Summary/Abstract: A passenger, as a consumer, is the weaker party to the transport contract. The European law provides the protection of passengers as part of consumer policy and within transport policy. This paper analyzes horizontal legal act of the EU, establishing principles and condition of aforementioned policies aimed at strengthening passenger rights within the EU. Improving passenger rights is, apart from the elimination of passenger transport market fragmentation, the purpose of the EU legal regulations in the field of transport. The scope of consumer protection is different in various branches of passenger transport, with sector type legal regulations. The majority of such legal acts in the form of the European Parliament and the Council regulations refer to air transport sector. They provide a large scale protection of airline passenger rights. Considerable is also the protection of the rail passenger rights, while other branches of passenger transport have only recently been provided with regulations that are to guarantee minimum level of the protection of passengers’ rights in future.
