The solution of the civil side in appeal after the abrogation point 17¹ of the art. 3859 par. 1 P.P.C.

Summary/Abstract: The appeal declared against a decision pronounced after the enforcement of Law no. 356/2006, that endorses in the 3rd degree of jurisdiction only the method for solving the civil side of the penal trial, will be rejected as unfounded when the decision of the appeals instance doesn’t include a mistake that must be taken into consideration also by the office.
