Summary/Abstract: The authors analyze the state of law that has been binding in Polish hospitality in the last 25 years from the point of view of the economic freedom determined by the law. Part II of the paper presents the period when the 1997 act on tourist services was binding. That act introduced compulsory categorization of tourist accommodation establishments, permitting hotel services in non-standard establishments that meet the requirements provided by the law in force. The authors analyzed the changes in that act regarding hospitality and categorization regulations based on it, pointing out to a visible tendency of increasing economic freedom in the area of hotel services. They expressed their opinion that provisions of the discussed act regarding hospitality were generally adequate. However, the resignation from vocational qualifications of hotel personnel provided by that act should be criticized. The presented legal analyses have been illustrated by the CSO statistical data on the number of tourist accommodation establishments and other establishments in which hotel services have been offered in Poland over the period of the last of 25 years. It shows the influence of the wide spectrum of economic freedom, provided by the law binding in Poland, on considerable development of tourist accommodation facilities. Over the last 25 years fast growth has been noted in the number of hotels and other establishments in which hotel services were offered. In the final conclusions the authors opt for the principle of “more freedom, more responsibility” in legal guidelines for hospitality.
