Summary/Abstract: Promulgation of regulations related to some social rights of non-retroactivity principle questioned the civil law. Courts from Romania have applied of non-retroactivity principle questioned in most cases involving the rights clearly established with finality, such as pension rights. There were also solutions to the contrary, the courts have made use of state law to change social policies and the binding force of Constitutional Court decisions. Divergent legal practice is useful and necessary to examine the non-retroactivity principle of civil law in terms of legal doctrine and jurisprudence.
