Summary/Abstract: U organizaciji Univerziteta u Sarajevu – Instituta za istraživanje zločina protiv čovječnosti i međunarodnog prava, u Svečanoj sali Rektorata Univerziteta u Sarajevu 9. januara 2025. godine održan je Naučni skup “Instrumentalizacija i politizacija nacionalnih prava: Deklaracija ‘Svesrpskog sabora’ kao kontinuitet velikodržavne politike”. Učešće u Naučnom skupu uzela su 34 naučnika i istraživača s više univerziteta i institucija iz Bosne i Hercegovine, koji su kroz različite segmente izlagali svoje radove o Deklaraciji “Svesrpskog sabora”. Rezultat održanog skupa je i pripremljeni Zbornik radova pod naslovom Instrumentalizacija i politizacija nacionalnih prava: Deklaracija ‘Svesrpskog sabora’ kao kontinuitet velikodržavne politike. Zbornik predstavlja rezultate teorijskih i empirijskih istraživanja naučnika i istraživača, uključujući i javne djelatnike u institucijama države Bosne i Hercegovine i entiteta Republika srpska (RS) o temi vezanoj za Deklaraciju o zaštiti nacionalnih i političkih prava i zajedničkoj budućnosti srpskog naroda, koju su 8. juna 2024. godine u Beogradu usvojili predsjednik Republike Srbije i predsjednik entiteta RS, predsjednici, potpredsjednici i članovi Vlade Republike Srbije i Vlade RS, predsjednici, potpredsjednici i narodni poslanici Narodne skupštine Republike Srbije i Narodne skupštine RS, uz blagoslov, molitveno i saborno učešće Njegove svetosti patrijarha srpskog Porfirija i arhijereja i sveštenstva Srpske pravoslavne crkve.

- Summary/Abstract:This paper examines the constitutional and legal implications of the PanSerbian Assembly held in Belgrade in 2024, with particular emphasis on the Declaration on the Protection of National and Political Rights and the Common Future of the Serbian People and the ancillary acts adopted for its implementation, for the constitutional order of Bosnia and Herzegovina. Considering the constitutional framework of Bosnia and Herzegovina, the analysis assesses the legal nature of the Declaration and considers whether it may be qualified as an expression of “special parallel relations” between the entity of Republika Srpska and the Republic of Serbia within the meaning of Article III(2)(a) of the Constitution of Bosnia and Herzegovina. The paper further evaluates whether such relations, as articulated and operationalized through the Declaration, comply with constitutional standards relating to the protection of the BiH state sovereignty and territorial integrity, the principle of the constitutent peoples, the prohibition of discrimination, the duty of entity loyalty to the state, and the binding force of the decisions of the Constitutional Court of Bosnia and Herzegovina. The paper subsequently analyzes the legislative, institutional, and practical consequences arising from the implementation of the Declaration, including the harmonization of the legal framework of Republika Srpska with that of the Republic of Serbia, the establishment of various joint bodies, the designation of joint holidays, and the creation of memorial institutions. It argues that these measures are inherently discriminatory insofar as they place one constituent people – the Serbian people—in a privileged position, and that they constitute a systemic deviation by the Republika Srpska from the constitutional principle of loyalty to the state of Bosnia and Herzegovina. The paper ultimately concludes that the Declaration and the measures adopted for its implementation pose a serious threat to the rule of law and the constitutional order of Bosnia and Herzegovina. Moreover, they undermine the authority of the decisions of the Constitutional Court of Bosnia and Herzegovina and represent an attempt to re-establish mono-ethnic exclusivity in the governance of Republika Srpska – an approach that has been unequivocally declared unconstitutional in the established jurisprudence of the Constitutional Court of Bosnia and Herzegovina.

