The rules determining the law governing contractual obligations arising out of international licensing agreements are in the European Union set out in the Rome I Regulation. The main pillar expressed in Article 3 is the principle of party autonomy. Equally important, however, is Article 4 containing rules for determining the applicable law in cases where the contract contains no agreement on choice of law. The present paper focuses specifically on Article 4 Rome I Regulation in relation to international industrial property license agreements in the absence of choice of law.
