model contains a set of measures for government support for the automotive industry depending on the life cycle stage (inception, growth, stabilisation, top position, stagnation, decline, crisis) of the automotive industry and the level (high, medium, low) of competitiveness of automotive enterprises.

The article focuses on the concept of public participation in key national health policy documents that were adopted during the first decade of Lithuania’s Independence (1991 – 2004). Seventeen health policy documents are analyzed: National Health Conception (1991), Lithuanian Health Program (1998) and major health system related laws that defined public participation. It is concluded that although the importance of public participation in key health policies has been highlighted, the possibilities for public involvement in health policy or health and healthcare decision-making in most of these documents were not clearly defined. Public participation is often seen not as involvement of the public in the processes of shaping or implementing health policies, but as participation of patients in their healthcare through granting them certain rights to make personally significant decisions. The public is also often treated as the object in health or healthcare-related decision-making.

The topicality of the problem under study is due to the expansion of the contemporary concepts of the regional innovation system, and the increasing role of regions and local governments in the implementation of State programs of innovative industrial and technological development. This article aims toward the study of participants of regional innovation processes in the Karaganda region, and the definition of their goals in current conditions. The leading approach taken to the study is the analysis of the regional innovation policy issued by the authorized organizations, and the local government, allowing us to identify the tools of their relationship with other participants of the innovation system in the region. The key participants of the regional innovation system are characterized. The indicators of innovation activity in the region are considered. The factors influencing the innovation processes are identified. The materials contained in this article are useful for improving the management functions and positions of state authorities in the region, as well as for conducting a comparative analysis with other regions of Kazakhstan and the territorial subjects of nearby foreign countries.

INDICATORS’ ADEQUACY ISSUES IN PERFORMANCE MEASUREMENT SYSTEMS

The aim of this article is to analyse the problems of performance measurement systems in relation to the adequacy of indicators. The requirements for modern performance evaluation systems, their classification criteria, and the peculiarities of performance measurement in the public and private sectors are reviewed. One of the most popular performance measurement systems developed into a strategic management tool, the balanced scorecard, is considered, along with other systems. One of the main issues of performance measurement systems is that the set of indicators remains practically unchanged. Some indicators are changed only after changing the strategic goals, and this circumstance prevents the timely identification of emerging problems within adequacy of indicators. The article proposes to enrich performance measurement in process improvement systems, and suggests breaking down the measurement process into cycles by reviewing the set of indicators after each step of the cycle and, if necessary, adjusting them. This could make a significant contribution to ensuring the adequacy of indicators, one of the most important prerequisites for proper measurement, and would bring the performance measurement systems closer to the requirements of third generation systems.

The issue of public policy on accountability, transparency, and access to public information has now become a trend in most countries of the world. Among one of its objectives when evaluating institutions and public servants by their administrative and governmental decisions is to decrease corruption. Mexico is already a formal democracy, but the quality of its governments is still very low. Although these have been elected by the citizens, they continue without being accountable. In this paper, we analyze as a case study the State´s last recourse to repair what bad management and privileges caused: the national anticorruption system, its formation, and operation. We enunciate the limits and scope it faces.

FIABILITATEA ŞI LEGITIMITATEA STRATEGIILOR DE DEZVOLTARE LOCALĂ

Strategies represent public policy documents that have the role to define medium or long-term development. Strategies are used as tools in decision making process. The key question of the study addresses reliability and legitimacy aspects of these documents. Public debates and involving of stakeholders offer legitimacy to the strategies. The limits of the strategies are represented by compatibility between interests and values, knowledge and skills between policy makers and citizens. Narrowing of the compatibility affects legitimacy reducing reliability of the document and its desired effects.
