SOME ASPECTS REGARDING FELONY MURDER COMMITTED WITH CRUELTY

Summary/Abstract: This article presents some important issues and provides explanations about the circumstance found in the Criminal Code, art. 176. In the first place the definition of cruelty is being detailed the way it’s perceived and understood and for a better understanding eloquent examples and judicial practice are being put up for discussion. Next step consists in displaying different issues related to the initiation of criminal action, and also to the phase of criminal investigation, when the prosecutor has a duty, and that is to personally carry out all acts in principle.
