Corruption and Trafficking: Monitoring and Prevention titles the new brochure, recently published by the Center for the Study of Democracy of its Reports and Analyses series. It is the first analytical output of the newly founded Expert group on corruption and illegal trafficking as part of Coalition 2000 anti-corruption activities. The phenomenon of illicit trafficking has become one of the most important sources for the “shadow economy” in Bulgaria throughout the 90ies. Its growth was caused by a number of international and internal factors as well; the most crucial of which is the weakening of the post-communist state and the spread of corruption practices among state officials. Hence the emerging of the criminally interwoven corruption/trafficking involve state officials (policemen, customs officers, senior civil servants and politicians) on the one hand, and semi-criminal groups and local mafia on the other. Bulgarian “contraband channels” also constitute a part of the wider network of transnational crime. In the forthcoming brochure, however, the emphasis is on Bulgarian trans-border crime, rather than on its international ramifications. The brochure is composed of three parts: - an analysis of trans-border crime in Bulgaria during the 90ies; - a review of the sociological and statistical methods of measuring illicit trafficking; - Practically oriented proposals with the aim of curbing corruption and trafficking.

Corruption is one of the most pressing issues in Southeast Europe, because of its detrimental impact on the social and economic development, especially during times of economic crisis. At the same time the capacity of the civil society organizations to monitor this phenomenon, propose and implement policy change remains low. To address this issue, in November 2012, 17 civil society organizations from Southeast Europe formed a coalition aimed to contribute to a dynamic civil society in the region, capable of participating in public debate and influencing policy and decision-making process in the area of anti-corruption and good governance. The SELDI Strategy and Action Agenda for Good Governance and Anticorruption in Southeast Europe aims to serve as a blueprint for CSO coalition building, as well as a value statement, which can be used to attract new partners and to inform and motivate other stakeholders. In addition the Action Agenda puts a focus on improving the environment for civil activism and state-civil society dialogue at regional and national level, on which CSOs and other stakeholders will agree to act upon.

Scientific conferences entitled “ Szubert Seminars”, organised at the Faculty of Law and Administration of the University of Lodz, have a long tradition. These meetings have two main goals. The first, is to show the multifaceted achievements of an outstanding and recognized researcher of social policy and labour law – Wacław Szubert. The second, is to pay attention to the universality and timelessness of the observations made by this author. His opinions can be an important hint for all researchers currently dealing with employment issues, counteracting unemployment, social insurance, health care and social economy. The variety of topics covered in this book shows the complexity of the relationship between labour law and social policy. Both areas of science benefit from the fact that their representatives conduct research in close cooperation. Thanks to this, social policy becomes the basis for building the axiological assumptions of labour law institutions. Labour law, in turn, provides tools for verifying the objectives and tasks defined by social policy, as well as the ways of their implementation.

The three-volume monograph offers a comprehensive study of the category of freedom which was used in the legal and political doctrines by representatives of the western civilization since antiquity up to the present. The publication reviews concepts put forward by ancient thinkers (Plato, Aristotle, the Stoics, Cicero, St. Augustine), propositions of philosophers active in the Middle Ages (St. Thomas, William of Ockham) and the most prominent theories of the Renaissance (Machiavelli, the Renaissance utopias, Reformation, the School of Salamanca). The Polish Renaissance thought has also been presented. It ushered in an antiquity tradition revival which manifested itself in treatises in 16th-century republican discourse and, in a developed form, in the works of Andrzej Maksymilian Fredro. The monograph also includes interpretations of Thomas Hobbes’s, Algernon Sidney’s and John Locke’s propositions as well as a study of the thought of Montesquieu together with a discussion of the theory of the separation of powers, especially with regard to the trias politica model from the perspective of constitutionalism. The review of numerous philosophical positions reveals a range of discrepancies in the perception of the concept of freedom not only in different historical periods but also among the representatives of the main political doctrines. The plethora of cited approaches unequivocally points to the interdisciplinary character of research on freedom as a philosophical category. Therefore, a presentation of the spectrum of differences through the application of scientific analysis seems a fundamental prerequisite for any attempt at arriving at a comprehensive and multilevel understanding of the idea of freedom.

The publication presents a critical view on various institutions of electoral law and their functioning in the context of the 2018-2020 elections and the accompanying changes to the law, as well as the situation caused by the pandemic and the problems resulting from the organization of the free elections in extraordinary conditions. The authors analyse classic electoral law issues such as the principles of electoral law (the principle of free elections in particular), citizens’ electoral rights, electoral bodies, the election process, the election campaign, election control, or legislative silence. Many texts, whose authors are young researchers in constitutional law from different academic centres, contain the assessment of legal regulations in force in Poland in accordance with international standards, especially those set by the Council of Europe, as well as the de lege ferenda demands, which aim at improving existing electoral procedures and ensuring that the elections to representative bodies are fully democratic.

The principle of the best interest of the child has gained widespread recognition. It is universally applied in adjudication by courts, tribunals, administrative authorities and legislative bodies in cases concerning children. This book aims to investigate what is behind the meaning of this term from the perspective of the philosophy of law and the political philosophy as well as in light of international and Polish law. Nietzsche famously argued that there are two opposing elements: Apollonian and Dionysian. Apollonian aspect represents the individual, order, rational thinking, logic, and law. The Dionysian element represents nature, unconsciousness, instinct, chaos, urges – there are no rules. According to the philosopher, everything and everyone consist of both Apollonian and Dionysian elements. This classification offers an insightful perspective on the subject of this book and is a thought-provoking starting point for the topic of child’s best interest, but also the notions of good and common good. Each matter is approached from the philosophical and legal angle.Although there is no clear and undisputed definition of the best interest standard, there are some factors that need to be considered. In all actions concerning children their particular interests have to be taken into consideration, along with moral and ethical aspects. At the same time, the child is a part of a community – the family, the society, and the state. Therefore, the communal angle of what is good for a child must always be considered as well.The main finding of the book is that there needs to be a balance between the individualistic and communal aspects while interpreting what is good for a child. Therefore, the balancing act is also necessary for interpreting what is best for a child – otherwise, the standard is set up to fail.

The publication attempts to reconstruct and analyse the concepts of transnational structures in French political and legal thought from the Enlightenment to modern times. The author argues that key modern concepts of substituting or limiting state sovereignty towards transnational power structures originate in the Enlightenment and 1789 French Revolution. Referring to the extensive subject literature, he demonstrates that in France, traditionally associated with statism and the affirmation of national sovereignty, there is a wealth of entirely different trends. France can be considered a kind of “bastion” of revolutionary universalism, from which many radicals, regardless of their nationality, derive directly or indirectly.

Korespondencja dyrektyw redagowania i interpretowania tekstu prawnego

Legal interpreters assume, inter alia, that the legislator consistently applies the concepts throughout the entire legal act, and that they do not introduce any unnecessary fragments into the text (prohibition of per non est interpretation). Do such interpreters' assumptions accurately reflect the way the legislator works? And do the persons handling the legislative process employ in their work tools with which the law will then be read? In order to find the answer to this question, the author has analyzed the applicable legislation and has undertaken socio-legal research, using the methods of text analysis, participant observation and in-depth interviews with legislators working in the Legislative Office of the Chancellery of the Sejm of the Republic of Poland. The results of his research and the conclusions derived from it are presented in the monograph titled Korespondencja dyrektyw redagowania i interpretowania tekstu prawnego. [Correspondence of the Directives for Drafting and Interpreting a Legal Text].
