Summary/Abstract: In accordance with the provisions of art. 55 of the Penal Proceeding Code, the Hight Court of Cassation and Justice transfers the judgment of a case from the competent court to another court of equal importance when the impartiality of the judges could be affected due to specific circumstances, to local enmities or to the quality of the parties, when there is a risk of public disorder or when one of the parties has a relative or an in-law up to the fourth degree amongst court judges, prosecutors, judicial assistants or clerks.
