No-fault compensation systems in motor claims based on the experience of the United States

Summary/Abstract: The publication refers to the previously unsolved postulate of convertion of the Polish tort compensation system to the no-fault system. This system is based solely on the occurrence of damage, rejecting the need to document the fault of the offender and his civil liability. This system has been evaluated on the ground of more than 30 years of the USA experience in the operation of no-fault systems. The article defines no-fault systems, presents the history of these systems in the USA and presents the conclusions of the U.S. research “Experience with No-fault Automobile Insurance”. This study compares empirically selected macroeconomic values associated with the compensation system in specific states of the USA.