- Summary/Abstract:This article examines the Declaration on the Protection of the National and Political Rights and the Common Future of the Serbian People, adopted at the All-Serb Assembly in Belgrade in 2024, through the prism of the sovereignty and territorial integrity of Bosnia and Herzegovina as fundamental principles of international and constitutional law. The article emphasizes that the entities of Bosnia and Herzegovina do not possess international legal personality and that their competences derive exclusively from the Constitution of Bosnia and Herzegovina. Within this framework, particular attention is devoted to the constitutional limits of permissible “special parallel relations” under Article III/2(d) of the Constitution, as well as to the legal and political consequences of arrangements that exceed this constitutional threshold. Initsanalyticalsection,thearticlesituatestheDeclarationwithinthecontinuity of a greater-state ideological matrix, highlighting the transformation of objectives from overt territorial claims toward “soft” forms of power, including cultural hegemony and institutional penetration. The Declaration is subsequently examined point by point, with the identification of key thematic clusters: the institutionalization of the Assembly and the National Council; identity homogenization; the role of the Serbian Orthodox Church; Kosovo; revisionism concerning the wars of the 1990s and the genocide in Srebrenica; the delegitimization of Bosnia and Herzegovina through specific interpretations of the Dayton framework; security positioning; symbolic politics; education and collective memory; memorialization; demographic policy; and economic and infrastructural integration. The concluding section of the article reveals that the Declaration has not remained at the level of political symbolism, but has been accompanied by concrete legislative, by-law, and administrative measures (the establishment of memorial institutions, normative interventions concerning symbols, educational regulations and harmonization, as well as agreements and “roadmaps” in strategic sectors), thereby establishing durable mechanisms of coordination between theRepublic of Serbia and theBosnia and Herzegovina entity ofRepublika Srpska (RS) outside the institutionalframework ofBosnia and Herzegovina. The cumulative effect of these processes is assessed as a serious constitutional and political challenge to state functionality, the rule of law, European integration, and regional stability.

- Summary/Abstract:This study analyzes the politics of memory in the context of the Declaration of the All-Serbian Assembly as a contemporary normative-discursive framework through which historical events, identity narratives, and political objectives of the Serbian national corpus in the post-Yugoslav space are reinterpreted. Drawing on key theoretical insights, the research examines how the Declaration functions as an instrument for the institutionalization of selective memory and historical revisionism, aimed at homogenizing collective identity and legitimizing specific political claims in the Western Balkans region. Particular attention is devoted to the ways and patterns through which the Declaration establishes continuity with narratives from the 1990s, including interpretations of the dissolution of Yugoslavia, the wars, the status of Kosovo, and the position of Serbs in Bosnia and Herzegovina and Croatia. Through an analysis of the content of the Declaration, accompanying political statements, and symbolic practices, the study demonstrates how the politics of memory is employed to normalize nationalist discourses, relativize responsibility for war crimes, and reaffirm the idea of a supranational political and cultural unity of the Serbian people. Methodologically, the research is based on qualitative analysis of relevant documents and discourses, supported by engagement with the existing scholarly literature. In conclusion, the study argues that the Declaration of the All-Serbian Assembly represents an important element of a contemporary strategy of symbolic and normative action, through which the politics of memory is instrumentalized as a means of political pressure and the production of long-term “controlled instability” in the region, with significant implications for regional relations and the processes of European and Euro-Atlantic integration.

- Summary/Abstract:The paper analyzes the concept of the “Serbian World” as a contemporary revisionist strategy of official Belgrade aimed at reshaping the geopolitical and normative architecture of the Western Balkans. Drawing on a realistconstructivist paradigm, the “Serbian World” is interpreted as a project that simultaneously encompasses material dimensions (power, territory, institutions, security arrangements) and ideational dimensions (identity, historical memory, and norms). The paper also develops a typology of revisionism through three ideal types and demonstrates how the “Serbian World” evolves from a predominantly normative form toward a combined, third type of revisionism, in which both the existing order and state borders are contested. Methodologically, the study is based on qualitative analysis of strategic documents of the Republic of Serbia, legal acts, and statements by political and ecclesiastical elites, as well as relevant secondary literature, complemented by a comparative analysis with the Russian concept of the Russian World (Russkiy mir). The paper concludes that the “Serbian World” represents a rebranded version of the “Greater Serbia” project, adapted to the era of hybrid action, which-through a network of special and parallel ties, cultural-religious structures, and the information-media sphere-produces a condition of “controlled instability” inBosnia and Herzegovina, Montenegro, and Kosovo. This, in turn, opens space for synergy with Russian revisionism and for the long-term undermining of Euro-Atlantic integration in the region. The paper further examines possible developmental scenarios, ranging from prolonged “controlled instability” to the potential transformation of the concept through changes in domestic and international conditions, and highlights the implications for EU and NATO policies toward the Western Balkans.

- Summary/Abstract:Based on available sources and relevant literature, this paper examines key assemblies and mass rallies held from the beginning of the process of dissolution of the Socialist Federal Republic of Yugoslavia (SFRY) until the end of the 1990s. These gatherings were organized by governing political structures among the Serbian population in Croatia and Bosnia and Herzegovina, as well as by representatives of the Serbian Orthodox Church (SOC), particularly in relation to the issue of Kosovo’s status and constitutional framework. The analytical focus is placed on assemblies and rallies held in so-called “crisis areas” in Croatia and Bosnia and Herzegovina in 1990 and 1991, as well as on assemblies convened in connection with the “Kosovo question” in 1997 and 1999. Consequently, special attention is devoted to the assemblies in Srb and Donja Gradina in 1990, the rallies in Banja Luka in 1991, and the Kosovo-related assemblies of 1997 and 1999. Although these were not the only assemblies and rallies organized during the 1990s, their significance lies in the fact that they articulated strong nationalist messages and announced prospective changes to state and republican borders. The decisions adopted at these gatherings, the messages conveyed, the political and social context in which they were held, and the consequences they generated constitute the central analytical concerns of this study.

