This study explores the abuse of superior bargaining position as set in Article 37a of the Bulgarian Competition Protection Act (CPA). The provision of art 37a is analyzed from the comparative point of view as to the existing normative regimes in jurisdictions like Japan and Germany. Unlike most studies on the abuse of superior bargaining position, the author maintains the view that the prerequisites in Article 37a of CPA set the institute as a part of the competition law rather than as part of the law of unfair commercial practices between enterprises. In support of this opinion the author performs a comprehensive review on the existing practice of the Commission for the protection of competition regarding Article 37a of CPA.

Ownership and the right of ownership are formed in a specific historical and social context. Knowing these differences, as well as the reasons for their existence, may serve as a guarantee for the successful realization of the rights and for their protection. This paper discusses some specifics of the ownership in Bulgaria, which have been differentiated as a result of the social and economic relations from the Middle Ages to the present days. Such distinction is carried out in the paper on the basis of the differences between East and West (in a religious context), between country and town as well as natural exchange and monetary exchange.

Based on Mamardashvili’s words that “the meaning of the past is happening in the present,” we would like to investigate in what way the contemporaries of the period after 1990, period of transition from socialism to democracy, remember this time, and how do they interpret the events of the past from the perspective of the present. After a research on the published Bulgarian memoir literature from the year of 1990 to the year of 2018, based on a detailed list from the Collaborated Online Bibliographic System and Services (COBISS), we have chosen three authors of memoirs, whose books we are going to analyze in details. We have chosen these authors by two criteria: 1) their active participation in the social and political life of the country, both in the first years after 1990, and until today; and 2) the three authors are representatives of professions which are connected in some way with the words and writing. In this paper we are going to analyze the memoirs of the journalist and publisher Tosho Toshev, the writer Georgi Mishev and the political scientist Evgeniy Dainov. Our main goal is to analyze how do they see and interpret the period after the 1990, in their memoirs.

According to research, documentaries are among young people’s favorite sources of information on the time of communism in Bulgaria. Are these films announced, how are they announced, do announcement have their own message? The article looks into film announcements as a paratext with specific features on the internet. The study covers the period 2006-2015 and regards as “films on communism” the documentaries, developing plots from the period 1944-1989 in which concepts on “communism in Bulgaria” are concentrated. Announcements are viewed in connection with online platforms promoting them, on the one hand, and with cinematographic works, on the other.

Internet has inevitably the media landscape and the way we communicate with each other. The trend has an immense impact on childhood, too. Today, children are “digital natives”. They are always on, always connected, living in a world of communication fragments. Attention spans are shrinking, so do media formats. The aim of this article is to identify and analyze trends in content production and consumption in the digital era. A small-sized yet focused empirical study on the Bulgarian television programmes for children is also presented.Internet has inevitably the media landscape and the way we communicate with each other. One of the most common mistakes made by the contracting authorities refers to the violation of the prohibition as set out in Article 25, paragraph 7 of the Public Procurement Act (PPA) – that is when the selected criterion for the award of public contracts is the one of “the most economically advantageous tender”, the contracting authorities are not allowed to use in the capacity of award criteria the selection criteria under Article 25, paragraph 2, item 6 of the PPA. The subject of the present article is to clarify the nature of the prohibition under Article 25, paragraph 7 of the PPA, as well as the legal consequences that such a violation entails. For this purpose, the selection criteria and the award criteria are discussed, and special attention is paid to their differentiation. The law explicitly enjoins the mix-up between selection criteria and award criteria. The violation of that prohibition is an administrative offence which results in imposing a penalty sanction, respectively, a fine upon the contracting authority. Regardless of the administrative penal provisions of PPA, the current legislation still provides for an opportunity to impose financial corrections in cases when it comes to costs associated with the implementation of operational programmes co-financed by structural instruments of the European Union, the European Agricultural Fund for Rural Development and European Fisheries Fund for non-observance of the rules with reference to public procurement.

The effect of the doer’s confession in criminal cases adjudicated under the order of the brief court investigation or settlement of the case by an agreement is statutory lowering the punishment. This procedural effect raises the question about the material value of the confession which has to be presented trough the point of two purposes of the punishment and the basic principles of imposing a determined sanction on a particular doer. Current article is focused on the material legal contents of the confession as a mitigating circumstance and legal grounds for applying art. 55 of Penal Code, which allows the substitution of the statutory sanction with a lighter one.

The main focus of this work is two important events at the global and local level that illustrate how Facebook is gaining more influence in public life. The presidential elections in the United States and those in Bulgaria in 2016 were marked by trends that show a growing influence on the social network - both positively and negatively. This approach aims at finding out how and to what extent this affects these important political events and their results. The way in which news content is presented in the social network to analyze its potential as a new media environment is also analyzed. The study pays attention to the importance of information in the social network, its credibility and its purpose – whether it is to be in favor of the consumer or to manipulate it.

