Third party liability of real property managers, housing communities and cooperatives – selected problems

Summary/Abstract: This article attempts to draw attention to the problem of identification of the perpetrator and pur- suing claims under TPL of managers of real properties or housing communities by injured parties in connection with the use of multi-family buildings. It shows regulations governing the owner- ship title to the premises which have been separated out and third party liability of entities which take part in the process of managing real properties. Further in the article, the author presents basic problems of injured parties connected with proper indication of the party responsible for loss occurrence, i.e. using the law by insurers. In the final part of the article, the author draws read- ers’ attention to alternative liability present in the American common law system, which, when implemented properly, may contribute to strengthening of the consumer protection of owners of residential premises.
