General jurisdiction in maintenance matters under Regulation (ЕC) No. 4/2009 of the European Union

Summary/Abstract: The subject of the present article is the legislation of general jurisdiction in maintenance matters under Regulation (EC) No. 4/2009 of the European Union. The conditions for application of this type of jurisdiction, the criteria for its determination, as well as issues related to maintenance proceedings, such as seizing the court, examination regarding jurisdiction and admissibility are explained in the article. A comparison is made between the new legislation and the one that existed before – in the Brussels Convention, the Lugano Convention and its versions of 1988 and 2007, and the “Brussels I” Regulation. The proposals and changes discussed in relation to each analyzed text are pointed out. The analysis of legal texts is accompanied by the Bulgarian courts’ practice in their application.
