Специфика формирования политико-правового сознания молодежи в современной России

The author of article concentrated attention on basic elements of process of formation of political culture of the Russian youth. The factors influencing the level of political and legal consciousness of the younger generation are allocated and its main components are given. Conditions and factors of formation of political preferences of modern Russian youth and its socio-political orientations are revealed. The author proved a role of process of political socialization of youth, which lays the foundation of basic knowledge, judgments and installations. The importance of the actions focused on increase of political and civil culture of modern youth is reasoned.

Problems of Evaluating the Tax Burden Level in Ukraine

The article reviews problems of evaluating the level of tax burden in Ukraine. The dynamics of a Total Tax Rate index is given by certain countries of the world as of from 2013 to 2015. This index value is compared between Ukraine and other countries. Basing on the statistical data, the rate of tax burden in Ukraine as of from 1997 to 2015 is calculated. Its dynamics analysis is conducted. The problems are defined which appear during evaluation of the tax burden level in Ukraine. Among main problems, the following are considered: corruption rank, ambiguity of calculation methodology, large share of economics in the black economy sector, growth of tax burden due to additional expenditures.

The system of decentralized public administration creates a vital environment for better interaction between the state, its sub units and citizens. Despite all benefits, the growing nature of bureaucratic procedures and power distribution seem to attract more attention, mainly from the reasons of unprecedented mechanisms of control. The aim of the paper is to demonstrate the potential of Public Prosecution Service in Slovakia to control the decentralized public administration being provided with a statutory power to monitor the field of public administration as a whole and whether the competence to exercise supervision over the law-abidingness should not be entrusted to other public authorities, such as the Public Defender of Rights. The paper is conceived as a case study of methods of prosecutorial supervision and their practical application in Slovakia.

This transformation of public consciousness, as an inevitable stage in the construction of a market economy requires new forms of organization of state regulation of all the processes in different sectors and at different levels. The modern concept of Public administration is firmly established as the standard form of organization of processes and technological support of public administration in Ukraine. The using of a certain unified model of decentralization of Public administration in the framework of Local Self Government will ensure the necessary level of transparency in dealing with many of the common problems of regional development, including those in the context of economic liberalization.

Činnost veřejné správy České republiky hodnocena metodou analýzy rizika

This paper deals with the activities of the public administration of the Czech Republic. It appeared recently, that the responsible persons were held accountable for wrong decisions, both of technical and political nature. In some cases, these decisions were also used against responsible persons at all levels. The aim of our research was to find out how the Risk Analysis can be used to identify and manage risks effectively. It shows an alternative option to use the mathematical model, called SWOT, in the decision-making processes of public authorities. This model can partially eliminate the subjective influences of judges and responsible persons who decide on the final verdict. This research is based on the analysis of the present Czech legal norms and their application in the decisions of the local administration. The results show that the use of the model SWOT can help to avoid wrong decisions of public administration. It can also reveal weak and strong aspects of decision-making processes. As there is a need to decide and take correct actions at all levels of the government, one of the risk analysis methods may be used as a supporting instrument. In this case, SWOT matrix was chosen as a basic and universal method that can be easily applied.

Considered as the highest virtue in all historical ages and all cultures, ‘justice’ is a key concept in rendering civil services. Provision of civil services to people who must live together should continue based on a relationship of justice and responsibility. The roles of public administration and administrators are important in meeting the needs of citizens because of justice and responsibility. It is of utmost importance that public administration and administrators act in conformity with justice when satisfying the needs of the society. Effective and just provision of civil service by public administration is closely associated with public administrators’ awareness of their responsibilities. In this study, first the concepts of ‘justice’, ‘responsibility’, ‘civil service’, ‘public administration’ and ‘public administrator’ will be explained and then the role of public administration and administrators in rendering civil service on the basis of a relationship of justice and responsibility will be discussed.

Although public policy as a discipline appeared in the Second World War, policies have been studied throughout history. The roots of today's public policy discipline have begun with the use of modern science in policy making processes and when this applies to all policies, public policy has become a discipline. The aim of this study is to examine the development process of public policy and its present state. At the point of development of the discipline, modernization process was applied. In terms of the disciplined role, it is based on postmodern type. In the study, public policy is divided into an action and a field of work. It has been shown that the public policy, which is the result of the further use of science by the state in the context of grasping its importance, can be evaluated within the process of modernization and this form of use can be considered within the scope of criticism of postmodern discourse.

The article aims at presenting the connection between growing international cooperation of public administration in relation to organization and functioning of public service. The presentation is made with the example of the antimonopoly administration. It begins with a short description of the legal basis of international cooperation of the Polish competition authority. It is followed with a short overview of different modes of this cooperation on global, European and bilateral levels. Despite extensive international cooperation of the Polish competition authority, its internal organization is rather inefficient and fails to deliver relevant input from the international cooperation into internal works of the authority. Similarly, civil servants of the competition authority are not offered to rise their skills in relation to foreign cooperation as well as there are no transfers between jurisdictional departments and the department for the international cooperation which keeps those departments separated.

