Errors and Abuses in the Restitution of Woodlands in Transylvania

Summary/Abstract: The post-revolutionary period has led to important changes in the field of real estate, due to numerous fraudulent transactions and property restitutions. There have been several operating modes regarding the latter, sometimes favoured by the inadequate legislation or erroneous judgments. An important segment is woodland and other real estate in Transylvania, restituted to persons who were not entitled to claim them. Competent authorities and some courts have shown passivity, or exaggerated in the interpretation of favourable aspects to those claiming them. They have not considered or have incorrectly valued some events and documents, such as land reform, collectivization, the consequences of the second Vienna Award and measures ordered by the allied powers. Probate documents presented in some cases were suspect as they created artificial links between former owners and the people who claimed the land or other particularly valuable real estate. Abuses and errors were more serious in the case of forest land, as an area larger than the existing one in Romania was claimed, often through actions specific to theorganized crime.
