The domestic work through the lens of the participation in acquisition regime: is it an artifice to maintain the balance between the spouses?

Summary/Abstract: Since the adoption of the Civil Code of 2009, the spouses have the right to choose the matrimonial regime of property, between the legal or conventional community of property and the separation (division) of property regime. However, difficulties may arise when it comes to divorce, if the spouses chose the separation (division) of property regime and one of the spouses only did domestic work. Therefore, we shall come up with a solution for this problem, consisting of choosing the participation in acquisition regime.
