CONTEMPORARY THEORIES ON TERRORIST VIOLENCE: FROM DISTORTED COMMUNICATION TO SYMBOLIC EVENT

The present article departs from the traditional approach of terrorism through its predominantly physical component and insists on the idea that, however intense and cruel it may be, the category of violence usually associated with terrorism is not an end in itself. The primary intention of this study will be to rethink terrorist practices as communicative practices, however traumatic and offensive the message communicated through them might be. The overall purpose of such a refashioning is not to make the experience of pain and death, usually inflicted by terrorist agents, less important. The finality of such an action would be that of increasing the chances of understanding terrorism from a perspective that differs from the conventional approach (political, mediatic) of the matter: the paper proposes a deciphering of the meanings assigned to the (recent) acts of terrorist violence by philosophy (Jürgen Habermas, Jacques Derrida and Jean Baudrillard).

Eastern European immigrants coming to the UK since 2004 (in 2/3 from Poland) by their amount of work have concurred to serious growth of the GDP. But simultaneously they have been burden for British welfare system (among others by taking benefits for family members living outside the UK) and taking job even for minimum salary what have caused growth of native British unemployment. In this situation Conservative-Liberal Government leading by David Cameron have decided to limit an access to the UK labour market by language knowledge tests and tightening social benefits policy to job seekers. With informal support of main opposition parties (i.e. the Labour Party and the UKIP) D. Cameron have taken risky game showing he has been able to fight for his nation’s interests even in spite of huge protests of Polish and other Eastern European countries politicians and against the European Parliament resolution of 16 January 2014. But when turning out into a defender of Britons’ rights he also has showed that there have been deep divisions between “old” and “new” Europe still after 10 years of the EU’s biggest enlargement in 2004.

Europeanisation and Internationalisation of LGBT Rights in Poland

The development of the civil society in Poland post-1989 has put the LGBT movement on the map of the country’s social landscape. As a corollary, it has also led to a greater social engagement of the non-heterosexual community striving for recognition of its demands. The establishment of the Campaign Against Homophobia (KPH) and the spread of the Internet in Poland have raised the Polish society’s awareness of the LGBT movement and made it part of the country’s political discourse. On the other hand, the perceived threat to the established conservative values of the Polish society has galvanised the opponents of the non-heterosexual community and its demands. The resulting dispute between the supporters and opponents of the LGBT movement and its professed ideas has placed the issue on the agenda of the Polish political parties.

The concept of discourse has acquired many meanings in everyday language and the discourse of experts claiming various fields. In our case it is the legal field, an area to which this paper is devoted. Law is a discipline that is directly concerned with the theory of speech acts whose promoter was J. L. Austin.

The paper reveals the formation of the concept in Bulgaria’s laws in the period 1878–1912, related to the stimulating the settlements in the country. Starting with the Constitution, the author examines some basic laws connected with the implementation of this aim such as the Law on Population of Uninhabited Lands in Bulgaria (1880), the several versions of the Law of Acquisition of Bulgarian Citizenship as well as the legislation connected with the settling of the refugees. Particular groups of laws were targeted to different categories of population abroad with regard to attracting them to the Bulgarian Principality. For the realization of this policy the legislators set out mainly encouraging measures of economic and political nature, with the dominance of those of economic character. The main tendency in reflecting this political concept in the envisaged laws was to gradually expand the opportunities for attracting potential settlers to the country. Nevertheless, there was a marked inconsistency in the implementation of this trend by the government. This was mainly due to the lack of convenience among the ruling circles about the necessity of this type of policy and its enforcement through the existing legislation in the country at that time.

The article provides translation of key titles postulating the interdiction “contra iustitiam iudicasse” in Lex Romana Visigothorum. The author commented on the way in which specific norms and texts are derived from the Theodosius Code, guarding the fair private and public law relations, and embodying this prohibition “to adjudicate against justice”. The focus is on the concepts of the ancient Roman iustitia, defined through its connections with the grounds of mos maiorum (the customs of the ancestors), with ancient Roman valour (virtus Romana), with freedom (libertas), with civil and personal dignity (dignitas), with the community benefit (communis utilitas) and with the common good (bonum commune), with justice and law (ius and lex), Whose ultimate goal is the just retribution of “giving each one his own” (“suum cuique tribuere”). The article also analyzes the complex metamorphoses that Roman legal moral concepts of justice and valoуr underwent (iustitia и virtus), following the transformations in the Roman values system and in the perceptions of Romanitas, accompanied by the processes of barbarisation and reception of Roman law (ius Romanum) after the fall of the Western Roman Empire in 476.

The information is collected from Codes of bishoprics record books of Bulgarian parishes and correspondences from the National Revival press. The study shows that regulations and orders issued by all institutions of authority, suggesting the existence of a common vision for the development of society. The main goal of the requirements is to establish a balance in relations by freeing poorer families from the financial burden of the wedding.

The object of the researching is analysis of law providing of implementing of Customs Control of passenger traffic in Customs Air Check-points according to requires of international and Ukrainian laws.The issues of providing of international passenger and freight traffic safety are especially important in conditions of increasing threats. Visa liberalization between Ukraine and countries-members of EU provokes demand to work out new tools-bar of Customs Control to be used in the field of increasing international passenger traffic by air. Developed countries’ experience of implementing of control on passenger traffic by air shows the high level of using of risk-oriented Customs Control Tools. These tools are ordered to defying and neutralizing of foreign trade threats, on the one hand; and providing of simplification of Customs Formalities, on the other hand.Analysis and Management Risk System exists in Ukraine today. It is an effective tool of Customs Control, and it provides minimal involving of Customs Authorities into operational activities of all participants of International Providing Chain. In fact, functioning of single module ASAMR in Customs Air Check-points is regulated by law, but is not used in practice. The bill on Changes into Customs Code of Ukraine (on authorized economic operators and simplified of customs procedures) forecasts implementing of Previous Informing System, which is a main condition of effective functioning of Management System.

