Politička instrumentalizacija Visokog sudskog i tužilačkog vijeća BiH na primjeru oktobarskih zaključaka Vijeća

In October 2017, few days after first instance judgment of the Court of B&H in Orić case, Republika Srpska's Centre for the Investigation of War and War Crimes and the Search for Missing Persons filled an Information to the High Judicial and Prosecutorial Council of B&H about state judges and prosecutors with “suspicious war past”. Fifteen of them were accused for unethical behaviour during the war and discriminating against Serbs in war crimes proceedings. Just 12 days after the Information was received, president of the Council, Milan Tegeltija put it on the agenda of the Council meeting with prepared conclusions. Conclusion were formulated in the way to establish a control of bringing indictments for war crimes and war crimes convictions with an aim to achieve ethnically balanced proceedings. That would eventually lead to politicizing war crimes trials. Adopted conclusions were unlawful and pointless. The biggest concern raised the last one, which asked to amend the Law on HJPC which would allow Council to dismiss judge or prosecutor without conducting disciplinary proceedings. Conclusions created internal pressure on the judges and prosecutors to prosecute and judge people based on their ethnicity. Reaction of international & judicial community to the adopted conclusions indicated that they were threatening judicial independence and human rights of judges and prosecutors. After the EU pressure on the president Tegeltija, in November 2017 Council adopted new conclusions. Milan Tegeltija has misused his powers as a president of the Council. Firstly, the Center did not ask the Council to adopt any conclusions. Conclusions were drafted by president Tegeltija himself, without any consultation in or out of the Council. They were shared with members of the Council shortly before the meeting started without giving them time to prepare for debate and working material. Secondly, President Tegeltija was in regular procedure obliged to instruct the Centre to deliver its submissions directly to the institutions responsible for the questions raised. Thirdly, there was not his reaction to the Peer Review or European Commission concerns about rising problems in the B&H judiciary. But, he found it needed to react to the Information submitted by the Centre which activities are directed towards carrying out the nationalistic campaign. Republika Srpska’s Centre Information was part of the orchestrated and long-term campaign from Republika Srpska directed against judiciary of B&H. By his acts, President Tegeltija has joined to this campaign. He politically instrumentalized the Council in order to carry out political requests from Republika Srpska. Although Council’s conclusions were re-formulated, external pressure of the politicians and public & internal pressure of the Council has already had a negative effect on the independence of the judiciary in its final effect. All in all, the ultimate effect can be described as the most severe attack on the political independence of the B&H judiciary.

Security and energy sectors’ cooperation with the civil society in Macedonia – friends or foes?

The cooperation between civil society and state institutions is an important segment of the reforms the candidate countries have to undertake in order to comply with the EU accession criteria. Moreover, it is one of the crucial corrective roles civil society plays in democracies. The Republic of Macedonia, a candidate country for EU membership since 2005, has undertaken a number of reforms to improve its dialogue and cooperation with civil society. In this line, the Government created a Strategy for cooperation of the Government with the civil society in 2007, succeeded by a new Strategy in 2012. However, experience shows that the implementation varies from ministry to ministry. Having in mind the capital-intensive profile of the energy sector and the legacy of the previous system applying to the security sector, both sectors do not have a tradition of transparency and openness. They also play an essential role in the country’s national security. All of that is considered to be a justification for decisions to take place behind closed doors. Therefore, these sectors prove not to engage themselves actively into cooperation with civil society.

Lažne diplome i pravo na privatnost

Credible media reports and resent arrests of those suspected to have been engaged in the falsification of high education and university diplomas, provoked public authorities to initiate a comprehensive review of public servants’ diplomas. However, the Data Protection Agency stated in its opinion that such review presents unnecessary “generalization” and puts under suspicion all public servants, thus violating the right to privacy and the Data Protection Law. The analysis shows that such review would be in accordance with law, would have legitimate aim and would be “necessary in democratic society”, as requested by Article 8 of the ECHR, but also by the Convention 108 and EU Charter of Fundamental Rights. The only way to achieve the legitimate aim – to detect and to prevent falsification and usage of falsified diplomas in public sector (which constitutes crime under the Criminal Law) is to review all diplomas of public servants, including those in managing positions. Diplomas are public documents, public servants act in public interest, and review of their diplomas, in a procedure prescribed by the Law, would not in any way “diminish [their] human dignity” (as Agency explained) or present unnecessary interference in their private life.

I budući da se obe ove rečenice, no s drugim prezimenom odgovornog lica isto toliko često koriste i u Rusiji, mislim da je došlo vreme da izvučemo neke poučne zaključke.

