3. Noting the possession of a real estate asset in the Land Registry... or how to weave Penelope's web to comply with the effects of the acquisitive prescription (I)

Summary/Abstract: In light of the regulation of Law no. 7/1996 on the cadastre and real estate advertising, which allows the acquisition of property rights by noting possession in the real estate advertising registers, the institution of usucapion in common law seems to no longer find applicability. An important role in the legislative framework is played by the heir certificate issued under the previous regulation, which is currently at the congruence between the different types of registration in the land register. In the context of legislative inconsistencies, legal challenges are not slow to appear.
