Vis Moot is the leader moot court in international commercial arbitration, by teaching of doctrine and advocacy skills through participation, devoted to the education of ‘practice-ready’ lawyers. Vis Moot is actually a moot court in which participants attend several arbitration hearings of a commercial dispute governed by UN Convention on Contracts on the International Sales of Goods (CISG), based on a specific set of Arbitration Rules, which involves learning experience relevant to professional practice for all the actors involved, such as students, judges, arbitrators, trainers, lawyers and other practitioners. The moot ensures the teaching of substantive law through the written and oral process. The first one is writing the memoranda, both for Claimant and Respondent. The oral arguments are addressing the jurisdictional issues and then the merits of the case and are prepared in advance by law students, selected for their oral advocacy skills, together with their trainer team. Decretul nr. 2015-219 din 27 februarie 2015 cu privire la soluţionarea litigiilor individuale dintre marinari şi angajatorii lor a fost publicat în Monitorul Oficial din 28 februarie 2015 şi a intrat în vigoare în ziua următoare publicării sale, în 1 martie 20151 . Litigiile individuale în curs dintre marinari şi angajatorii lor rămân supuse fostelor dispoziţii. Înaintea apariţiei părţii reglementare din Codul transporturilor, anumite articole din Decretul nr. 59-1337 din 20 noiembrie 1959 cu privire la litigiile dintre armatori şi marinari au fost abrogate, lăsând loc la numeroase incertitudini. Noul decret răspunde la marea parte a chestiunilor puse, chiar dacă îşi rezervă eventuale contestaţii. Viza Consiliului Superior al Marinei Comerciale este absentă, aşadar articolul 22o din Decretul nr. 2002-647 din 29 aprilie 2002 cu privire la compunerea sa, la atribuţii şi organizarea Consiliului Superior al Marinei Comerciale precizează că Consiliul Superior al Marinei Comerciale este obligatoriu consultat asupra proiectelor de aici şi asupra decretului cu privire la marina comercială sau la porturile maritime. Pe de altă parte, nu reglează competenţa de atribuire în ceea ce priveşte căpitanul navei.

La 23 iulie 2014, Uniunea Europeană a adoptat o Directivă care stabileşte un cadru pentru planificarea spaţială maritimă. În cadrul politicii maritime integrate, Comisia Europeană a propus legislaţiei UE (Parlamentului şi Consiliului European) adoptarea unei directive-cadru, care să combine planificarea spaţială maritimă cu managementul zonei costiere integrate. Directiva ce a fost într-un final adoptată este mai puţin ambiţioasă decât cea propusă. Managementul zonei costiere integrate, cu aspectul ei orientat puternic către mediu, a fost eliminată aproape integral. În plus, obligaţiile alocate Statelor Membre sunt definite în termeni foarte generali. De fapt, această Directivă nu aduce nimic prea substanţial din punct de vedere legal. În realitate, această Directivă ridică problema aplicării principiului subsidiar, care presupune ca UE să acţioneze doar dacă obiectivele acţiunii propuse nu pot fi atinse suficient de către Statele Membre.

Dominând succesiv industria navala după anii ’50, Japonia, Coreea de Sud şi China sunt figuri centrale ale acestei industrii. Fără a repune în discuţie statutul lor de lideri mondiali, criza din 2008 şi anii care i-au urmat au adus schimbări enorme pentru toate şantierele navale din lumea întreagă. Într-un context mondial de „şuturi comandate”, războiul lor de competivitate se caracterizează prin deplasarea activităţii asupra sectoarelor portuare, susţinute de instituţii financiare hotărâte să salveze această industrie. Restructurările şi fuziunile au avut ralul lor în această cursă a hiperspecializării şantierelor navale asiatice. Ele au permis, de asemenea, să anihileze dezavantajul asupra opţiunii către ecoshipping, care pare a fi un nou eldorado pentru construcţia navala mondială.

The book by the author Dumitrița Florea reflects the concerns for the regulation of private international law analyzed both through the lens of domestic law and the applicable European regulations in this field. The present paper highlights the study of some aspects related to private law relations with an element of foreignness, the specific sources of international law, the application of foreign law or the legal condition of the foreigner. The private international law relationship differs from the domestic law relationship by the existence of an element of extraneousness, which represents a factual circumstance related to a legal relationship due to which this relationship is related to several legal systems. It follows that the determination of the elements of extraneousness and the effects they produce differ from one legal system to another.

