The study has mainly in view the involuntary hospitalization of a person with mental disorders as a civil protection measure, as regulated by the Law on mental health and protection of persons with mental disorders No 487/2002, republished. In order to complete the characterization of this measure, the paper has also approached the aspects concerning the protection of the person suffering from mental disorders and that are governed by the Civil Code, but also by the new Criminal Code and the new Criminal Procedure Code.

Analysing the case law of the Constitutional Court, we cannot but notice the tolerant attitude of the constitutional litigation court with regard to the unorthodox trends of the executive power, which used the procedure laid down by Art. 114 of the Basic Law, often, as dictated by the momentary interests. As an author considers, in some cases the Court has laid down certain minimum conditions that need this procedure to be performed , but, in our opinion, the limitations instituted are too general and in the governmental practice the result was not the one anticipated. Relative to the approval of an emergency ordinance by Government’s accountability, it is a violation of both the constitutional provisions of Art. 114 and of the provisions of Art. 115, the right of the Government to pass ordinances being circumscribed to limits and conditions. Legislative delegation does not involve the adoption of laws but of governmental instruments, known as ordinances on which the legislator can subsequently intervene, by a law for their approval or rejection, while the institution provided for by Art. 115 of the Constitution, namely the accountability of Government for a draft law, is the procedure by which the executive, relying on the support of the parliamentary majority, determines the Parliament to adopt at the outset of a law which, once in force, produces legal effects until it will be changed by another law or ordinance.

A central character of the 20th century, Nicolae Caranfil contributed significantly to the development of the exact sciences. He was an important electrical engineer and manager. He was also the remarkable manager of the gas works in Bucharest (1930). He wrote also inlightning pages during confusing times for the economy and social consciousness. He was the first Minister of the Air and Marine. He was an important intellectual. In the last 34 years of his life he was not allowed to return to Romania. He is buried in New York.

The article aims to analyze the problem in question, that of determining whether an offense committed while the defendant was in prison for the retrial of his case is committed in a state of recidivism against the sentence to which he was sentenced in absentia, or in state of competition with respect to the sentence to which he is sentenced following the admission of the retrial request. The second option is chosen in the study, among the considerations being the one according to which the trial in the first procedural cycle, carried out in the absence of the defendant has a formal role, preserving the evidence and preventing the fulfillment of the limitation period. criminal law, there can be no question of a true authority of res judicata, the decision being under the condition precedent of the arrest of the defendant and the execution of the sentence.

Kafka’s novella, The Metamorphosis, foregrounds the condition of the individual in the modern society, an individual who is weighed down by the awareness of his own insignificance in relation to the others and his own dreams. By means of memory, he tries to resist his new identity in an alienated and alienating world/space in which the others gradually turn from powerless witnesses into mighty ‘victimizers’ whose indifference proves too much for the weakened self. Our paper approaches the metamorphosis Kafka displays in his novella from the perspective of the relation between the individual and the others, viewed through the lens of the (in)ability to stay human(e).

It is known that the 1930s have been troubled, with strong tensions, marked by a series of sustained polemic debates, with the intellectual world suffering major ideological splits. Thus, on the public stage of the indigenous intelligence will appear Mircea Streinul, a young writer and follower of the „philosophy of life”, determined to tell the truth that he considered to be defining for the times he lived. The study presents some of the positions and polemics reflecting the thinking of the young generation of Romanian intellectuals in the Bukovinian space, around Mircea Streinul, the ferment of the Iconar Movement, which established itself as an important writer, poet and writer, translator, leading exponent of a group that aimed to reinvigorate the province, to shift the emphasis on the periphery to the detriment of a centrality that he saw as excessive and harmful at the same time.

The article is devoted to the archaeographic description of the undated parchment Psalter, copied by Hieromonk Epiphanius in the Putna Monastery. The manuscript is currently kept in the Russian State Library in the collection of P.A. Ovchinnikov (Fund 209, No. 785). The dating of the codex is based on the mention of Voivode Alexandru (Lăpușneanu) in the scribe’s note.

The N.I.S.T. agenda describes the activity of the institute’s researchers during the first half of this year.
