Healthcare Reforms in Bulgaria: Towards Diagnosis and Prescription

The paper shows the evolution of this reform path to low compliance by both customers (contributors) and service-providers (contractors with the National Health Insurance Fund), which leads to excessive regulations and control, and crowding out of the private sector. The outcome is a system that is increasingly driven by administrative controls at the expense of market incentives. Based on this analysis it identifies the relevant policy implications and opportunities for moving the stalled health reforms out of the institutional impasse.

The decentralized system of health organizing of the Federation of Bosnia and Herzegovina, based on the autonomy of the cantons in the exercising and allocationing of funds from the mandatory health insurance has resulted in significant differences in both the scope of the rights of insured persons to health care and in terms of access to health care. The differences in the realization of funds from mandatory health insurance by cantons are caused by differences in the coverage of the population with health insurance, unevenly rates and bases for calculation of contributions, number of employees and the amount paid.

Presently there is no law regulating the rights of patients to health care in Bosnia and Herzegovina on country level. For this reason, there are no established mechanisms to protect the rights of the patients. In the Republic of Srpska and District Brčko of Bosnia and Herzegovina, the laws on health care, and in the Federation of Bosnia and Herzegovina, the Law on the Rights of the duties and responsibilities of patients, defined as patients' rights to health care and public legal mechanisms to protect the rights of patients. There is no protection of patients' rights in health-related decisions in administrative proceedings or before the administrative court, in the same way as in other cases of infringement of the rights of any other citizen. The rights of the patient to the personal dignity, in respect of time, to have access to medical records, to refuse receipt of the notification, the food in accordance with the worldview and others, do not enjoy the protection of public-law. Activity of the entire health system in Bosnia and Herzegovina is of particular importance for the country, and all the regulations that apply to this activity include public law elements. Legal assistance to patients is very limited. Patients are double handicapped because of their limited knowledge of medicine and medical technology. There is a significant presence of fear, because healthcare is always and only provided by health professionals in the health care system which is patients only option. We should keep in mind that the right to health care (in most cases, on the basis of compulsory health insurance) patients realized in a health care institution in the area where he lives, and that if you file a complaint, it believes it is right to continue to be withheld or that they will get less quality-service. The existing legal provisions are a good basis for further improvement of the public-law protection of patients' rights. Due to the large number of cases and the workload of the courts, one of the solutions that could be applied in the process of protecting the rights of the patient, is mediation. Mediation, as an alternative means of dispute resolution, to speed up the process of making decisions about protecting the rights of patients and thus to achieve better results.

