The paradigm of law in normative space makes it possible to develop a distinct view on many issues related to the traditionally understood areas of scientific reflection on law. When analysing the relations between law and the normative sphere (normative environment) today, the phenomenon of a normativity form and its characteristic features in a postmodern society deserve special attention. The question of the form of normativity is complementary with the question of whether and how the changing and distinctly shaped forms of normativity articulation affect the law, and lawmaking in particular. The normative environment and normative space, which are subject to their own dynamics, generate a broader discussion about law and its evaluation which includes another, “non-state law” as well as what the author refers to as the “normative sources of law”. Therefore, the discussion extends beyond the strictly-defined domain of systemic relationships which has become well-established over the years. One detailed and very important problem is that, in the field of discourse and normative content presentation, statements appear which not only relate to the individual elements of normative space, but also exhibit the characteristics of “normative claims”. In a reality characterized in this way, law is a bridge connecting “normative claims” with normativity external to the law.

The usefulness of publishing the study discussed here is unquestionable and twofold. It consists in the inclusion of a summary of ten years’ work of the Student Scientific Penitentiary Group, established at the Department of Penal Enforcement Law at the Faculty of Law and Administration of the University of Łódź, and the presentation of a number of valuable and intellectually stimulating articles. Among the authors are academics, judges and other professionals associated with the judiciary. It is worth emphasizing that the authors of some of the studies are also students.

The publication deals with issues from the field of copyright law as not yet described in the form of a monograph. The claim for payment of multiples of the respective remuneration for infringement of author's rights, regulated in Article 79, paragraph 1, subparagraph 3, b) of the Act of 4 February 1994 on copyright and related rights has undergone radical transformations in the last 5 years. The current wording and interpretation of the provision has been influenced by judgments given of the Constitutional Tribunal, the Court of Justice of the European Union and the Supreme Court. These rulings are described and assessed in detail in the monograph. A number of new arguments in favour of re-examination of the issue and in favour of maintaining the claim for payment of a multiple of the respective remuneration in copyright law, constituting the main instrument for protection of authors and other rights holders, were also presented. The monograph includes, inter alia, an overview of Polish acts regulating lump-sum damages and an analysis of the legislation of 47 European states within the scope of the claim being analysed.

Years of academic deliberations on labour law in Poland at the heart of which I see the “scientific study of law” have led me to the sad conclusion that it is probably impossible to confirm the existence of a real scientific approach to this kind of law. It seems that this scientific approach does not comprise a coherent system of views on the issue of labour, at least at its core. As a consequence, it does not have much to offer legal practitioners who, in a desperate search for solutions to the real current problems in everyday work, are left to their own devices when it comes to dealing with legal issues. In fact, it could not be otherwise, bearing in mind that the academic approach to labour law in Poland can “boast” merely a collection of loose, frequently pseudo-scientific ideas, as they do not in fact rely on any solid theoretical findings. Even worse, nobody is obliged to take responsibility for this situation. As a result, this kind of scientific approach, especially in relation to labour law, where whole societies are affected, bears consequences whose seriousness cannot be underestimated. This publication is unfortunately only of an introductory nature, as the exhaustive analysis of labour law is the kind of task that not only requires years of academic work but, more importantly, should be a joint effort, which again, in the Polish social context of academic activity, would be something rather exotic. Having published a monograph on the axiological basis of Polish labour law, therefore having a clear understanding of the kind of values this labour law focuses on, I would like to reflect on the theoretical dimensions of the system of labour law norms. I also view all my previous efforts to study the particular problems related to this issue presented in various articles that I have published as mere preparation for the task in hand.

This monograph provides a historical overview of the justifications for freedom of contract, which was developed in the Medieval study of canon law, its impact in the modern era and its relevance for present-day discussions on the freedom of contract. Canonists were the first in the Western legal tradition to put forward solutions for private law that reflect the contemporary model of freedom of contract. To support their concept they used three arguments: the first was rooted in the authority of the sources of law available to them at the time; the second imposed an obligation to abide by the rules of the contract stemming from the concept of a sin of breaking one’s promise; the third was related to the importance of the concluded agreements for strengthening social order. The argumentation used in the Medieval teaching of canon law has met with various receptions in the modern era. Some movements took it on board (the canonists, the second scholasticism), some others rejected it (legal humanism), while for others it served merely as a useful example (Dutch jurisprudence, usus modernus Pandectarum), and ultimately it was functionally similar to some (the school of natural law). As a result of the establishment of a general theory of contracts at the turn of the eighteenth and the nineteenth centuries, which presumed the freedom of contracting, the question of the binding power of the concluded agreements lost its relevance. The answers to this question can be found by referring to the forgotten Medieval canonist tradition or the English theory of contract. Both these sources provide similar arguments, which can be useful in the discussion on the limits of the freedom of contracts alongside legal dogmatics.

