Razvoj sistema e-nabavki u Bosni i Hercegovini

Uspostavljanje jedinstvenog portala za e-nabavke (www.ejn.gov.ba) krajem 2014. godine predstavlja dobar osnov za razvoj efikasnog sistema e-nabavki u BiH. Međutim, do sada je implementirana otprilike polovina funkcionalnih modula neophodnih za zaokružen sistem elektronskih javnih nabavki, a nedostaju i važni formalno-pravni preduvjeti, prije svega kada je riječ o podzakonskim aktima iz Zakona o elektronskom potpisu i izmjenama Zakona o javnim nabavkama, kojima bi se omogućilo elektronsko dostavljanje i evaluacija ponuda, što ukazuje na to da je sistem elektronskih nabavki još uvijek u ranoj fazi razvoja.

Iako pravna regulativa u Bosni i Hercegovini prepoznaje mobing kao oblik diskriminisanja, čini se da je neophodno donošenje posebnog zakona u ovoj oblasti, koji bi pravni režim zaštite od mobinga potpuno odvojio od zaštite od diskriminacije, te predvidio sve potrebne elemente borbe protiv mobinga, uključujući i snažnu preventivnu dimenziju.

Implementation of the access to information laws in BiH has been largely undermined due to weaknesses in the mechanisms intended to ensure compliance with the laws. Based on this policy analysis, two sets of recommendations for improving the enforcement and oversight of access to information have been formulated. One of the proposals points to improvements within the current institutional set-up, while the second set of recommendations refers to creating a new institutional oversight mechanism as a potentially transformative solution to these problems.

Sistem socijalne pomoći u bosni i hercegovini: zanemareni potencijal aktivnih socijalnih politika

U aktuelnim raspravama o nedostacima i mogućim reformama sistema socijalne zaštite u Bosni i Hercegovini, uglavnom se zanemaruje problem nedovoljne usklađenosti i neintegriranosti socijalnih politika sa politikama tržišta rada, odnosno nedovoljno razvijena aktivacijska komponenta socijalnih mjera. Stoga je osnovni cilj ovoga teksta predstaviti aktuelne politike i trendove Evropske unije u oblasti socijalnih politika, naročito se fokusirajući na aktivacijsku dimenziju ovih politika, te analizirati postojeće stanje i institucionalni okvir u BiH u ovom kontekstu. Formulirano je nekoliko preporuka sa ciljem unapređenja postojećeg sistema socijalne zaštite u pravcu stvaranja pretpostavki za realizaciju njegove inkluzivne funkcije i implementacije aktivnih socijalnih politika.

Osobe koje pružaju neformalnu njegu nisu prepoznate u sistemu dugoročne njege u Bosni i Hercegovini (BiH). Postojeće mjere iz domena dugoročne njege su primarno usmjerene na osobe kojima je potrebna njega, pri čemu su potrebe neformalnih njegovatelja skoro u potpunosti zanemarene. Osnovni cilj ovog teksta je analizirati stanje u oblasti dugoročne njege s fokusom na neformalnu njegu u BiH i predstaviti međunarodne prakse u ovoj oblasti, koja je u većini zemalja Evropske unije prepoznata i sistemski uređena kroz različite vidove podrške i usluga neformalnim njegovateljima. Na osnovu identificiranih nedostataka i primjera dobre prakse u drugim zemljama, formulirano je nekoliko preporuka za sistematsko rješavanje pitanja neformalne njege u BiH.

Social Assistance System in BiH: The Neglected Potential of Active Social Policies

The problem of insufficient coordination and integration of social policies with labor market policies, i.e. the insufficiently developed activation component of social measures, is what is largely neglected in present discussions on the disadvantages and the possible social protection system reforms in Bosnia and Herzegovina. Therefore, the goal of this paper is to present the existing European Union policies and trends in the field of social policies, remaining specifically focused on the dimension of the activation of these policies, and to analyze the existing state and institutional framework of BiH in this context. Several recommendations are given with the goal of advancing the existing social protection system in the direction of creating a basis for the realization of its inclusive functions and the implementation of active social policies.

