Summary/Abstract: The objective of this article is show the basic legal regulations in the range of water protection and the sanction system of crimes against environment on the basis of penal codes in Poland and Czech Republic. The crimes in the Polish Penal Code are based on the effect or considerable destruction and significant damage in the environmnetal elements, and in the case of waters – significant lower quality. However, these evidences of crimes are not strictly defined by the legislature. While in the Czech Penal Code, the basis of penal sanctions is infringement of environmental protection and its elements with the strictly defined the evidences of crimes such as damage of environmental component, larger area and also graduated valuation of environmental damages.