We humans live within this sphere and are guided by legal rules that guide our actions so that we do not cross the line of legality, and any deviation is sanctioned as such. People's relationships are not limited only to the perimeter of a country. Thanks to the possibilities offered by the technologies of the 21st century, we can physically be in a state but we can contract from a distance, we can form friendships, we can communicate, more recently in the United Arab Emirates it is even possible to divorce at a distance by sending a message from the husband , to the wife that they are divorcing, however to be effectively divorced a judge's decision will be needed. Technologies make themselves felt more and more in our lives, and we make room for them, because they make our lives easier and offer us possibilities that sometimes we cannot actually fulfill. However, the right cannot be removed, rather, it is extended by the fact that it must also cover actions in the area of technology. Law develops and evolves along with the needs of society. In the times when people with a certain citizenship are not so tied to that state, in the times when they can be anywhere in this world, can work anywhere, in all these places and not only can find happiness and get married. At that moment the physical border between the states has dispersed and that man becomes a simple man living on this earth without being too tied to a certain state jurisdiction. Today, perhaps more than ever, we need states to collaborate, to realize the necessary prerequisites so that people do not encounter legal obstacles in marrying or working in another country. A concerted effort of all legislations is needed to work out the legal aspects involved in a marriage. One of the most beautiful moments in life is getting married. As well as being a personal moment, it involves a number of legal aspects.

In the present study, we show that the principles of criminal law constitute a complex, interdependent, mutually conditional whole, each of them characterising the whole of criminal law as a whole about the principles of European Union law. We then point out that, in general, the means of criminal coercion are restricting their scope of application in favour of extending their preventive, educational and social values, through a gradual decompression of criminal law in favour of other forms of legal intervention and coercion (contraventional, administrative, disciplinary, etc.). We also stress that there are principles enshrined throughout criminal law (1865 - to date), recognised as constants of criminal law; what developments in society have promoted new ideas? Is the range of constants widening or narrowing?

By discrimination we mean that action whereby certain persons are treated differently from others or bear the restriction of certain rights unfairly, on the basis of groundless reasons. Direct discrimination, indirect discrimination, harassment and instigation to discrimination have been identified as forms of discrimination at social level. At the level of international society, preventing and combating any form of discrimination by resorting to the most appropriate legal measures represent a concern even today. The right on non-discrimination prohibits those cases whereby persons or groups of persons in a similar situation are treated differently, and situations where persons or groups of persons in different situations are treated in the same way. The aim of the right on non-discrimination is to guarantee to all people equal and fair prospects of access to the opportunities granted by the society. The discrimination’s different manifestation forms, the criteria underlying discriminatory behavior, the areas where it manifests itself and some perspectives regarding the European non-discrimination law will be presented in this study.

Over recent decades, judgments as a legal genre have received increased attention from linguists. Such a trend has contributed to a better understanding of the macro-and micro-linguistic aspects of this highly complex legal genre. However, the pragmatic aspects of judgments as a specific text type remain largely neglected in the current literature. Therefore, this paper aims to contribute to this line of research by discussing the pragmatic effects arising from the use of meta-argumentative verbs in a corpus of judgments delivered by the European Court of Human Rights (ECHR judgments, henceforth). Accordingly, the paper will show that the pragmatic effects of the recurrent meta-argumentative verbs in ECHR judgments can be analysed through the prism of politeness and legitimization strategies. In addition, suggestions will be provided regarding the ways in which corpus data can be used for raising learners’ awareness of the nuanced language that is pertinent to juridical settings.

The article focuses on the procedural peculiarities of court investigations in cases of missing persons and death declarations. The jurisdiction of such cases has been determined. The criteria and the arguments for declaring a person missing or deceased were singled out. The procedural status of the applicant and the person concerned was analyzed. The necessity to expand the range of case participants has been proved. Special attention has been paid to the court claim requirements. The article also examines the problem of object of proof and the process of filing the evidence to court in order to justify the applicant's claim. The paper reveals the issue of court judgements and the proceedings for its renewal. It also reveals the consequences in case such court statements are satisfied. The author examines the academic positions of those scholars who researched such institutes in civil procedure perspective as well as the case law.

The study is devoted to the field of criminal procedure law and special investigative activity, its topicality being determined by the complexity of the problems generated by some legislative inconsistencies likely to prevent the understanding and uniform application of the legal framework regarding the performance of special investigative measures. The reason for the initiation of this investigation is formed by the expressions: "within the criminal process" and "outside the criminal process", these being used in Law no. 59/2012 in the context of ordering the execution of different categories of special investigative measures. The analysis of the notion and legal content of the criminal process highlights the fact that within them the activity of investigative officers is not found as a subject competent to carry out special investigative measures. The problem addressed has both theoretical and practical value.

Trade custom is a rule that has developed in the field of commerce on the basis of a constant and uniform repetition of actual relationships. Trade custom is of great importance in international trade and merchant shipping. The role of trade custom is increasing in the regulation of those areas of foreign economic cooperation that are not regulated by laws. Trade custom plays a decisive role in the resolution of disputes between parties to arbitration. A trade custom must meet the requirements: it must have the character of a general rule, be known in the relevant field of trade, defined in its content and reasonable. A condition for the application of a trade custom is knowledge of it by the parties making the transaction. Trade customs determine the content of some conditions of contracts (if there are ambiguities and inaccuracies in contracts).