Tokom 2011. i 2012. godine Analitika je provela istraživanje o ključnim problemima u zaštiti pojedinaca od diskriminacije iz perspektive, isti na ograničene, sudske prakse u ovoj oblasti u Bosni i Hercegovini. Istraživanje je, pored ostalog, pokazalo da sudovi često ne razumiju i pogrešno interpretiraju ključne inovacije u parničnom postupku za zaštitu od diskriminacije, kao što je prebacivanje tereta dokazivanja na tuženog, te da se zakonom propisana hitnost antidiskriminacijskog postupka u pravilu ne poštuje. Pored toga, pojedina zakonska rješenja, kao što su ona koja se odnose na režim troškova postupka – koji je izrazito nepovoljan po žrtvu diskriminacije, prekratke rokove za podnošenje antidiskriminacijske tužbe ili na mjesnu nadležnost suda prema sjedištu tuženog, a ne tužitelja, nisu u skladu sa najboljom praksom u ovoj oblasti te, kao takva, predstavljaju dodatnu prepreku za efektivno utuživanje diskriminacije u Bosni i Hercegovini.

The Development of an E-Procurement System in Bosnia and Herzegovina

The establishment of a single portal for e-procurement (www.ejn.gov.ba) in late 2014 is a good basis for the development of an efficient e-procurement system in BiH. However, so far, approximately one half of the functional modules needed for a completed system of electronic public procurement have been implemented, and important formal-legal preconditions, primarily bylaws from the Law on Electronic Signature and the Law on Public Procurement, are missing. Those bylaws would enable electronic submission and bid evaluation. All of this indicates the electronic procurement system is still in an early developmental phase. That is why it is crucial that all elements of an electronic public procurement system are established as soon as possible, because they can significantly contribute to the improvement of transparency, efficiency and cost-effectiveness in public procurement in Bosnia and Herzegovina.

The Future of Public Service Broadcasting in Kosovo: Will a Hybrid Model of Funding Change RTK’s Status Quo?

Radio Television of Kosovo was established in 1999 through a comprehensive international assistance program. In the years following the handover from international management to local ownership its financial situation became increasingly vulnerable. In 2009, ten years after it went on air, the license fee, which was paid by all households in Kosovo and was the main source of funding for RTK, was suspended, and RTK turned to being fully dependent on state funding in subsequent years. The growing dependence on the state budget has also eroded its editorial independence and credibility. This policy brief analyses the proposed amendments to the existing RTK Law (2012) regarding the re-introduction of the license fee, the selection and term limits of the RTK Board and management appointments, as well as proposed methods to ensure that RTK has greater accountability. It explores the suitability of these proposals and their implications in regard to the prospects and future functioning of Kosovo’s public broadcaster.

The Law on the Prohibition of Discrimination of Bosnia and Herzegovina defines the Institution of Human Rights Ombudsman of Bosnia and Herzegovina as a central institution for protection against discrimination. However, the existing anti-discrimination mechanism provided for in the Law on the Prohibition of Discrimination is faced with a number of problems that affect the work of this Institution. The main structural problem relates to insufficient budget available to the Ombudsman of BiH, resulting in the lack of staff. Other problems derive from this circumstance, such as insufficient territorial coverage and accessibility of the Institution, as well as the lack of efficiency, specialisation and expertise in particular areas of discrimination. Moreover, the problems occur in the context of relationship between the courts and this Institution in cases of discrimination resulting from the lack of complementarity between the two. Thus, for example, courts may issue decisions contrary to the recommendations of the Ombudsman of BiH without providing reasoning for taking such action, which negatively affects the principle of legal certainty.

The question of publishing public procurement contracts in BiH is partly aligned with the requirements of the public procurement directives, but there are still some normative shortcomings, especially when it comes to completeness and functionality. This brief analyses the provisions of the Law on Public Procurement which regulate the publishing of public procurement contracts in BiH, and detects problems which undercut the principle of transparency. The main findings unambiguously indicate that thorough legislative reform is needed, and to that end the brief offers specific suggestions aimed at improving some of the legal solutions.