Transseksualnost pred Ustavnim sudom Republike Srbije

Prva odluka o ustavnoj žalbi transseksualne osobe X Ustavnog suda i argumentacija koja je upotrebljena za njeno obrazloženje, nesumnjivo zaslužuju svaku pohvalu. Uprkos tome, čini se racionalnim pozvati na hitnu intervenciju zakonodavca, ne zbog toga što problemi transseksualiteta nužno zahtevaju da budu baš zakonski regulisani (jer su mnogobrojna uspešna rešenja demonstrirana i u sudskoj i u upravnoj praksi drugih zemalja) već što bi u sadašnjem trenutku takva intervencija osujetila potpunu ignoranciju težine problema od strane zakonodavca u Srbiji. Suprotno iskustvima stranih pravnih uređenja, odsustvo striktne zakonske regulative moglo bi u srpskom pravu da otvori put neodgovornom i olakom tumačenju kako je promena pola stvar rutinske administrativne odluke koja se ispisuje na šapirografisanom obrascu, što je druga, ništa manje rđava krajnost. Prepuštanje opštinskim organima uprave da odlučuju o tako važnom pitanju kao što je promena pola, a da pritom ne budu snabdeveni nikakvim uputstvom ili drugim bližim propisom o načinu na koji će obavljati tu svoju dužnost, krajnje je riskantno i teško da bi se moglo pretpostaviti da bi se bilo koji odgovoran zakonodavac sa takvim rešenjem mogao saglasiti. To bi značilo pristajanje na sasvim slobodnu procenu svakog matičara o najvažnijim otvorenim pitanjima: da li je operacija za podešavanje pola neophodna za promenu navoda o polu u matičnoj knjizi ili je dovoljna i sama endokrinološka terapija o kojoj bi postojala odgovarajuća medicinska dokumentacija; ako operacija jeste uslov, kakva i kolika medicinska dokumentacija treba da prati odgovarajući zahtev i ko je ovlašćen da izdaje takvu dokumentaciju; najzad, kakve sve posledice proizvodi takva promena na dotadašnje i buduće pravne odnose transeksualne osobe, od mogućeg retroaktivnog dejstva upisa, do pitanja o sudbini braka u kome se mogao nalaziti onaj ko je pristupio hirurškoj i pravnoj promeni pola? Logično je, naime, očekivati da se u bliskoj budućnosti, a naročito nakon odluke Ustavnog suda, pred organima uprave ili sudovima u Srbiji pojavi više novih zahteva transseksualnih osoba za promenu upisanog pola u matičnim knjigama ili za priznavanje nekih drugih prava, koji će zahtevati civilizovan i adekvatan odgovor državnih organa i pozitivnog prava. Buduće pravno uređenje fenomena transseksualiteta u srpskom pravu moglo bi se ostvariti propisivanjem posebnog vanparničnog postupka za promenu pola, koji bi predviđao i nužne medicinske i pravne pretpostavke koje se moraju ispuniti da bi jedna osoba mogla pravno da stekne pol suprotan onome koji je upisan u matičnu knjigu rođenih (sudski postupak po ugledu na nemačko pravo), ili bi za donošenje takve odluke i dalje bili nadležni matičari kojima bi stajalo na raspolaganju odgovarajuće zakonsko rešenje (upravni postupak po ugledu na austrijsko pravo). No, bez obzira na vrstu pravnog postupka, rešenje našeg prava ne bi smelo da propusti da razreši dva vrlo važna pitanja načelnog značaja. Prvo je zahtev da se o pravnoj promeni pola može govoriti jedino kada je reč o transseksualcima koji su bili podvrgnuti operaciji polnog preuređenja, budući da se pre takvog zahvata može govoriti samo o osobi za koju je postavljena dijagnoza transseksualiteta. Kako je terapija transseksualiteta postupak koji traje više godina i obuhvata nekoliko faza (od psihijatrijskog posmatranja, preko hormonskog tretmana, do završnog polnog preuređenja koje se obavlja operativnim zahvatom na genitalnim organima), za pravo je važno da bude utvrđen jedan trenutak u kome će se nesumnjivo moći govoriti o obavljenoj polnoj transformaciji. Takvo rešenje je logično, zbog toga što i pravo koje se odnosi na transseksualce (slično onome koje se već godinama primenjuje na somatske hermafrodite) mora da uvažava preovlađujući pol jedne osobe. U slučaju predoperativnog transseksualca, kod koga su svi kriterijumi pola (izuzev psihološkog) usklađeni, očigledno je da takva osoba može u pravu biti smatrana jedino kao pripadnik pola koji je imala na rođenju. Potencijalni brak takve osobe sa osobom istog hromozomskog pola ne bi bio dopušten i morao bi se kvalifikovati kao homoseksualni odnos, bez obzira što bi takav transseksualac, zahvaljujući svom suprotnom psihološkom polu, smatrao svoj odnos heteroseksualnim. Obrnuto, kod post-operativnog transseksualca, preovlađujući je pol onaj na koji ukazuje usaglašenost psihološkog pola i anatomskog izgleda koji je stečen zahvaljujući hirurškoj intervenciji, pa i u pravu pol može biti samo onaj koji je u saglasnosti sa takvim harmonizovanim statusom individue. Drugo je zahtev da se o obaveznoj pravnoj promeni pola mora govoriti ukoliko je preduzeta odgovarajuća hirurška intervencija koja je definitivno približila transseksualca polu koji je suprotan onom koji je inicijalno bio upisan na rođenju. U suprotnom, moglo bi se dogoditi da se transseksualna osoba podvrgne operaciji polnog preuređenja ne zahtevajući posle toga nikakvu promenu statusa. Takav ishod bi značio da se pravo može naći u prilično čudnoj situaciji, u kojoj će morati da se saglasi sa tim da je valjan brak dve osobe koje obe imaju spoljni izgled jednog istog pola, ali na jedan zaobilazan način. Drugim rečima, u pravnom sistemu u kome je, kao što je to slučaj sa srpskim pravom, ustavna definicija braka obuhvatila bezuslovno samo muškarca i ženu, odnosno gde definicija braka nije indiferentna prema različitosti polova kao jednoj od pretpostavki za punovažnost braka (iako u uporednom pravu takav uslov sve češće izostaje), sudbina braka transseksualne osobe koja je izvršila operaciju polnog prilagođavanja, ali nije pravno promenila pol, bila bi u najmanju ruku neizvesna. Pravo ne bi smelo da dopusti da promena polnih odlika dovede u stvarnosti do situacije da pravni status neke osobe nije više usklađen sa njenim spoljnim izgledom, budući da je čitava velika tema o pravima transseksualaca na polni identitet i započeta kako bi se postiglo takvo harmonizovanje.

