Europe is part of a globalized and interconnected world where international mobility is expected to increase. the current european union (eu) legislation, after entry into force of Lisbon treaty, is facing new challenges in the field of the area of Freedom, Security and justice. there is a significant Europeanization of migration policy. the Western Balkan (WB) region is considered as one of the most interesting and challenging regions in europe regarding the current migration flows. the last eu enlargement shifted the migration from classical working class immigration, to the so-called brain drain immigration, since now younger and highly educated people tend to migrate more in other countries to pursue their professional career. the eu eastern enlargement and WB migration may go in the same direction. the present article aims to identify the eu legal migration policy for the WB nationals when they decide to enter and/or work in the eu territory legally, pointing out that decision as a challenge or as an opportunity for WB citizens.

the author constrasts the normativity of europe with the center-periphery issue. He argues that the normativity of europe has been challenged by the center-periphery problem. In the first part of the article, the author discusses the normativity of europe and proposes a new concept – embeded normativity. In the second part, he presents several theories on the center-perifery relations and stresses the relevance of structural assymetries. In the third part, Central and eastern europe is compared to Latin america in three historic sequences. the last part is a summary of the arguemts and their relevance for the present crisis that can be understood as an ensemble of structural and systemic tendencies.

Uwarunkowania kształtowania priorytetów polityki zagranicznej Unii Europejskiej wobec państw Azji Centralnej po roku 2012

Central Asia is not a priority for the European Union. Relations with the states in this region were established immediately after the former Soviet republics won independence but, despite attempts at rapid advancement there, the results of mutual cooperation and mutual commitments have been unsatisfactory. The objective of this paper is to analyze the priorities of the European Union’s policy towards Central Asia after 2012. These priorities are viewed from the regional and national perspectives. The analysis studies a comprehensive range of legal documents to establish the framework of mutual relations and the broad range of mutual political declarations. The key elements of this analysis involve examining the determinants that have shaped the political priorities, the institutional mechanisms established for the purpose of political decision-making and the conduct of collaboration. The paper also looks at the main challenges faced in those areas of cooperation that are deemed crucial. The final part of the analysis leads to conclusions that make it possible to assess how feasible it is to implement EU policies in relations with Central Asian states.

Zakaz dyskryminacji w zatrudnieniu w świetle prawa Unii Europejskiej

The subject of this article is anti-discrimination regulations in European Union. It examines the legal basis of the non-discrimination and equality regarding to the area of employment and occupation. The regulations against workplace discrimination are included in the primary and secondary sources of European Union law. European directives enacted on foot of the article 19th Treaty on the Functioning of the European Union are fundamentals for working against discrimination. These directive forbid discrimination based on race, ethic, origin, religion, belief, disability, age, sexual orientation and other listed grounds at hiring, firing, job advertisements and other terms and conditions of employment. This article contains an analysis definitions of direct and indirect discrimination and another prohibited way of treatment having its definition in European directives. It also shows the case study of the European Court of Justice in this field.

EU, Russia, Georgia, Ukraine – analysis and forecast

The European Union as a political and economic union used to be based on the increasing integration. But after the integration processes that took place in 2004 and 2007 the most of EC member states expressed concerns about the EU enlargement. In 2004 the concept of integration without enlargement evolved. This concept has been reflected in the ENP and its subsequent regional addition, known under the name of the EP. The critics of EU enlargement argued that from the geo-strategic point of view EC foreign relations and EC neighborhood was less important to Europe. However, the European Neighborhood Policy and the EP have become a subject of growing interest for the partner countries. EC neighboring countries perceive EC to be a major player in terms of both economical empowerment and security. In addition, EC neighborhood initiatives became especially important after the document "Evaluation of EU external relations" was released . The "reliable strong global player" status of EC depends on whether EC will be able to positively influence the neighboring countries and the world security. Partner countries and the researchers came to the conclusion that the ENP failed to meet the expectations – starting from its introduction in 2004, since it became obvious that bipolar disorder syndrome between the EC and Russia was intensifying. Consequently, in 2009 the EC developed a new program for the Eastern Part-nership, as an ENP further eastern dimension. EaP – this is a bilateral and multilateral political initiative that is focused on 6 neighboring countries of Eastern Europe. This group includes 3 South Caucasian countries - Azerbaijan, Armenia, Georgia and Belarus, Moldova, Ukraine. Out of these states Armenia has a strongly pro-Russian orientation, Azerbaijan plays both ends, the same is true for Belarus, hence, Georgia, Moldova, Ukraine remain strictly of pro-European orientation having Russia as a main obstacle in its way. Russia now presents itself as an aggressor, which strives to restore the soviet empire, subordinate neighboring countries, create a structure such as the CIS or the Euro-Asian Union, which will oppose the EU and control the eastern states rich in natural resources and with huge markets, thus allowing Russia to dictate the policy course to the Western states.