Although the adoption of the Law on Public Procurement for Bosnia and Herzegovina in 2014 introduced a series of new provisions aimed at improving transparency in the public procurement process, there are still significant limitations in this domain that can have significant negative implications in practice. Among other things, the legal framework has not ensured adequate availability of information on planned public procurement, given that public procurement plans are not published on the public procurement portal. The published procurement plans do not include procedures for lower value contracts, and decisions on these contracts are not published. There is a manifest lack of provisions that would contribute to publishing the contracts signed between the public sector and the suppliers. In addition, there are no guidelines developed for the application of tender evaluation criteria, especially criteria for the economically most favourable tender. It is, therefore, crucial to improve legal regulations to remove the identified shortcomings and ensure a significantly higher level of transparency in public procurement in Bosnia and Herzegovina.

Iako je usvajanjem Zakona o javnim nabavkama u Bosni i Hercegovini iz 2014. godine donesen i niz novih odredaba koje imaju za cilj unaprijediti transparentnost u procesu javnih nabavki, i dalje u tom domenu postoje ograničenja koja mogu imati značajne negativne implikacije na praksu. Zakonskim okvirom, između ostalog, nije osigurana adekvatna dostupnost informacija o planiranim javnim nabavkama, budući da se planovi javnih nabavki ne objavljuju na portalu javnih nabavki. Objavljeni planovi nabavki ne uključuju postupke za dodjelu ugovora male vrijednosti, niti se odluke o dodjeli ugovora putem ovih postupaka objavljuju javno. Uočljiv je nedostatak odredaba koje bi doprinijele objavljivanju ugovora koje javni sektor sklapa sa ponuđačima. Također, nisu razvijene smjernice za primjenu kriterija za ocjenjivanje ponuda, posebno kriterija ekonomski najpovoljnije ponude. Stoga je od ključne važnosti unaprijediti zakonsku regulativu kako bi se uklonile uočene manjkavosti, te osigurao znatno veći nivo transparentnosti u javnim nabavkama u Bosni i Hercegovini.

Unused Potential: The Role and Importance of Non-Governmental Organizations in Protection Against Discrimination in Bosnia and Herzegovina

The Law on the Prohibition of Discrimination BiH, inter alia, allows non-governmental organisations (NGOs) in BiH to provide support to victims of discrimination by participating in judicial proceedings on behalf of plaintiff and, for the purpose of abstract protection of victims of discrimination, by filing a collective lawsuit. Although the antidiscrimination law has already been in force for three years, the number of proceedings instigated under this Law is very low, and the participation of NGOs in its implementation is practically negligible. The obstacles preventing NGOs in engaging more actively in antidiscrimination proceedings are partly the result of the legal provisions themselves, but are primarily the consequence of certain practical problems, such as: the lack of stimulating environment for the participation of NGOs in judicial proceedings, the lack of financial and human resources and the technical problem of the lack of records on instigated proceedings.

Zakonskim okvirom o slobodi pristupa informacijama u Bosni i Hercegovini nije utvrđena obaveza javnih organa da samoinicijativno, i kada ne postoji konkretan zahtjev, objavljuju za javnost relevantne informacije koje posjeduju. Ovakva pravna regulativa značajno odstupa od novijih međunarodnih standarda u ovoj oblasti, koji nalažu da su javni organi dužni ne samo odgovarati na pojedinačne zahtjeve, već bi određene kategorije informacija od javnog interesa trebali objavljivati na proaktivnoj osnovi. U takvom pravnom okviru, oblast proaktivne transparentnosti nije adekvatno uređena, što se, između ostalog, ogleda u fragmentiranosti i parcijalnom reguliranju obaveze proaktivne objave informacija od javnog značaja, kao i nedostatku pravne zaštite korisnika informacija. Analiza propisa relevantnih za proaktivni segment prava na informaciju ukazuje na neophodnost zakonskog utvrđivanja minimuma standarda koji se odnose na sadržaj i kvalitet objave informacija od javnog značaja.
