The trust as an estate planning mechanism between spouses. Issues concerning the recognition of a trust containing immovable property located in Romania

Summary/Abstract: Within the framework of estate planning, the arrangement of patrimonial relations between spouses constitutes a key element, reflecting the interplay of various legal constructs drawn from both Romanian and foreign legal systems. A particular case arises when a testamentary property trust or when lex succesionis are governed by the law of a foreign jurisdiction, naming the surviving spouse as the beneficiary, in regard to one or more immovable assets situated on the territory of Romania.
