Unlawful registration of trademarks relating to the Arsenie Boca

Summary/Abstract: Two individuals and a trading company from England registered three brands with the names "Boca Father” ”Arsenie” and "The image of Arsenie Boca” to the European Intellectual Property Office. After one year they gave up the exploitation right in Romania to a trading company in Arad. Its representative filed criminal complaints and has summoned many entities to use them only after the purchase of holograms.At the insistent notifications of brand owners, the police have left icons and souvenirs in this category and triggered criminal investigations for unlawful use of a trademark. After documentation in this area has applied contravention fines for abusive use of the emergency number 112, and the trade mark proprietors filed criminal complaints against police officers.The phenomenon has spread to several areas of the country, so it was decided to take the files to the Prosecutor's Office to the High Court of Cassation and Justice.Criminal investigations can not disregard the lawfulness of registration of these marks, which needs to be analyzed from the point of view of internal legislation, in line with EU regulations.