The purpose of this paper is to investigate issues related to the functioning of the police in a state of law, particularly in the area of human rights, freedoms and legitimate interests of man and citizen action using legal measures intended to maintain a stable law and order in the country, the fight against crime and other offenses.The article is devoted to the role and place of law enforcement in the state of law. The article deals with the problem of disclosure of the activity of law en- forcement bodies in the struct ure of state organs, directed to the creation of a legal democratic society, strengthening of law and order, and legality, protecting the public and personality from the vi olation of rules of law. Unlike other systems of government, the system of law enforcement does not have the traditional organizational structure, such as the system of executive power, but a coherent set of systems forming factor which is not structural (organizational), and functional criteria - directly to law enforcement, that defined their common functionality, which is mainly in the protection and enforcement. Therefore, system-factor law enforcement is law enforcement, for which the state creates law enforcement.

During the 17th and 18th century the Ottoman state implemented various mechanisms to organize the system of public order mobilizing the local resources of the province. This study aims at exploring the expanding scope of local communities’ obligations by detailed view of their role in the various stages in the treatment of criminal matters: reporting the crime/ complaint; arrest, persecution; the trial/investigation; punishment. The elaboration of the local social microstructure and the development of new social relations represented by the emergence of the local communal elites had a clear repercussion on the development and upgrading of different socio-legal mechanisms in the context of the administration of the public offences. These competences of the local communities were a result of a long evolution and they became of key importance in the context of the widespread brigandage during the second half of the 18th century.

The Łódź PPSY International Seminar Transitional Justice: Between Redemption and Retribution. Łódź (June 6, 2017), University of Łódź, Professor Czesław Mojsiewicz International Cooperation Fund and the Editorial Board of the Polish Political Science Yearbook.The Łódź PPSY International Seminar Transitional Justice: Between Redemption and Retribution was the first scientific event co-organized by the Chair of International Law and International Relations (Faculty of Law and Administration, University of Łódź), Research Centre of University of Łódź "The Balkans at the Turn of the 20th and the 21st Century", Professor Czesław Mojsiewicz International Cooperation Fund, Adam Marszałek Publishing House and the Editorial Board of the Polish Political Science Yearbook. The idea that stood behind the organization of the academic seminar was to analyse the current scientific and practical trends witnessed in a global discourse on transitional justice. Deliberations on post-violence efforts and all closely related topics, especially the issue of politics of memory, gathered in the Polish city of Łódź 20 researchers, coming from 7 Polish universities and 8 foreign academic centres. It is worth mentioning that participants of the seminar represented 9 different countries, such as Germany, the Netherlands, Poland, Romania, Slovakia, South Sudan, Ukraine, the United Kingdom and the United States.

The paper deals with prostitution in 18th century Ottoman society, Bulgarian lands including. Legislation on prostitution, resting both on the intransigent rules of religious law (sharia) and on the more tolerable Ottoman state law (some customary laws included), is taken into consideration. The paper is based on comparative analyses of literary narratives, “urban legends” and documentary sources from Ottoman archives related to prostitution and its persecution. The archives dating from the 18th century show that all measures (systematic and accidental) undertaken by the Ottoman authorities to combat and wipe out prostitution – mainly through imprisonment and expulsion of prostitutes and state servants caught in immoral contacts with prostitutes – had but a minimal effect. It was realized in the 19th century that prostitution is nothing but the “necessary evil” and that it is better to control through legalization of brothels and taxation of prostitutes (after the western pattern) than to apply rigorous measures, death penalty including.

The occupation of government power by a leftist party in Greece (in January 2015) has formed a new political landscape and given rise to new political expectations after a long period of administration by the so-called system parties. The left-wing party, SYRIZA, was voted by Greek citizens as a new political force that could bring new policies, as it had the ambition to solve the country’s economic problems, bring social justice and tackle the severe humanitarian crisis caused by the recent long economic crisis. Regarding the religious field, the fixed aim of leftist parties was the separation between the State and the Church, which would lead to the full independence of the State from any religious or ecclesiastical influence, as well as the seizure of church assets by the State, the obligation for the clergy’s payroll to be covered by the Church, and similar demands regarding many other issues that shape the relationship between the State and the Church in Greece. This paper investigates especially the relationship between SYRIZA and the Church of Greece during the one-year period of the left-wing government, through the official discourse and political practices of the governing leftist party. For this purpose, the left-wing government’s political practices and stance towards the “religious issue,” as they are expressed by the party’s official press medium, the Avgi newspaper, are analyzed.

Governing Catholic religious education in Italian state schools: Between the revision of the Concordat and social movements, 1974-1984

This article focuses on the redefinition of Catholic religious education in Italian state schools, from compulsory religious instruction into a non-compulsory discipline of “religious culture”, by analyzing how the issue is framed and negotiated by political, religious and educational actors between 1974 and 1984. The negotiations between governmental and Church representatives in the revision of the Concordat led to attempts at a compromise on religious education, its regime and its guarantees for students’ choices. However, social movements and school reforms forced various actors and institutions to reframe it in non-confessional, pedagogical and professional terms in public arenas. “Religious culture”, as a category promoted by teachers and intellectuals, became both a social problem and the main justification for the ownership of the Catholic Church over the problem.
