Summary/Abstract: The model of sustainable development based on sustainable economic growth is a new model of an economic development. It forces the transition from a post-industrial economy to an innovative economy, based on new technologies, knowledge and which creates high-paid jobs. At the same time, the state, both at the national and EU level, must pursue an active innovation policy. State policy must aim to ensure growth based more on knowledge, digitization and innovation, taking into account that foreign competition is intensifying, the economy is increasingly globalizing, and after the economic crisis there has been no clear period of economic recovery. Consequently, without stimulation in this respect, a scenario is likely in which, in the medium and long-term perspective, a number of negative trends will appear in the economy (eg. medium income trap or development trap). The analyze in the article confirmed that supporting innovative activity is an important task not only for the European Union, but also for all Member States, including Poland. From the EU and Polish legal regulations emerges a very complicated, though coherent legal framework for supporting innovative activity. The procedural framework, however, requires constant development in this area. Hence, innovation policy is conducted not only with help of legal regulation, but also with use of various measurements, which should be deemed as soft law.