Kierunki zmian tożsamości polskiego prawa urzędniczego

The creation of professional civil service, operating on the foundation of axiological objectives of the democratic state is a complex and long-drawn-out process. Polish experiences in this respect are not minute as the origins of the civil service date back as far as the interwar period. Whereas the first civil service practice was established in 1996 and included the regulations clearly inspired by the Polish experience of the interwar period as well as Western-European solutions in this respect. The legislator was in favour of the career system, setting up the service of the public interest. The legislator defined the major aim of the institution establishment as well, whose main objective was to assure in the government administration offices professional, reliable, impartial, politically-neutral execution of the state tasks. Two years later, the bill was replaced with another practice. In the light of the 1998 Bill, the concept of the institution was adopted. The legislator proposed a mixed model of civil service, which means that the model comprised elements of career and positions model with the prevailing role of the latter. Another Bill on Civil Service from 2006, in the assessment of the doctrine, ruined former achievements of the Polish legislation in the area of civil service. The civil service corps, existing under the rule of the Bill, was stripped of managerial positions. The developed system of civil service organization was liquidated by abolishing the position of the Head of Civil Service and their office. Therefore, in 2008 the legal act was aptly rescinded, replacing it with the bill particularly restoring the position of the Head of Civil Service as well as higher positions in the civil service itself. Nevertheless, that legal act also includes major flaws disqualifying itself from positive assessment. Thus, in the period of less than twenty years, the subject matter in question has been regulated by four completely different legal acts which violates the foundations of a law governed state and definiteness of law. Such changes, with every subsequent entry of a new practice, had a negative effect on practical functioning of the Civil Service Corps and, at the same time, the realization of state tasks.

Perceiving public administration of Poland in its role as “public service” authority during the EU membership period must be interlinked with rethinking this issue in the light of new responsibilities – as the EU territorial administration. Making EU law effective is one of the most fundamental of such responsibilities and concerns equally the process of application of the law by administrative organs of the Member State, in accordance with the set of rules of application of EU law (e.g. doctrine of supremacy of the EU law). Polish public administration in its activity still, despite the period of over the decade of the EU membership, takes a wary approach to this issue. In the meanwhile, the reality of the “multicentric legal system” and progressing process of the Europeanisation of national law results in stronger need to present the proactive approach without which Polish public administration cannot properly function in its role as “public service” authority.

One of the cases of termination to the mandate of local county councilor, before the deadline, is the loss of membership of the political party or organization on whose list of national minorities was elected, as provided by article 9 par. ( 2) lit.h1) of Law no.393 / 2004 on the Statute of local elected representatives, text that was subject to several exceptions of unconstitutionality rejected by the Constitutional Court. Given that the decision nr. 530 from December 12, 2013 the Court has changed practice, declaring unconstitutional provisions of article 16 par. (3) of the Political Parties Law No.14 / 2003, that Retiring councilor (local or county), pursuant to article 9 par. (2) lit. h1) of law no. 393 / 2004, cannot work right, but only after exhausting all appeals and a final decision of the court.

THE RELATIONSHIP BETWEEN PUBLIC SECTOR REVENUES AND EXPENDITURES IN TURKEY

Since the 2008 financial crisis, the topic about the relation of public revenues on the expenditures in affecting fiscal sustainability has received particular attentions by several economists. For this reason, it is necessary to investigate revenue and expenditures relationship for Turkey. In this paper, the empirical relationship between two variables has been investigated by providing econometric models. First, we employed classic and structural break unit roots. After determining the level of unit root of mentioned series, the study found evidence of a cointegration relation between the government revenues and expenditures by employing Bounds test approach. Then, ARDL method was used with the aim of examining the short and long-run coefficients of co-integration relations. According to Bounds Test results, two variable was found to be a cointegrated. The findings of the ARDL method revealed that the change in public sector revenues have significant impact on public sector expenditures. This study provided the evidence of financial sustainability of expenditures with government revenues which can be supported the concept of fiscal sustainability in Turkey.

Narratives on Complexity: Interpretations on Local Government Leadership Change

This article, based on narratives of experienced (born between 1945 and 1950) municipal chief executive officers, investigates changes that challenge leadership in local government. Four factors emerge: the dissolution of municipal boundaries; cooled relations between the State and municipalities; municipal inhabitants’ chang-ing role from participatory residents to exacting customers; and fragmentation of local politics. These four changes reveal the diversity of local leaders’ everyday environment, illustrating and exploring how day-to-day management takes place in the intersection of more and more complex governance relations.

Politico-Administrative Relations in the National Reception of OMC Policies: Comparing Policy Sectors in Slovenia

The article examines the relationship between the national politicians and their civil servants in the reception of the Open Method of Coordination (OMC) policies. Our comparative case study of three policy fields in Slovenia identifies variations in the politico-administrative relations among different policy sectors. These variations can be explained by the weight of the ideological-political burden that determines the extent to which a particular policy sector is politicised. Although the reception of OMC policy is first and foremost in the hands of the national politicians, national civil servants have greater scope to act autonomously in those policy sectors which are less politicised.

Design in public service organisations is an important context, possibly influencing many aspects of public management. Yet it has not been well included in the main research stream as a variable, mostly due to elusive understanding of the phenomenon and its weak operationalisation. Research aims. This paper aims to further the understanding of design within Public Service Organisations (PSOs), in order to propose the main dimensions for measuring design within PSOs. Methodology. This study uses a literature review and deconstruction based on a narrative analysis. Literature has been hand-picked according to snowball effect logic. Key findings. The obtained results of deconstruction allowed for proposing a consistent and comprehensive framework of design within PSOs. It facilitates research by giving the ground for developing concrete measures.

Sustainable development, a development model that can meet the needs of today's generations without sacrificing the needs of future generations, remains up to date as a result of global warming and increasing environmental pollution. For sustainable development, it is necessary to integrate all economic and social policies of an country with environmental policies and strategies. In the formation of these policies, not only the state, private sector and NGOs but also the attitudes and activities of public private sector partnerships, which are increasingly applied in recent years, are also determinant. Public private partnerships are a financing model based on the realization of certain investments and services through the sharing of costs, risks and benefits with a long-term contract between the public and private sectors. The effects of this model on sustainable development with its advantageous and disadvantaged aspects create a debate. In this study, we will try to find answers to some questions such as what public private partnerships mean for sustainable development, whether it is an opportunity or a threat, whether the public private sector partners need a change in the framework of sustainable development, and various suggestions will be made.