Normative Regulation of Banking Union in European Monetary Law

The subject of analysis in this study is the identification and analysis of the normative framework of a future banking union in the Economic Monetary Union. In this sense of the word, the research emphasis is on the issues concerning the need for establishment of a banking union, the prerequisites that must be met in both the national and the EC law, the advantages and disadvantages of using this supranational coordination mechanism of economic policy and its functions in terms of financial and economic disorders. In next paragraph, attention is paid to the new tasks of the main EU institutions in the process of implementation of the banking union, primarily European Central Bank, European Commission and European Parliament, where a general conclusion notes a need for their active role in implementing the concept of a banking union would not thus preserve legal certainty and to ensure optimal consumer protection, property, rights of depositors and conservation of overall economic stability.

Different implications of media ownership on democratic capacity of Serbian society in the beginning of the new millennium are analysed in the paper. The frame of the research is democratic and market model of media policy which was established after political changes in Serbia in 2000. The aim of the paper is to identify the main problems of media ownership in Serbia in the process of adjustment to the European media policy. In order to understand the genesis of marked problems, they are observed in the context of current trends on wider – global – media market. It can be concluded that democratic and market model of media system does not guarantee the conditions for democratic public discussion and satisfaction of public interest.

This article analyzes the attitudes of the Russian Orthodox Church and the Roman Catholic Church on Europe and European integration, through the activities such as the writings of Bishop of Vienna – now Metropolitan of Volokams – Hilarion Alfeyev and cardinal Joseph Ratzinger-Pope Benedict XVI. Furthermore, it perceives their reflection on moral pluralism, the role of Christianity in foundation of modern Europe and in process of European integration as well as their attempt in establishing the creative answer to militant secularism. The culmination of the cooperation between the two churches was the joint Catholic-Orthodox forum in Trent in 2008 and joint declaration of prolonging family values in European Union.

Handel usługami w krajach Unii Europejskiej – analiza typologiczna

In her study, the author presented a typology of the European Union countries based on the criteria related to value of exports in the selected service industries and on their share in the total value of services exported from the EU. The research was carried out with application of the method of comparative analysis, while the typological groups of the European Union countries were selected by the Ward’s method. The author pointed out to high sales particularly in the highly developed states of Western Europe as well as to the prevailing importance in the structure of both exports and imports of services, in all the service industries in question, of Germany and the United Kingdom. She also ascertained that the new European Union Member States from the region of Central and Eastern Europe have so far not specialised to any significant degree in trade in services.

Wpływ cen i polityki cenowej państw Unii Europejskiej na import równoległy produktów leczniczych

Objective: to explain the notion of parallel imports in the market for pharmaceuticals, to describe the processes of its functioning and to present the mechanism of impact of the price for medicinal products and drug policy of the European Union member states on parallel imports of medicines. Result: the factor causing the phenomenon of parallel imports is the price difference of the same medicines in various countries of the European Union. For example, in Germany, the United Kingdom or the Netherlands, prices for pharmaceuticals are considerably higher than in Greece or Spain. Conclusion: differences in prices for medicines in individual countries of the European Union and the phenomenon of third degree price discrimination are the direct and main economic reasons enabling the occurrence of parallel imports of medicinal products.