Mislim da će stanovnici Ukrajine još dugo pamtiti sumorno jutro 19. februara 2014. Požari koji još traju u centru Kijeva, zgarišta od ognjenih barikada kojima su se opozicionari ograđivali od „Berkuta“, miris krvi… Bojim se da je to prvo jutro građanskog rata u Ukrajini. Posle dugog koprcanja, radi rešavanja višemesečnog problema koji ga muči, Janukovič je juče odlučio da primeni nasilnu varijantu. U svom obraćanju građanima, on je za povredu zakona optužio lidere opozicije i na njih svalio svu odgovornost za nasilje i haos koji su juče zavladali ukrajinskom prestonicom. Tokom noćnih pregovora s opozicijom, on je od njih zatražio da se praktično odreknu Majdana. U Kijevu je zatvoren metro, a specijalci su pokušali da zatvore i sve ulaze u Kijev. Pripadnici takozvane unutrašnje vojske, zajedno sa specijalcima, celu noć su pokušavali da sa Majdana rasteraju demonstrante. Odmah ću reći, bez naročitog uspeha. No zato je Dom sindikata, mesto gde je bio štab opozicije, potpuno izgoreo. Prema nekim izveštajima, požar se proširio i na susedne zgrade.

U najkrvavijoj noći nove istorije samostalne Ukrajine poginulo je najmanje 25 ljudi a više od 200 je ranjeno, posle nasilnih sukoba u centru Kijeva. Naoružani odredi policije za razbijanje demonstracija sukobili su se sa demonstrantima opremljenim palicama i molotovljevim koktelima, u pokušaju da povrate kontrolu nad Trgom Nezavisnosti, sedištem višemesečnog protesta protiv vlade i predsednika Viktora Janukoviča. Do jutra, policija je osvojila oko trećinu gotovo ugljenisanog trga.

S druge strane, ako ste javni funkcioner, to neznanje bi moglo da ukazuje da ste zalutali na mesto na kome se nalazite i sa kojeg odlučujete o tuđim parama i tuđim problemima. Ako ste, međutim, Vesić ili Vučić, sve je dozvoljeno. I da se rugate građanima i državi, ne samo onim što činite, nego i potcenjujućim, ponižavajućim obrazloženjima.

The research “How much is invested into the fight against corruption and organized crime and are there visible results in this respect?” was established within the sub-programme of the Centre for Civic Education (CCE) Accountability and Transparency of the Government and it aims to raise awareness on the expenditures from the Budget of Montenegro and European Union funds. The specific objective of the project is to point out the investments in the fight against corruption and organized crime, as one of the key problems of Montenegro on its path towards the EU and the (in) visible results in this direction. CCE has conducted research in the period from 17 January to 6 February 2013, taking into account the funds for project activities in the field of fight against corruption and organized crime invested in Montenegro from 2007 to 2012, through the financial support received through the Instrument for Pre-Accession Assistance, as well as direct allocations from the Budget of Montenegro into the key bodies responsible for combating corruption and organized crime. Corruption and organized crime have been long lasting challenges in front of the Montenegrin way to the EU, along with an internal democratization of the country. In the fight against corruption and organized crime, it is essential to establish strong, efficient and professional institutions that will conduct this work, so that citizens of Montenegro could have confidence in the entire legal system. Therefore, the construction of these institutions include also their adequate financing, which should be a priority not only of the European Union which has been pointing out their weaknesses for years already, but also investing significantly through its funds in Montenegro for this purpose, but the Budget of Montenegro, which is nothing but a financial expression of its declared political will. Of course, it is necessary from time to time to make an assessment what are these resources, whom are they allocated to, are they corresponding to the visible results, and whether the declared political will is accompanied by track record.

Opšti cilj projekta bio je osnaženje ličnog integriteta mladih u Crnoj Gori uzrasta od 14-18 godina u pogledu povećanja njihove spremnosti da prijave koruptivna djela i da se ponašaju u skladu sa zakonom. Specifični cilj projekta bio je unaprijeđenje svijesti mladih o važnosti spriječavanja koruptivnih radnji, putem šest interaktivnih teatarskih radionica kod najmanje 150 crnogorskih srednjoškolaca/ki, utičući na podizanje svijesti najmanje 2,000 učenika/ca. Ostvareni rezultati: 1. Osnažen integritet, smanjena spremnost na korupciju i povećana spremnost da prijave korupciju kod 150 učenika/ca, učesnika/ca teatarskih radionica. 2. Podignuta svjest o korupciji kod 2000 učenika/ca srednjih škola. 3. Unaprijeđena svijest o važnosti podrške mladima u procesu borbe protiv korupcije.
