Summary/Abstract: The necesity of making a delimitation between the offence of pandering provided by art. 329 of the Criminal Code and the offences provided by Law 678/2001, art. 12 and art. 13, appears in the judicial practice in order to correctly classify the crimes that are committed. Firstly, we are talking about defending morality in what regards social life relationships and ensuring lawful livelihood, and secondly it’s about defending the right to freedom of will and action of the person.