Dialysis treatment is often the only hope for patients with renal insufficiency, which is why it is extremely important that the system of providing this type of health care service is organized in an adequate manner. In the Federation of Bosnia and Herzegovina, dialysis services are performed exclusively within public health institutions, which are faced with a number of problems, some of which are caused by the healthcare system itself, and the other are the effect of the lack of financial resources. In addition, there are significant differences in the scope and manner of achieving certain rights of dialysis patients in the area of social protection, depending on which canton they live in. Possible solutions to some of these problems are the introduction of new models of providing dialysis services and the development of transplantation medicine. However, without the constitutional reform in the Federation of Bosnia and Herzegovina, it will be almost impossible to introduce a model of providing dialysis based on the principles of public-private partnership, and for the further development of transplantation medicine it is necessary for BiH to become a member of Eurotransplant, and one of the conditions for that is the state-level legislative framework.

The European Roma Rights Centre (ERRC)1 hereby submits this list of issues concerning the Former Yugoslav Republic of Macedonia (FYROM) to the United Nations Committee on Elimination of Discrimination Against Women (hereinafter also referred to as “Committee”) for the consideration of the Committee on the 71 presession for the List of Issues. The submission focuses on the situation of Romani women and girls, in particular sexual abuse of Romani children in state care institutions, access to reproductive healthcare and citizenship rights. FYROM has 2,022,547 inhabitants, of whom 53,879 (2.66%) have declared themselves Roma. However, the available unofficial estimate for Roma is 135,490 (6.77%). Roma live in 75 out of 85 municipalities across the country. According to official data, the majority of Roma live in the capital, Skopje (23,475), with 56% of Skopje’s Roma concentrated in the municipality of Šuto Orizari (13,342).

The European Roma Rights Centre (ERRC) submits this parallel report to the United Nations Committee on the Elimination of All Forms of Discrimination Against Women (CEDAW) commenting on the Combined Fourth and Fifth Periodic Report of the Czech Republic, submitted under Article 18 of the United Nations Convention on the Elimination of All Forms of Discrimination against Women (Convention). The present shadow report describes the current situation regarding one of the most serious human rights abuses of women – the practice of coercive sterilisation among Romani women – and the legal, policy and other obstacles in reaching an effective remedy for the victims. The submission focuses only on violations directly related to the practice of coercive sterilisation engaging the following articles of the Convention: Articles 5 (stereotyping and prejudice), 10 (equal access to education), 12 (equal access to health care services) and 16 (freedom from discrimination in all matters relating to marriage and family relations) of the Convention. This report aims to provide an update on the situation since 2010 when CEDAW last reviewed the Czech Republic.2 It includes an update on the legislative changes, compensation mechanism proposals, updates on court cases, comments on the information provided by the Czech government and recommendations for government action.

Over the past ten years, the Helsinki Committee for Human Rights in Serbia (HCHRS) has conducted dozens of visits to prisons in Serbia, with the aim of making an assessment of the human rights conditions for imprisoned and detained citizens. Since 2001, the HCHRS has visited all 28 institutions for the execution of criminal sanctions, many of which several times. In a vast number of reports, the HCHRS has conducted analyses and noted non-compliance with solutions prescribed by national legislature and international law on the one hand, and with common practices in the system of execution of criminal sanctions on the other. During the first visits to prisons in 2001, it was determined that human rights conditions were extremely poor. At that time, there were around 6,500 convicted and imprisoned persons in Serbia. Ten years later, resulting from vast efforts by non-governmental organizations (NGOs), international organizations (OSCE, UN, CoE), but that of the state as well, the human rights conditions in prisons have been significantly improved, primarily when the decreasing practice of torture and introduction of new (contemporary) legal solutions in the field of criminal sanctions are concerned. The implementation of the institute of alternative execution of criminal sanctions has finally begun in 2011. It includes the possibility of serving a sentence in home confinement (with or without electronic monitoring) for persons serving prison sentences of up to one year, or the conversion of the prison sentence to community work. However, the number of sentenced and detained persons in prison has nearly doubled over the same period of time.