Le projet avait pour objectif principal d’étudier la réglementation relative à la protection des personnes qui divulguent les irrégularités et les violations du droit dans des entreprises et dans d’autres institutions privées et publiques dans des États faisant objet de l’étude, ainsi que de montrer les problèmes et de proposer des solutions juridiques liées à la transposition de la directive de l’Union européenne 2019/1937 du 23 octobre 2019 sur la protection des personnes qui signalent des violations du droit de l’Union dans la législation nationale.La publication présente, entre autres, une analyse de l’étendue des questions pouvant faire objet de signalement, de personnes qui peuvent être considérées des lanceurs d’alerte et bénéficier de la protection liée à la divulgation des violations et d’autres entités couvertes par la protection en raison de leur lien avec le lanceur d’alerte, de procédures et canaux internes et externes de signalement des violations de mesures de soutien juridique des lanceurs d’alerte dans leur activité et de leur protection contre les représailles pour divulgation d’informations, de la confidentialité de leur activié, de la responsabilité juridique pour les représailles ou la violation des obligations à l’égard des lanceurs d’alerte.La recherche susvisée a été coordonnée par l’Université de Lodz, la faculté de Droit et d’Administration en coopération avec l’Université Charles à Prague, l’Université de l’Église réformée Gáspár Károli en Hongrie, l’Université de Maribor, l’Université de Tours et l’Université de Trnava à Trnava ainsi qu’avec la participation des représentants d’autres centres scientifiques, institutions publiques, partenaires sociaux, organisations de société civile, entreprises et praticiens du droit.Le résultat global de la recherche réalisée dans le cadre du projet est présenté dans le livre « Towards a Better Protection of Workplace Whistleblowers in the Visegrad Countries, France and Slovenia » publié par la maison d’édition de l’Université de Lodz.Cette publication s’adresse à tous ceux qui s’intéressent aux mesures ayant pour but d’améliorer la situation juridique des personnes qui signalent des violations du droit au travail.The project is co-financed by the Governments of Czechia, Hungary, Poland and Slovakia through Visegrad Grants from International Visegrad Fund. This monograph is an outcome of research completed within the Visegrad Grant “Workplace Whistleblower Protection in the V4 Countries, France and Slovenia” – WhistlePro (2020–2021), financed from the International Visegrad Fund. The project aims to contribute to the improvement of the legal framework in the Visegrad countries concerning the protection of workplace whistleblowers and, indirectly, to the change of workers’ attitudes towards whistleblowing.Contributions prepared by legal experts from various countries and universities concern matters of universal importance such as freedom of expression relative to whistleblowing, personal scope of the EU Whistleblower Protection Directive (2019/1937) or personal data protection. They also discuss the legal situation concerning whistleblower protection in the Visegrad countries, France and Slovenia and present recommendations for changes in the respective countries. The monograph entitled Public-law aspects of the participation of the SME sector in the process of achieving strategic goals of development policy is the result of the research by an international team of scientists from Poland, Spain and Chile. The issues covered by the analysis relate to activities with the highest priority from the point of view of socio-economic development, namely combating climate change and facing the challenges of digitization. Barriers to the use of the Digital Single Market mainly concern small and medium-sized enterprises, which are the dominant group of entities actively operating in the economy, and their activities and expenditures on innovation have a direct impact on the implementation of strategic development goals. The authors of the study, analyzing the provisions of EU law and national law systems, attempted to identify legal and administrative barriers to SME, to assess the effectiveness of existing support tools, to identify areas requiring intervention by the EU or national legislator, and to formulate de lege ferenda proposals for more effective support for SME. The monograph includes texts prepared in Polish and Spanish with extensive translations of their summaries.

Public-private partnership is both a fascinating and frustrating area of research. PPP is not a simple recipe for financial shortages experienced by public entities; it is a complicated mechanism that requires meeting many conditions to function efficiently. The authors present their thoughts and conclusions against the background of the existing state of knowledge about PPP and assess the level of institutional maturity of PPP in the context of public support for this formula in Poland. The monograph consists of six chapters. The first and second chapters constitute the theoretical foundation, describe the genesis and institutional conditions of public-private partnership, its subject, specificity, significance, and financing of PPP. The next chapter presents the state of the PPP market and the requirements for its development; it starts with an international framework to analyze the number, value, and areas of PPP application, then describes the situation in Poland against this background. The authors also investigate the success factors of public-private partnership projects. The fourth chapter is devoted to the issues of regeneration. The authors synthesize it and then present the historical conditions for developing PPP in regeneration in Great Britain to deliver Polish solutions and problems in this field. Chapter five, describing transport solutions in the PPP formula, has a similar practical dimension. The authors focus on the road, transport projects, and transport-related infrastructure, referring to British and Polish solutions. An extensive summary of the considerations carried out in work can be found in chapter six. The monograph ends with a synthetic conclusion.

The Models and Techniques Used in Family Mediation in England and Wales

Over the past forty years, the approach to legal disputes in England and Wales has experienced some important changes. In many instances, mediation, with its objective of resolving disputes, is favoured over the traditional and adversarial procedure of litigation. Intriguingly, the perspectives of mediators on the practice of family mediation are relatively unexplored territory. This book with its focus on family mediation seeks to reduce this gap by supplementing the existing literature. It will put forward the family mediators’ opinions and my recommendations on how family mediation can be improved from the perspective of models. It aims to contribute, through the practitioners’ lens, to some of the important theoretical issues, discussions and difficulties surrounding family mediation. In addition, the aim of this book is to set out the understanding of family mediators and draw on this to explore important themes such as mediation models, their principles and the nature of the task. The analysis of these themes will reveal many things, from the difficulties and demanding tasks in family mediation, to the satisfaction and reward that can be felt by family mediators who achieve the parties’ objective of amicably resolving a family dispute.