The main functions of the state border, such as barrier, filter, contact are studied. It is proved that currently there is activation of contact function of the state border. It is underlined that the Ukrainian-Polish border is characterized by processes of contact function strengthening. Origins and political aspects of the formation and development of the Euroregion “Buh” in the Ukrainian-Polish border; the positive impact of cross-border cooperation within these structures on the socio-economic development of border areas; the prospects and ways of further intensification of Ukrainian-Polish border cooperation and positive effects from increased contact functions of the Ukrainian-Polish border are studied.

UNIJNY MINISTER SPRAW ZAGRANICZNYCH W TEORIACH UNII EUROPEJSKIEJ PERSONIFIKACJA WSPÓLNEJ POLITYKI ZAGRANICZNEJ I BEZPIECZEŃSTWA?

The post of the Minister of Foreign Affairs of the European Union (EU) is one the greatest innovations led by the Treaty Establishing the Constitution for Europe. Thanks to ‘double hat’ he will be able to act both in the first and second pillar of the EU. The aim of this paper is to answer to the questions of the future position, character and the point of its establishment in the institutional construction of the EU. Can he become ‘one face and one voice’ of the member states at the European level? The first part of this paper contains the instruments of the future Minister established on the basis of the Treaty Establishing the Constitution for Europe and the assumptions of the following theories of the EU: neo-functionalism, interngovernmentalism and fusion theory. In the second part on their basis the Author analyses possible developments of the newly created post. In conclusion, according to the presented theories, taking into account their assumptions of importance of institutions, relationships between them and the attitude of the member states to the process of political integration of Europe, the Author gives three directions of evaluation of the post of the common Minister of Foreign Affairs of EU.

POLSKA A EUROPEJSKA POLITYKA SĄSIEDZTWA

During its EU pre-accession period, Poland monitored the development of a new post enlargement EU external relations policy. Poland proposed its own vision for the relations after the enlargement of the EU, stressing the need to define new relations with eastern neighbours. The proposals dated before 1st May 2004, the formal date of membership and the right to participate in the decision making process, focused mainly on the need to intensify relations between the EU and Eastern European states and create the EU eastern dimension in the future. Poland supported and wanted to be actively involved in the process of political, economic, and social integration between countries in the south Mediterranean area with the EU, at the same time it treated the „Mediterranean Dimension” to be an important component strengthening cooperation and security architecture. However, Poland clearly stressed its interest in becoming an active player in shaping the EU Eastern Dimension. While following the process of developing the EU Neighbourhood Policy, it is worth considering its place in the Polish foreign policy, Poland’s position in the area concerned, and possible suggestions to make the policy more effective. It is also worth considering whether the vision of future EU external relations with neighbouring countries coincides with Poland’s foreign policy objectives and goals, and whether cooperation forms proposed by the EU can be considered sufficient.

The text A Preliminary Assessment of the Spanish Membership in the European Communities is an attempt to analyse what Spain has gained and lost since 1986 when it jointed the Communities. The author is trying to find out whether the membership, which had been the priority of the Spanish diplomacy at least since the beginning of democratisation processes after Franco’s death (1975), is still advantageous for the country. He is also trying to find out whether the Spaniards still believe in the EU as a factor to fortify the democratic institutions of their country, to modernise the economy and to achieve inside and outside security.

The criterion of effect on trade between Member States has served, for more than half a century, as the dividing criterion for the application of national and EU competition law, respectively. This criterion, which has gone through both expansion and contraction and then further expansion in terms of its scope of application, is gaining importance with time, due to the ever-greater substantive and procedural consequences of the applicability or inapplicability of EU competition law. The only way in which this crucial question will be placed under a solid framework is if the relationship between national and EU competition law were determined beforehand, something which, to some extent, the new Directive on Damages Actions, currently in the final phase of adoption, aims to do.

Координативни ефекти вертикалних концентрација у праву Европске Уније

In this article the author focuses on the coordinated effects of vertical concentrations, because vertical concentrations can be anticompetitive if they result in either foreclosure or enhanced coordination. The author points out that some vertical concentrations might facilitate upstream collusion among producers when selling to downstream firms, and gives short review of the economics of such effects. Therefore, the article reviews some of the provisions of the EU law concerning the coordinated effects of vertical concentrations and provides conditions under which vertical integration facilitates collusion between undertakings.