The text is a part of the bachelor’s degree thesis, which was presented in the Department 'Radio and Television' of Faculty of Journalism and Mass Communication in 2016.

The present paper forms part of a broader study on emperors’ constitutions as legal sources in the Late Roman Empire –both with regard to commentaries of the constitutions issued in Ancient Serdica, being one of the main seats of Roman emperors from the Age of Tetrarchs, and with regard to the overview of Roman jurisprudence developments from didactic point of view. This issue is under consideration at present in the light of the process of drawing general conclusions on the basic problems with regard to Roman law sources from the point of view of the history of lawcreation and Roman legal traditions in the establishment of European law.

Current exposition examines the right of state bodies to litigatesubstatutes. Article 186, section 2 of the Administrative Procedural Codeallows state bodies to bring before the Supreme Administrative Court thematters of legitimacy of regulations, ordinances, instructions andgovernment decrees, although article 120, section 2 of the Constitution ofBulgariadoesn’t explicitly empower them to litigate statutorial actsof the administration. The Constitutional Court’s Decision No 5 from 17 April2007 on Constitutional Case 11/2007 definitely deals with the question ofstate bodies rights to litigate substatutes and the requirement of provingdirect personal interest in order to do so. The lack of clearlydefined rules about whoacts as litigation rights’ holder, however, still remains a problem. Legal norm indeed are general rules of behavior and constitutional normsare abstractions of highest degree, but this could not be an excusablereason for the lack of precision, clarity and thoroughness of theregulation of such a high priority matter as judiciary control over theacts of the administration. Hence the contradictory court rulings overthis matter not surprisingly lead to different legal consequences for thesame parties and the legal doctrine is also inconsistent. The main purpose of the present workis to expose this very issue.

The public lecture offers two polar opportunities for international journalism. The lecture reflects on the relative comparability of the presence of topics and places in different segments of the information media. The role of the maps – geographic, political, and any other – as an invaluable assistant in the understanding of the world, the causes of the existence of geopolitical ties or ambitions, the behavior of states with their natural vulnerabilities is shown. Maps are analytical tools and tools that help us think about individual countries, regions or continents, and more general about the world. The Mercator projection is an appropriate key to understanding the continued dominance of the North – the North as a political concept covering the developed and economically powerful countries of the world in the global information flow. The misunderstanding of the scale of the world around us can have or has a real impact on our opinions and decisions. An example in two parts – the presence of Nigeria and France in world news, helps to see the connections. The inequality in the coverage of identical events in the example is related to the sense of predictability of mass killings in Africa and the surprise that such a thing can happen in France. The revolution in communication technologies got ahead of major processes of human evolution and globalize our world, globalize humanity long before the world, humanity has become a community of mutual knowledge and understanding. All of this makes the opportunities of international journalism big and negligible at the same time.

Antropologia New Age

This article examines New Age anthropology in light of important changes that are taking place in western culture. These changes are undoubtedly due to many factors, but primarily to a crisis of Christianity, scientific revolution, and postmodern man’s search for alternative answers. The first two points of this article discuss the foundations of this anthropology, which are rooted in new scientific theories and their metaphysical interpretation in light of the concept of Eastern religions such as Hinduism and contemporary gnosis. According to these Eastern ideas and religions, man is an emanation of the Divine Absolute, who is an incarnate particle. This holistic outlook identifies the Creator with creation and is connected with an evolutionary (and not a creationist) worldview. The following point of the article discusses the concept of so-called “transformation of consciousness,” meaning the need to discover one’s true divine identity. This concept asserts that man’s rational identity is an “illusory I.” The final two points of this article present the consequences of this kind of human perception, or the cognitive process based on inner human experience, meaning so-called “enlightenment” (and not on objective Truth), and of the absolutization of the subjective conscience as the supreme tribunal based on having reached enlightenment. In this way, man’s divine identity, which blurs the boundary between that which is divine and that which is human, is the basis of New Age anthropology. In addition, New Age anthropology’s evolutionary understanding of the cosmos, including of man, leads one to conclude that human nature is subject to the processes of change that makes it possible for man to go beyond the limit within which he is understood as being a homo sapiens.

The dignity of a man who fits into his subjective existence is imperishable and irreducible. It implies awareness of subjectivity, the ability to reflect, identity, historicity, freedom, autonomy of the relationship. In individual dignity, man experiences belonging to a group whose functioning is often dictated by national dignity. A hundred years of Poles’ independence showed that the history of the nation affects the maintenance of the sense of individual dignity and the changing circumstances of life, often dictated by persecution or life on the periphery of this dignity, can not threaten. In order to show the dignity carried out in the period of one hundred years of independence, the following problems have been emphasized: the principle of human dignity (1), dignity as the basis of social life (2.), dignity crippled and trampled – exile, exile, emigration, periphery (3.) in defense of dignity (4.).