It reflects the continuity of destructive ideologies that have caused enormous damage to the entire region in the past. It represents a new platform for political pressures, territorial claims, and the shaping of narratives that can destabilize all countries in the region, especially Bosnia and Herzegovina. The declaration undermines the fundamental principles on which the EU and the UN are based.

- Summary/Abstract:The Declaration on the Protection of the National and Political Rights and the Common Future of the Serbian People (hereafter referred to as the “Declaration”), adopted on 8 June 2024 in Belgrade by a non-existent institution or a fictional citizens’ association called the “All-Serbian Assembly,” was endorsed by the parliaments of the Republika Srpska and the Republic of Serbia. It represents a continuation of the “populist“ movement established in the mid-1980s. As such, it defines the politics of the “Serbian World,” centered on the entities of Bosnia and Herzegovina (Republika Srpska) and the Republic of Serbia (again, RS). The Declaration provides a framework for unifying the concept of “Serb” as an official designation, regardless of where members of this “people” reside worldwide. It enumerates all continents with highly specific objectives, not only for identity consolidation and cultural homogenization of the concept of the “Serbian people” within the two “Serbian states” as defined by the Declaration (the two RS), but also as a tool of broader political mobilization. Among the listed actors, the Declaration is proposed by the “Serbian people” itself, reflecting the highest form of “populism“, in which political elites cloak themselves with this broad and abstract term. Its use is part of the notion of “assembly-ness” (sabornost), also invoked by the authors of the Declaration, which implies gatherings led by a self-proclaimed leader of the people-namely, the President of the Republic of Serbia-while others play largely ceremonial roles. This “populist“ structure, as the ideological foundation of the people’s movement (reflected in the ruling party’s name, the Serbian Progressive Party, and in the planned formation of the Movement for the People and the State), differs only in nuance from the template established by Milošević. The central figure is the leader and his National Council, which ostensibly supports other gatherings, yet this exclusive rallying around the leader under the banner of a “common future” is claimed as a right of the Serbian people, whom the Declaration portrays as possessing a millennia-long historical presence in these two “states,” always aligned with the “rightside of history,” and grounded in Orthodox Christianity.

- Summary/Abstract:In this paper, based on the facts, we attempt to clarify the dynamics of diplomatic relations between Bosnia and Herzegovina and Serbia from the official establishment in 1996 with the signing of a joint statement in Paris by the then presidents of the Republic of Bosnia and Herzegovina, Alija Izetbegović, and the Federal Republic of Yugoslavia, Slobodan Milošević, which will be the focus of our analysis, to the holding of the All-Serbian Assembly and the adoption of the 49-point declaration. The goal is to present the key aspects of the relations chronologically, based on available sources, with a focus on Serbia’s actions that cannot be characterized as friendly and good-neighborly. Our main assumption that we will examine is that Serbia, through its foreign policy actions towards Bosnia and Herzegovina, continuously tries to minimize Bosnian-Herzegovinian statehood, bypassing the state of Bosnia and Herzegovina and favoring the BiH entity of RS. Through analysis and data collection, we will attempt to present the factual situation, which is actually a consequence of the hegemonic pretensions of official Belgrade, which have their roots in the 19th century.

- Summary/Abstract:The paper analyzes the role of the Serbian Orthodox Church (SOC) in the Declaration of the All-Serbian Assembly, emphasizing that the SOC functions not only as a religious institution but also as a significant political and cultural actor. Through historical analysis, it demonstrates how the SOC has played a key role across various periods in preserving the identity of the Serbian people, as well as in shaping political and nationalist views. Representatives of the SOC propagated the idea of a “Greater Serbia” and justified the crimes that would be committed during the aggression against the Republic of Bosnia and Herzegovina between 1992 and 1995. In the post-Dayton period, the SOC intensified its presence in the public sphere, often overlapping religious discourse with national and political narratives, including the denial of the genocide against Bosniaks. Church dignitaries frequently make public statements on political issues, including relations with the state ofBosnia and Herzegovina. Such actions by the SOClegitimize national policies, particularly those aimed at preserving the autonomy of the entity, often framed through the lens of Serbian ethno-confessional identity. The paper highlights the institutional and symbolic mechanisms through which the SOC exerts influence – including its presence in the educational system, collaboration with political parties, and the use of religious holidays and symbolsfor political purposes. Special emphasisis placed on the concept of the Church’s “symbolic power,” which is manifested through the authority religious institutions hold in shaping social values and norms. The role of the SOC goes beyond traditional religious functions. It becomes a political subject that actively participates in the creation of collective identity, the formation of public opinion, and influence over political decisions. This position raises important questions about the boundaries between religion and politics, as well asthe implicationssuch a relationship hasfor democratic processes and social cohesion in Bosnia and Herzegovina.

