Suspendarea executării actelor administrative emise de Autoritatea Națională de Reglementare în Domeniul Eenergiei
Suspension of the administrative acts issued by the National Regulatory Authority in the Field of Energy

Summary/Abstract: The suspension of the administrative act is an exception from its mandatory and ex officio enforceable nature, such suspension being allowed, in principle, in relation to any legal instrument which fulfills the criteria provided by law in order to be qualified as an administrative act. Of course, in certain situations, legal norms which do not allow the possibility to suspend the enforcement of an administrative act may exist. An issue raised in the practice of the courts with respect to the entities interested in suspending acts issued by the National Regulatory Authority in the Field of Energy consists of interpreting the provisions which regulate the legal regime of these acts, in the sense that said provisions would not allow the suspension of the acts issued by this authority, this matter being analyzed herein.
