Summary/Abstract: The author focuses on the regulation of defense in pre-trial proceeding provided in the Act. 301/2005 Coll., Code of Criminal Procedure, as amended. It refers to situations which may arise during an examination of witness or witness in practice. At the same time the author in the article analyze the difference between repeating the examination of witness and supplementing examination of witness. Finally, the author discusses the status of lawyer in pre-trial proceeding and the amendment to Act no. 586/2003 Coll. of. Advocacy as amended by Act no. 335/2012.