Serbia’s system for the execution of criminal sanctions has undergone multiple transformations over the past ten years. Since 1991, the prison system has a record of an increasing number of detainees and prisoners, which is the result of a more strict court policy. This occurrence was particularly pronounced as of 2003. Before 2003, the number of detained persons in the Republic of Serbia was steadily between 5,000 and 6,000; whereas afterwards the growth rate of the prison population amounted to more than 10%, so that today, the total increase as compared to the mentioned year surpasses 60%.

Kad Aleksandar Vučić kaže da „država nema i ne može da obezbedi još para za pomoć privredi“, onda je to samo zato da bi njegov podvig kada to ipak učini izgledao veći. „Mislite da imamo ćup pa dođete i uzmete? Vlasti u Srbiji, kako smo doznali od istraživačkih novinara BIRN-a, u službenim su izvještajima višestruko umanjivale brojeve umrlih i zaraženih od korona virusa. Pitoma štampa u Hrvatskoj nije poduzimala slične istraživačke napore, pa nema dokaza o otvorenim lažiranjima, no svaki je laik – ukoliko se odvažio mućnuti svojom glavom – mogao prozreti epidemiološku strategiju proizvodnje povoljnoga ishoda: što manje testiranih, to manje zaraženih! Svaki put kada je postavljeno pitanje zbog čega se u Hrvatskoj provodi tako mali broj testiranja, medicinari iz kriznog menadžmenta odgovarali su otpisujući autora prigovora kao neznalicu. „Testiramo točno onoliko koliko je potrebno!“ Nije nedostajalo ni sitnih računskih trikova. Na dan kada nastaje ovaj zapis, recimo, Nacionalni stožer civilne zaštite objavio je da u Hrvatskoj u zadnja 24 sata ima ukupno 67 novooboljelih, dok podaci lokalnih stožera govore kako su samo u Zagrebu zabilježena 44 nova slučaja, a u Osječko-baranjskoj županiji 35.

Glasačke kutije i birački spiskovi se još nisu ni ohladili, a članovi Kriznog štaba, do juče iščezli iz javnosti, su nas obavestili da je epidemiološka situacija u zemlji ozbiljna i da zahteva ponovno „stezanje kaiša“. Gotovo istovremeno, mediji su objavili da su podaci o broju obolelih i umrlih pacijenata od korona virusa lažirani od prvog dana epidemije, a naročito od ukidanja vanrednog stanja početkom maja. Vanredno stanje je, podsetimo, konvalidirano u Skupštini, a nekoliko dana kasnije i ukinuto sa istim obrazloženjem– da je „širenje zarazne bolesti COVID-19 na teritoriji Republike Srbije ograničeno i da se nalazi pod kontrolom“.

Sigurno nisam jedini koji se latio da sračuna ko je koliko pomoći obećao zemljama pogođenim pandemijom iz koje će se netom preći u ekonomsku krizu. Ponadao sam se, ali je posao samo delimično obavljen. Evropska centralna Banka (ECB) pokazala se najširokogrudija. Kristin Lagard je, pre nego što su na nju izvršeni bezočni pritisci, izlicitirala ukupno 1.350 milijardi evra kredita, kojima će podupreti izlazak iz krize. EU je odlučna da mobiliše čak 2.400 milijardi evra. Prvih 540 milijardi su krediti Mes (za zdravstvo), Sure (za zapošljavanje) i Eib (za preduzeća). Gotovo da ne postoji duži period otkako je kompanija „Jura“ došla u Srbiju, a da nije završila na naslovnim stranama zbog nekog kršenja zakona. Navodnog kršenja zakona, naravno, budući da je država bez greške propustila da makar jednom sankcioniše varvarsko ponašanje južnokorejskih „investitora“ prema srpskim radnicima. Tako nikada nismo dobili potvrdu da je bilo pelena (odnosno u blažoj i realnijoj varijanti ove priče, sankcionisanja zbog vršenja male nužde u toku rada), diskriminacije, zlostavljanja na radu, kršenja niza odredbi o rasporedu radnog vremena.
