Insolvency in Construction Contracts

The present study analyzes the application of the prerequisites for the opening of insolvency proceedings due to failure to fulfill a construction contract. The main purpose of the author is to investigate the peculiarities of insolvency over a certain type of commercial transactions, which have as object the construction of a future property and the subsequent transfer of the object for the benefit of third parties. The scientific argument for the existence of a specific reflection of the normative regulation on the analyzed contracts is argued in the following directions: bearer of receivables and its origin; application of suspension of payments as a presumption of insolvency; determining the starting date of insolvency. The specific hypotheses in which a claim resulting from a construction contract arises have were systemized. An analysis of the specific impact of the normative requirements on this kind of agreements in practice was carried out.

Indirect benefits are the ones obtained by education, comparison and exchange of experience, because of which knowledge gets larger and it leads to innovations, imitation and product/service improvement. It refers to the connections between the companies within the network in the field of the industry structure, and how the companies interact with each other. In this relation, in this report are consequently revealed the peculiarities of the contemporary networking organizations, the dynamics of their connection with the elements of their environment, and the type of internal relation with the internal company resources.

Psychological resilience is defined as an individual's ability to properly adapt to stress and adversity. Stress and adversity can come in the shape of family or relationship problems, health problems, or workplace and financial worries, among others. In other words, resilience is ones ability to bounce back from a negative experience with "competent functioning". Resilience should be considered a process, rather than a trait to be had. It is a process of individuation through a structured system with the gradual discovery of personal and unique abilities. Resilience is generally thought of as a "positive adaptation" after a stressful or adverse situation. In our research, resilience is considered and analyzed at different levels in tourism economic sector.