- Summary/Abstract:The Declaration of the All-Serbian Assembly can be considered a continuation of the policy of a Great Serbia, especially when its implications for the state of Bosnia and Herzegovina are considered. This perspective arises from several key points within the Declaration that concern: national unity and identity, the role of the Serbian Orthodox Church, the interpretation of the Dayton Peace Agreement and finally, the relations between the entity of Republika Srpska and the state of the Republic of Serbia. Although the declaration does not explicitly call for a “Great Serbia“, its emphasis on Serbian unity, its interpretation of the Dayton Agreement, its relationship with entity Republika Srpska, and its stance on historical events and interpretations suggest a continuation of policies that undermine the sovereignty and territorial integrity of Bosnia and Herzegovina, and more broadly, a continuation of hegemonic politics. - Summary/Abstract:U nakani teorijske kontekstualizacije današnje rasprave o nacionalizmu, a na što smo kao znanstveni djelatnici pozvani, prvotno se zapitati o osnovnim značajkama doba našeg življenja. Samo iz jednog takvog širokog zahvata možemo razumjeti i odrediti svoju poziciju u svijetu kao i poziciju aktera o kojima raspravljamo. Složiti se s karakterizacijom svijeta francuskog geopolitičara Dominika Mojsija da je 20. stoljeće, kao stoljeće ideologija, zamijenjeno stoljećem identiteta, uprkos tome što se njemu u znanosti dodjeljivalo 19. stoljeće. Identitet, osobni i kolektivni, postaje jednim od ključnih pitanja našeg vremena. Ovo pitanje i ranije je bilo prisutno, ali nikada kao danas nije politizirano, ideologizirano i instrumentalizirano. To svjedoči i Deklaracija Svesrpskog sabora, na koju se referiram.

- Summary/Abstract:Stanje svijesti o državi u jednom kolektivu, zajednici, narodu ili društvu osnovna je pretpostavka svih pretpostavki. Deklaracija o kojoj danas govorimo izraz je, prije svega, stanja svijesti o državi kod jednog kolektiviteta. Malo prije smo čuli da je ključna pretpostavka pomjeranje fokusa i akcenta s osporavatelja na zagovaratelje Bosne. Potrebna je jedna mentalna revolucija, jedan novi početak za 21. stoljeće. Ako nemate vlastitu agendu, osuđeni ste biti dijelom nečije agende. Korisno je znati i pratiti agende drugih o sebi. U tom smislu, čestitam Institutu za istraživanje zločina protiv čovječnosti i međunarodnog prava Univerziteta u Sarajevu na organizaciji ovog skupa. Međutim, nije mnogo korisno i efikasno biti stalno u reaktivnoj poziciji. Pametnije je i mudrije, efikasnije i efektivnije, pa i u cilju odbrane od negativnih agendi drugih o sebi, razvijati vlastitu agendu.

- Summary/Abstract:Dužan sam prije bilo čega, ograditi se. Premda je skup izrijekom naučni, ovdje ne figuriram kao naučni radnik nego, prije i poslije svega, kao politički aktivan djelatnik, izabrani dužnosnik na nominalno visokoj, najvišoj funkciji koju Bošnjak može obnašati u entitetu Republika srpska, kao potpredsjednik entiteta. S takvim zaleđem čini mi se, preče je, značajnije i učinkovitije da se ovom skupu obratim najprije kao političar, ali možda bitnije i svrsishodnije kao stanovnik entiteta RS, vrlo dobro upućen u stvarne učinke srpske velikodržavne politike prije, u vrijeme i nakon donošenja i drugog Memoranduma SANU i Deklaracije Svesrpskog sabora.

Dokument koji sadrži 49 zaključaka, a koji su usvojile Vlada Republike Srbije i Vlada bosanskohercegovačkog entiteta RS na zajedničkoj sjednici, predstavlja okvirne smjernice za daljnje zajedničko djelovanje na uspostavi “srpskog sveta”, što je zamjenski naziv za ranije težnje uspostave “Velike Srbije”.
